Re: Lot 6 Easment
Dear Don,
I hereby request a hearing before the City Commission
to request that the drainage easment along the rear lot
line of Lot 6,Excelsior Business Park be reduced from 15
to 6 feet.
As you know I have discussed this matter with the City
Engineer and he does not have a problem with this request.
I would appreciate being put on the agenda as soon as
possible

Re: Drainage Easement on Lot 6
Dear Mr. Munizzi:
In regard to your letter of September 25, 1990, and after having
several conversations with you regarding this easement, it is recommended
in lieu of abandoning the entire easement, that it be best to vacate all
but six (6) feet of this easement on Lot 6.
.
As per our conversations, you mentioned that the new building under
construction of Lot 6 infringes upon the existing drainage easement of
fifteen (15) feet by about 8.2 feet; thus the necessity of vacating all
but six (6) feet of the easement.
As a point of information, it would be best to relocate the stormwater
pipe, that is closest to the building, so that any potential pipe defect
would not impact the building.
Please note that you will have to follow the City procedures to have
this easement changed on your plat. It will be necessary to contact the
Land Development Coordinator for guidance.
If you have any further questions,'please contact this office.

Dear Mr. Rozansky:
On behalf of my client, Vernon Pi tt, I am wr i ting to request a
rehearing in order to allow the City Commission of the City of Winter
Springs to reconsider Mr. Pitt's application for the vacation of the
west five feet of the ten foot utility easement located in the rear of
Mr. pitt's yard.
It is my understanding that on July 23, 1990, after public
discussion, the First Reading of Ordinance 495 (which is the subject
of this vacation of utility/drainage retention easement request) was
approved by the City Commission. However, on August 27, 1990, at the
Second Reading, although a motion was made to approve the vacation, it
was denied for lack of a second to the motion.
Since that time, my client has obtained from the City of winter
Springs a copy of a Memorandum dated August 28, 1990 from Commissioner
William Jacobs to the City Attorney indicating that, in light of the
commission's denial of Mr. pitt's request, the City may have some
liability based on past approvals of similar requests. He has also
obtained copies of other Ordinances dated between 1985 and 1990 that
were approved for the vacation of easements simi 1ar to Mr. pi tt 's
request. Some of those which were approved recently are cited below:

In addition, Mr. Pitt has over 60 signatures on a petition from
his neighbors in the Tuscawilla Subdivision in support of his request,
stating that his neighbors have no objections to the improvement
proposed on his lot.
Mr. Pitt has also received and submitted to the Commission prior
to the first two readings of the Ordinance, letters from all affected
utility companies indicating that they have no objection to his
request.
It would appear, from the foregoing that: (i) the overwhelming
majority of Mr. pitt's neighbors are in support of his request:
(2) the utility easement is not, in fact, required for any utility
purpose: (iii) the City Commission had no problem whatsoever with the
request at the First Reading: (iv) the City Commission has somewhat
routinely granted similar requests to similarly situated citizens: and
(v) Mr. pitt is being singled out by the Commission for reasons that
are not immediately apparent.
Therefore, I request that a rehear ing be scheduled at the next
regular meeting of the Ci ty Commission in order to allow the Ci ty
Commission to reconsider its decision in this matter.

sole purchasers at this time. We have made a purchase
agreement with Jim Hartman based on Winter Springs City

A field inspection was made of Lot 6, North Orlando Ranches
