PUBLIC HEARING
REGARDING THE STATUS OF THE LAND USE CLASSIFICATION
FOR PARCEL 61 IN TUSCAWILLA
MONDAY, FEBRUARY 6, 1989
The Public Hearing was opened by Mayor Leanne M. Grove at 7:30 p. m.

Mayor Grove recessed the Public Hearing and then reopened at 8:00 p. m.

Attorney Kruppenbacher outlined the procedures for this hearing as follows:
the Developer will present anything and everything he wants to present to the
City to consider what they believe to be the land use designation in reference
to this parcel of property. Attorney Kruppenbacher explained they would present
this uninterrupted and at the conclusion of their presentation the Commission may
or may not have questions at that point. If the Commission has questions, they
will be asked and answered, then the public will be permitted to raise any and all
questions they may have regarding what was presented. Those questions will be
raised directly to the Mayor as Chair of the meeting and the Mayor will then
direct the questions to be answered. Subsequent to the citizens or anyone else
raising any and all issues, the Commission will then raise any additional questions
that they have regarding the matter. Following that the Developer will be permitted
to present anything additional and we will go back through that procedure once again
regarding any additional matters that are presented.
Attorney Kruppenbacher explained that this meeting is starting at 8:00 p.m. and is
going to adjourn at 10:30 p.m. and will be continued to another night if the Developer
or the citizens have not finished their discussion, and we will do that until the
process is completed. Following that aspect of this matter, Attorney Kruppenbacher
has asked the Mayor and Commission to continue the matter to permit the Staff an
opportunity to analyze everything that has been presented. Then the Mayor and
Commisison will take whatever appropriate action they deem should be taken. Everyone
will be sworn in and persons wishing to speak will sign up.
A court reporter was hired by the City Manager for the City to record the meeting
verbatim.
Attorneys David Brown and Rob Rosen with the law firm of Broad and Cassell were sworn
in by the City Clerk. As primary witnesses they have Charles True, original Engineer
with the project and Harlon Hanson, the original planner with the project. Attorney
Brown said they would be presenting numerous documents to the City and he explained
that their understanding of this matter was that the City, in reviewing a proposed
shopping center, a number of issues have been presented to this Council, and the issue
to be presented was the issue of the vested rights to PUD Commercial zoning on the
subject site within the Tuscawilla Planned Unit Development.

Mr. Charles True was sworn in. He explained his involvement with the project and that
he oversaw almost all of the engineering work, did most of the engineering through his
engineering firm and also oversaw the development involving all the streets, roads,
utilities etc.
Mr. Harlon Hanson was sworn in. Mr. Hanson explained that he was employed by Bill
Goodman, Norman Rossman and Roy Dye in 1970 to do the master planning for the project.

Attorney Brown requested the hearing be continued because they had another l~ to 2 hours
of discussion.
Mayor Grove called the next meeting on this subject for February 20th at 8:00 p.m.
The public hearing adjourned at 10:20 p. m.
