Authorization REQUEST: Public Works Department Requesting the City Commission Approve the Transfer of Land with the State of Florida to facilitate the completion of the Cross Seminole Trail and Magnolia Park PURPOSE: This agenda item is needed for the Commission to consider transferring an unimproved City Right of Way between SR 419 and Old Sanford Oviedo Road to the State in exchange for a portion of the Cross Seminole Trail adjacent to Magnolia Park. This agenda item is needed to swap lands with the State that will allow the completion of the Cross Seminole Trail in the industrial park and also provide additional area for the Magnolia Park Trailhead/Amphitheatre. The two areas to be traded are roughly equivalent in size. Exhibits are attached depicting both areas to be exchanged the The City would convey the unimproved right of way that exists from SR 419 across the CSX rail line to Old Sanford Oviedo Road. A utility easement would need to be retained for the existing water, sewer and fiber optic lines in this right of way. The conveyed right of way is to be used in conjunction with the right of way to be dedicated by Bart Phillips to complete the 0.71 miles missing link in the 16 mile Cross Seminole Trail. Completion is subject to CSX approving the trail crossing. Mr. Phillips is assisting Seminole County in obtaining approval for the crossing. In exchange for the City right of way, the State would transfer ownership of a portion of the existing trial right of way adjacent to Magnolia Park. As shown in the attachment, the additional October 12, 2009 Consent Agenda Item 206 Page 2 area is needed to make the amphitheatre a viable space. Construction on Magnolia Park will not commence until the additional right of way is obtained. In addition, the City Attorney's office is diligently working on acquiring the triangular parcel to the north of Magnolia Park. Magnolia Park could be constructed without acquiring this parcel (assuming the trail right of way is transferred) although some utilities would need to be adjusted. The process begins with submitting an Application for Land Exchange to the trail right of way "owner the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (BTIITF). Subsequent steps in the process include surveys and appraisals. Seminole County staff members are taking the lead in the land exchange process as they are the managing authority for the Cross Seminole Trail. FUNDINGS: No funding is required at this time. RECOMMENDATIONS: It is recommended that the City Commission authorize the City Manager and City Attorney to prepare and execute any and all documents needed for the exchange of unimproved City right of way between SR 419 and Old Sanford Oviedo Road for Cross Seminole Trail right of way adjacent to Magnolia Park.
