MONDAY, AUGUST 24, 1987
The Regular Meeting of the City Commission of the City of Winter Springs, Florida,
was called to order by Mayor John V. Torcaso at 7:30 p. m.

For the invocation, Commissioner Trencher asked for a moment of silent prayer.
The pledge of allegiance to the flag was led by Attorney Frank Kruppenbacher.
Motion was made by Commissioner Trencher to approve the minutes of August 10, 1987.
Seconded by Commissioner Kulbes. Discussion. Vote on the motion: Commissioner

for 1987:

Mayor Torcaso recessed the Commission Meeting and opened the public hearing. The
City Planner, Jacqueline Koch, explained this is the final action on the first set of
amendments of 1987. These are the five requests for which a public hearing was held
on May 4, 1987. At that time the Commission agreed to forward the requests to the
State and the Commission's intent to approve these amendments and change the Land
Use Map accordingly. The State reviewed them, they sent information to the County,
the Regional Planning Council and various state agencies. Mayor Torcaso asked if
anyone in the audience wanted to speak. There being no further comments, Mayor
Torcaso closed the public hearing and reconvened the Commission Meeting.

Comments from State of Florida Department of Community Affairs Regarding Proposed
Amendments to Land Use Element:
Miss Koch explained we have now received a letter from the Dept. of Community Affairs
that the proposed plan amendments to the future Land Use Map are consistent with
Sec. 163.3177, Florida Statutes.
Ordinances Implementing Land Use Changes:

Attorney Kruppenbacher read Ord. No. 394, 395, 396, 397 and 398 by title only on
second reading. Miss Koch showed the location of each parcel of land in each ordinance.
No one spoke for or against the ordinances. Mayor Torcaso closed the public hearing
and reconvened the Commission Meeting.
Motion was made by Commissioner Kulbes that Ord. No. 394, 395, 396, 397 and 398 be
approved and that Ord. No. 395 have an effective date of Oct. 20, 1987. Seconded by
Commissioner Hoffmann. Discussion. Vote on the motion: Commissioner Kulbes, aye;
Commissioner Jacobs, aye; Commissioner Trencher, aye; Commissioner Kaehler, aye;
Commissioner Hoffmann, aye; motion carried.
Public Hearing for Ord. No. 388, to extend its territorial and municipal limits to
annex the hereinafter described lands, etc. (Lot 12, Entz. Farms Add. #2, Denton)
Second Reading:
Attorney Kruppenbacher read Ord. No. 388 by title only on second reading. Mayor
Torcaso recessed the Commission Meeting and opened the public hearing. Miss Koch
explained the property is 6.85 acres north of the Old Sanford/Oviedo Road/at Wade Street.
No one spoke for or against the Ordinance. Mayor Torcaso closed the public hearing
and reconvened the Commission Meeting.
Motion was made by Commissioner Jacobs to adopt Ord. No. 388. Seconded by Commissioner
Trencher. Discussion. Vote on the motion: Commissioner Jacobs, aye; Commissioner
Trencher, aye; Commissioner Kaehler, aye; Commissioner Hoffmann, aye; Commissioner
Kulbes, aye; motion carried.
Public Hearing for Ord. No. 389, to extend its territorial and municipal limits to

explained the property is two lots in a residential subdivision on south side of
Florida Ave. The property is across from light industrial and adjacent to the green

belt area of the Highlands. No one spoke for or against the Ordinance. Mayor
Torcaso closed the public hearing and reconvened the Commission Meeting.
Motion was made by Commissioner Jacobs to adopt Ord. No. 389. Seconded by
Commissioner Kulbes. Discussion. Vote on the motion: Commissioner Trencher, aye;
Commissioner Kaehler, aye; Commissioner Hoffmann, aye; Commissioner Kulbes, aye;
Commissioner Jacobs, aye; motion carried.
D. Amendments to Comprehensive Plan Land Use Element-Second Set of Full-Scale
Amendments for 1987:
1. Local Planning Agency Recommendations of Aug. 12, 1987:
a. Lot 12, Entzminger Farms Add. No. 2 - 7 acres north of Old Sanford-
Oviedo Road
b. Reclassification of property to Commercial Land Use - Lots 1-4, Pt.
Lots 5-6, P.K. Yonge Grant; and Lots 3-7, Pt. Lot 8, Blk. A, Mitchell
Survey - 414 acres east of Brantley Ave. north of S.R. 434.
The City Planner explained this is the second set of amendments. The Planning and
Zoning Board recommended approval of both parcels.
2. First Commission Public Hearing prior to Transmittal of Proposed Amendments
to State:
Mayor Torcaso recessed the Commission Meeting and opened the public hearing.
There was no comment from the audience on Item 1. On Item 2, Mr. Schrimsher
was present and spoke to the Commission in reference to the property. There was
discussion of the wetlands area and much of the property will have to be left as it is.
Mayor Torcaso closed the public hearing and reconvened the Commission Meeting.
Motion was made by Commissioner Hoffmann that we proceed with the process with Item
D-la to change the Land Use Map. Seconded by Commissioner Trencher. Discussion.
Vote on the motion: Commissioner Kaehler, aye; Commissioner Hoffmann, aye; Commissioner
Kulbes, aye; Commissioner Jacobs, aye; Commissioner Trencher, aye; motion carried.
Motion was made by Commissioner Jacobs to continue on Item D-lb. Seconded by
Commissioner Hoffmann. Discussion. Vote on the motion: Commissioner Hoffmann, aye;
Commissioner Kulbes, aye; Commissioner Jacobs, aye; Commissioner Trencher, aye;
Commissioner Kaehler, aye; motion carried.
Announcement of Second Commission Public Hearing prior to Adoption of Amendments:
The City Planner, Jacqueline Koch, stated that there will be a second public hearing on
these amendments after the State's comments are received and prior to final action on
the amendments.
E. Small-scale Amendments to Comprehensive Plan Land Use Element:

The City Planner explained under the revised rules, there are exemptions for properties
that are less than 3 acres of commercial which allows us to proceed without going
through the full scale process. All of the above five properties are within that
criterial. The Land Planning Agency recommends approval of each.
2. First Reading of Ordinances to Implement Small-Scale Land Use Changes:
Motion was made by Commissioner Jacobs to put Ord. No. 402, 403, 404, 405,
and 406 on the Agenda for action to be read by title only. Seconded by Commissioner
Trencher. Discussion. Vote on the motion: Commissioner Kulbes, aye; Commissioner
Jacobs, aye; Commissioner Trencher, aye; Commissioner Kaehler, aye; Commissioner
Hoffmann, aye; motion carried.

Ord. No. 402, title is as follows: An Ordinance of the City of Winter Springs, Florida,
amending the Comprehensive Plan in accordance with F.S. 163.3187; providing for the
addition of annexed property to the Land Use Map at Light Industrial Classification;
providing for the zoning category C-2 for the property on the Official Zoning Map;
severability, conflicts, and effective date.
Ord. No. 403 title is as follows: An Ordinance of the City of Winter Springs, Florida,
amending the Comprehensive Plan in accordance with F.S. 163.3187; providing for the
reclassification of property to Light Industrial on the adopted Land Use Map; providing
for the rezoning of the property to C-2 on the official Zoning Map; severability,

first reading. Seconded by Commissioner Hoffmann. Discussion. Vote on the motion:

Kane & Associates Letter of August 7, 1987:
Manager Rozansky presented the letter to the Commission for their concurrence, and
the Commission concurred.
I.W.S. Refuse Pickup Dates:
Mr. Bazinet and Mr. Tom Daly, representing Industrial Waste Services, spoke to the
Commission about the change in the pickup to a Saturday-Wednesday schedule, for
customers north of S.R. 434. They explained this is just a temporary schedule.
Motion was made by Commissioner Jacobs that we grant the Wednesday-Saturday pickup
north of S.R. 434, and remain with the Tuesday-Friday pickup south of S.R. 434 for
a period not to exceed one year, and to be reviewed in six months. Seconded by
Commissioner Kulbes. Discussion. Vote on the motion: Commissioner Trencher, aye;
Commissioner Kaehler, aye; Commissioner Hoffmann, aye; Commissioner Kulbes, aye;
Commissioner Jacobs, aye; motion carried.
Winter Springs Water & Sewer-Effluent Disposal:
Manager Rozansky explained we have received some engineering from the Utility Manager
along with a letter in reference to this effluent disposal program. Mr. Doug Taylor
and Mr. Terry Zaudtke, CPH, were present to explain the program. The proposed spray
irrigation system is for the Dayron Perc Pond site and adjacent City property.

Motion was made by Commissioner Kulbes that we approve the installation of the
sprinkler system as outlined in the August 24th letter from the Utility Manager
to the City Commission, cost is $16,470 and subject to D.E.R. permitting.
Seconded by Commissioner Jacobs.Discussion. Vote on the motion: Commissioner
Kaehler, aye; Commissioner Hoffmann, aye; Commissioner Kulbes, aye; Commissioner
Jacobs, aye; Commissioner Trencher, aye; motion carried.
Commissioner Trencher asked that the surrounding homeowners be notified about this
spray irrigation system.
City Manager Rozansky thanked Mr. Taylor for his work on this proposal.
Monthly reports have been distributed.
Attorney Kruppenbacher spoke about the settlement agreement with Florida Public
Utilities and the Answer to Complaint he filed in reference to the Seminole County
Impact Fee lawsuit.
Commission Seat I - Cindy Kaehler:
No report.
Commission Seat II - Arthur Hoffmann:
Commissioner Hoffmann asked about an ordinance regulating pit bulls, etc. Commissioner
Hoffmann said he was asked by an Oak Forest homeowner whose responsibility it is to
clean the creeks.
Commission Seat III - Philip A. Kulbes:
Commissioner Kulbes spoke about the Senior Citizens Open House held at the Civic
Center on Aug. 23, which was attended by 125 persons.
Motion was made by Commissioner Kulbes to approve an amendment to the Agenda to ask
the Commission to approve $5.14 to reimburse the senior citizens for their Open
House refreshments. Seconded by Commissioner Trencher. Discussion. Vote on the motion:
Commissioner Hoffmann, aye; Commissioner Kulbes, aye; Commissioner Jacobs, aye;
Commissioner Trencher, aye; Commissioner Kaehler, aye; motion carried.
Motion was made by Commissioner Kulbes to approve the expenditure of $5.14 to the
Senior Citizens Advisory Group to cover the cost of items purchased for the open

Commission Trencher spoke in reference to Commissioner Kulbes' letter to D.O.T.
reference the traffic situation on S.R. 434 in front of the Winter Springs
Elementary School.

Mayor Torcaso reminded everyone of the Legislative Cookout at Barker Springs on
Sept. 24th.
Mayor Torcaso read the Election Proclamation, proclaiming the Election to be held
on November 3, 1987, as follows: A municipal election will be held in the City of
Winter Springs, Florida, on the 3rd Day of November, 1987, for the purpose of
electing a Mayor, Commissioner Seat II and Commissioner Seat IV, each for a three
year term of office.
In the event there will be a County-wide election, the Polling Place locations will
be:
Precinct 13 - Winter Springs Civic Center, 400 N. Edgemon Ave.
Precinct 24 - Seventh Day Adventist Church, 50 S. Moss Road

Dear Mr. Rozansky:
As you are aware, it is our goal to ensure that the citizens of Winter
Springs receive the finest services available. As the city grows, from
time to time it will be necessary to change collection schedules. After
a thorough review and analysis new boundaries were drawn to give a more
easily defined collection schedule. Specifically, we changed 86 customers
on the North side of 434 in the Meadowlark area from a Tuesday _ Friday
schedule to a Wednesday - Saturday pickup to coincide with the rest of
the houses that were already getting Wednesday - Saturday pickup. Now,
two things have been accomplished:
1. Using 434 as a readily recognizable landmark, all residents on
the North side receive Wednesday - Saturday and all residents on
the South side receive Tuesday - Friday. (In the past some confusion
existed when residents saw that some people on the North received
service on Tuesday and Friday and some people on Wednesday and Saturday).
2. With the geographical breakdown of service days as now constituted,
projected growth in both areas will not cause schedule changes in
the foreseeable future.
When we instituted the change, we delivered notices of the change to all
parties involved on two separate occasions. If you think it necessary
to give formal council notice, please let us know what avenue to follow.

Spray Irrigation System
Dayron Perc Pond site
The following is a estimated cost analysis for a
proposed spray irrigation system for the Dayron Perc
Pond site and adjacent City property. The perc ponds
already have the irrigation system installed. To
expand this system will require up sizing some of the
lines and installing new lines as indicated by the
dotted lines. The total area to be under irrigation
is approximately 11~ acres and should if permitted
give us about 87,000 gallons of effluent disposal.

Pursuant to section 163.3184, Florida Statutes, the
Department of Community Affairs has conducted a review of the
proposed amendments to the City of winter springs' local
comprehensive plan.
Our review indicated that the March 20, 1987 proposed plan
amendments to the Future Land Use Map are consistent with section
163.3177, Florida statutes. Once the adoption process is
complete, the Department requests a copy of the amended
comprehensive plan as required by section 163.3187(3), Florida
statutes.
