MEMORANDUM

Development/Unit: Highlands Glen,
Applicant/Agent: Ken Levitt/Rollingwood Dev. Corp.,
Review/Action Requested: City Commission review/approval of
final engineering/plat.
Pursuant to the applicable sections of the City Code, the City Staff
finds the plans for the development (identified above) are approvable
subject to the following conditions:
1. All conditions specified by Staff memoranda:
A. City Engineer/Public Works Director's memo dated 27 Apr. 84,
attached, and;
B. City Fire Chief's memo dated 24 Apr. 84, attached, and;
2. Resolution, to the satisfaction of the City Attorney and City
Planner, of omissions/discrepancies in the submission by the
applicant (identified, refer two (2) letters by City Attorney
dated 2 May 84, file).
Additionally, representatives of the Big Cypress Golf Club, and the
Highlands Homeowner's Association Architectural Review Bd. have reviewed
the final plans (identified) and object to the rear set-back of ten (10)
feet, preferring instead a twenty five (25) ft. setback (refer letter of
April 9,1984, attached). No objections were raised to a setback of ten
(10) ft. as it was depicted in the preliminary plan.

The Highlands Homeowners' Association Architectural Review Board has
reviewed the final site plan for Highlands Glens.
It is the decision of the Board to reject the submitted rear set-back
of ten feet. A twenty five foot rear set-back will be required.

Dear Mr. Elwell:
As a followup to our telephone conversation several days ago,
I am sending you this letter to advise you of our interest
and concern regarding the project planned by Rollingwood
Development Corporation which is named Highlands Glens. Our
interest in this project arises from the fact that we are
the owners of the Big Cypress Golf Course which is imme-
diately adjacent to the proposed project.
As I understand from my conversation with you, the City of
Winter Springs has given preliminary site plan approval to
the Highlands Glens project. Prior to the City of Winter
Springs giving final approval, we respectfully request that
you give consideration to the following information:
Our primary concern is over the preservation of all of the
trees and shrubbery on our property. We feel that these
trees and shrubbery are threatened if buildings are to be
constructed within 10 feet of the property line as the
current plat plan indicates. This threat manifests itself
in two ways. First, prior to construction, considerable
muck will have to be removed beneath the building pads
during which time the water table will be lowered due to
water being pumped out as part of the muck removal operation.
The lowering of the water table in the area will therefore
put our trees in jeopardy because, without water, the muck
tends to dry out and oxidize and no longer supplies the
necessary support for our trees. Secondly, it is not only
difficult, but almost impossible, not to damage the root
structure of our major trees such as maples and oaks which

lie on our property but close to the line. If the buildings
and related construction activities were allowed no closer
than 25 feet of our property line, I believe our trees and
shrubbery would be spared. At the time this property was
sold to Rollingwood by Florida Land Company, the sales
contract, in contemplation of this problem and the need to
preserve natural green areas on the golf course, included
a restrictive covenant which prohibited the construction of
any buildings closer than 25 feet to the property line of
the golf course.
We have met ,.,ith Mr. Ken Levitt of Rollingwood Homes and have
made our concerns known to him, and have requested that he
honor the 25-foot setback. As of this time, we have received
no affirmative response from him.
Please notify us in advance of any further public meetings
between the City of Winter Springs and Rollingwood Homes
regarding site plan approval of this project, especially any
meeting which can result in final site plan approval.

this matter.

Gentlemen:
We have reviewed the proposed homeowners association documents
for Highlands Glen (your copy of the Declaration is enclosed), and
based upon our review it is our opinion that:
1. Assuming the proposed Declaration of Easements, Covenants,
Conditions and Restrictions is properly executed and
recorded in the Public Records, its provisions will bind
all future property owners within the subdivision. The
proposed Declaration of Covenants and Restrictions includes
provisions which contain adequate assurance that the
Association will maintain the common areas within the
subdivision at the expense of the Association, except that
the enclosed provision entitled "Continual Maintenance"
should be added.
2. We were not provided with a copy of the proposed Articles
of Incorporation of the homeowners association.
Please let us know if you have any questions regarding this
matter.
