to request that \\e be allOlai to place a split rail fence adjacent to the public
sidet'lalk on Lot 3, 4, and 5 Blk 2 North Orlando Ranches for the purposes of enclosing
our rrodel center. Adjacent to both lots are vacant sites, one of vilich will be used
for our parking area. Considering the fact that this fence will not be in any public
areas vilich will distract traffic or pedestrian flON, \\e feel that this request is
certainly within reason.

SUBJECT: Recording Plat of Greens Pointe (formerly Hawk's Landing)
Pine Grove Holding Corp. requests approval to record the plat of Greens
Pointe in the Highlands, a patio home development previously known as
Hawk's Landing.
The original plat and supporting documentation are in order except for
the following:
(1) Three substantive corrections to the deed restrictions, with which
the applicant agrees.

(2) Written approval from the Highlands Homeowners Assn. of the deed
restrictions for Greens Pointe Homeowners Assn.
(3) Execution of the deed restrictions, articles and by-laws.

SUBJECT: Recording Plat of Pinewood Terrace
Winter Springs Terrace Partnexship re~uests approyal to record the plat of
Pinewood Terrace, a quadruplex development on the east side of South Moss
Road.
The original of the plat and the supporting documentation required~ the
Code have been received and reyiewed. The submittal is in order except
for the following:
(I) Approval by the City Attorney of cross~ccess easements coye,ring
three common driveways, and execution of these easements,
(2) Two minor substantive corrections to the deed restrictions.
( 3)
Certification by the contractor that all paving, drainage,
water, and sewer improvements have been fully installed, to
eliminate need for their assurance by a performance bond.

Coordination/Synthesis of The Findings of Staff Review:
The final plans are approvable subject to the applicant's ability to meet

1. The City Planner must "verify" from evidence to be submitted by the
applicant that there is compliance with the City Engineer's memo of 25
November 83, (attached) on the preliminary plan, and including com-
pliance with the "Standard Provisos of Engineering Approval", (attached)
and including the $10,000 Homeowners Association "opening budget"
condition of approval, all sanctioned by the prior approval of the
preliminary plans (attached), and;
2. The City Planner must "verify" from evidence to be submitted by the
applicant that there is compliance with the City Engineer's memo of 7
December 83 on the final plan, (attached) and including compliance with

bldgs. 6 and 7 is to be moved to an eight (8) inch line extended
between bldgs. 10 and 11, and;
5. The hydrant adjacent to bldg. 41 is to be temporarily relocated to
north of bldg. 13, and;
6. The hydrant north of bldg. 25 is to be temporarily relocated to north

7. At such time that phase "II" may be constructed, the above hydrant

required improvements, all supplemental data shall be in the files or
shall be submitted to the City Planner, and;

By the Land Development Ordinance that was passed in 1981 there are two waivers
required. One is that the private roads designed do not meet the public road
standards in right-of-ways, sidewalks, and cul-de-sacs and another is that trees
shall be removed from right-of-ways. The Staff recommends that each of these be
waived in this instance to allow a 40 foot right-of-way with no sidewalks to allow
trees to remain in the right-of-way including some islands in the middle of the
paving and cul-de-sacs have a shorter turn around radius than would be required on
a public street. There is only one additional condition that we put on this
recommendation. There is a street going west which ends in multiple cul-de-sac,
which did have some one way traffic and some two way traffic. The Police Chief
would prefer that that all be one way and the Developers have agreed with that.
Motion was made by Commissioner Hartman, seconded by Commissioner Jacobs that we re-
approve final engineering for Hawk's Landing subject to the City Engineer's recommendation
and the City Planner's memo. Discussion. Vote on the motion: Commissioner Linville,
aye; Commissioner Jacobs, aye; Commissioner Grove, aye; Commissioner Hartman, aye;
Commissioner Adkins, aye; motion carried.
Planning & Zoning Board recommendations of Oct. 12, 1983: Preliminary Plan for Casa
Park Villas in Tuscawilla:
The City Planner explained the property is to the west and north of Phase I of
Tuscany Place. This property originally was to be future phases of Tuscany Place but
has been acquired by a new developer and the preliminary plan submitted is to be
fhases I and II of Casa Park Villas. The development differs from Tuscany Place in
4It~that it will be rather than garden apartments as a condominium, it will be ~ee-simple
>> townhouses with common areas and private roads controlled by a homeowners association.
~r. Allen Ginsburg, speaking for Casa Park Villas, the proposed development, said they
are setting up a $10,000 opening budget. If the homeowners themselves decide that a
tot lot is necessary or desirable by a majority vote, they can vote to do so, and
there will be money available to build it.

Approval to record plats of Tuscawilla Units 12 and 13 and Streets Lights was tabled
for two weeks.
Public Property-Moss Road Site:
Commissioner Adkins said that by putting the retention area in there we are g~v~ng
away city property which could and should be used for something else, either sold
or developed as City property in the future when it is feasible and financially
equitable to do so. Bill Holmes, Conklin, Porter and Holmes, explained that the
City is going to be required to put in this retention area by DER and the St. John's
River Management District. After discussion, it was decided to leave the plans as
they are.

Gentlemen:
We have reviewed the proposed homeowners association docu-
ments for Casa Park Villas (copies of the revised documents are
~enclosed), and based upon our review it is our opinion that:
1. ~Assuming the proposed Articles of Incorporation are
properly executed and filed with the Secretary of
State's Office, the Association will be validly
organized and existing under the laws of the State
of Florida.
2. ~Assuming the proposed Declaration of Covenants and
Restrictions is properly executed and recorded in the
Public Records, its provisions will bind all future
property owners within the subdivision. The proposed
Declaration of Covenants and Restrictions includes
provisions which contain adequate assurance that the
Association will maintain the common areas within the
subdivision at the expense of the Association.
Please let us know if you have any questions regarding this
matter.

Dear Dick:
Currently.all the amenities requir'ed through Phase 5 of the Phased Amenities
Package as presented in the September 26, 1977 letter from 1.D. Castellano
have been completed with the exception of son~ work now in orogress on the
jogging exercise path. All Phase 5 amenities are scheduled to be completed
for the end of this year.
Currently there are 2,225 developed lots in the Tuscawilla ~.U.D. There at'e
also 192 lots now under developmel:t.
In January we will be starting Phase 6 amenities. Two tenn1s courts will be
.placed along Trotwood Blvd next to the basketball courts ard adjacent to
the handball courts. A picnic shelter will be constructed ~ear the barbeque
pits adjacent to the playground. We also are planning to c~ear selected
areas around the large lake a'long with further excavation <hId deepening of
the small pond so that both bodies of water add to the resi,Jents enjoyment
of the total park facility.
We plan to complete the ,Phase 7 amenities, one baseball fie~d and two soccer
fields, prior to the end of 1984.

SUBJECT: NOWSCO Acquisition

1. Upon reviewing our progress with the acquisition of NOWSCO I feel that
the following comments/recommendations should be brought to your
attention. I am placing them before the Commission because we are
addressing policy matters.
a. Require the utility include the facility located at Fairfax
and SR 434 in the purchase agreement for the utility.
b. Consider hiring a qualified utility director shortly after
the holidays so that he/she will have the advantage of
taking part in the take over/organization of NOWSCO.

(1) I have had meetings with officials of NOWSCO, other
public and private utilities, our consulting engineer,
and our attorney. Presently I am in the process of
compiling necessary data from all of the above in
order to produce necessary check lists, a take
over plan, and recommendations on how I feel the
take over will best be completed. It was after
reviewing compiled data, meeting with various
officials and attempting to compile the referenced
documents that it became apparent to me that it
would be beneficial to hire a utility director.
c. I am concerned about the ability of NOWSCO to effectively dispose
of their total committed capacity, be it .85, .70 or .95 MGD.
I discussed this with our consultants and was informed that the
answers to my questions should come out in the physical inspec-
tion report of our consulting engineers.
2. In the mean time we have scheduled a workshop for December 20, 1983
at 7:00 P.M. Mr. Lang concurs and feels we should hold a workshop
on the subject of NOWSCO.

Dear Mr. Rozansky:
Enclosed please find a copy of a letter from Mr. Gerald
Chancellor of the North Orlando Water and Sewer Corporation
(NOWSCO). In our proposal, we state that at selected locations,
we will observe excavation and exposure by either the City or
NOWSCO of main water lines to verify the material of
construction, general condition, and depth of cover. Please
note that NOWSCO will not provide any excavation equipment
and/or labor assistance for these excavations. Also, NOWSCO
will require insurance certificates from the personnel or firms
pertaining to these activities prior to access. Is the City of
Winter Springs able to provide the required equipment, personnel
and insurance for these excavations?
Please advise our office of the City's response so that we may
act accordingly. An alternative method for investigation may be
available. Hand augering is labor intensive and does not
provide information on the condition of the pipe or the
materials of construction. If we can be of further assistance,
please call.

Please consider this communication to be confirmation of our discussions
of December 2, 1983, with yourself and Mr. Terry Zaudtke. It was a
pleasure meeting with you once again and we will look forward to working
closely with you and Mr. Zaudtke in the future. With regard to our
discussions, we will be pleased to coordinate with your staff in the

1.
Provide utility company field personnel to assist in
locating water mains, sewer collection lines, etc., and
furnish access to plant facilities and lift stations,
for inspection and testing activities.
Provide copies of all documentation requested at our
meeting of December 2, 1983. . It is desired that any
requests you may have for field records during the
course of your investigations be made in writing to
Mr. John Hall at our Winter Springs office, with a
copy of the request sent to me.
Utility company field personnel will assist in your
investigations as per #1 above, however, we will not
be able to perform any physical activities for your
inspectors. This would include such activities as
excavation of lines, assisting in lamping or televising
of sewer lines, performing fire flow testing or any
electrical testing, etc.
All inspections and testing activities will need to be
coordinated with Mr. John Hall, (327-1641), or me. A
minimum of twenty-four (24) hours prior notice will be
necessary in this regard.
All requests for utility records, correspondence and
like materials (other than field records) should be
directed to me.

6. Access to plant facilities and other utility systems
located in public right-of-ways and private easements
will be provided by the utility company. However,
access to the golf course and possibly other private
properties will require the consent of the responsible
parties.
We would, of course, reserve the right to perform re-testing and be
present during any testing/inspection activities. We would also appreciate
receiving copies of all testing and inspection reports.
As we discussed, the utility company is very concerned with the possible
damages that may result to the utility systems due to the inspection and
testing programs proposed. We will expect the City of Winter Springs and
your firm to accept full responsibilities and all liabilities for these
activities. In addition, the personnel and/or firms performing these
activities will need to have complete and sufficient insurance coverages.
In this regard, the following would be applicaqle, and for which we would ~~.__
expect confirmation in writing, including copies of insurance certificates:

and persons or firms employed by either of the foregoing shall, at
their sole expense carry insurance satisfactory to Utility Company
in the following forms, types and minimum amounts:
Workmen's Compensation - Statutory Limits
include coverage for Federal
Longshoremen's and Harbor Workers'
Compensation Act if the work is
on or near navigable waters
Employers' Liability
Comprehensive General Liability
Bodily injury (for contracts less
than $25,000)
(for contracts $25,000 and over)
Property damage (for contracts
less than $25,000)
(for contracts $25,000 and over)
include coverage for XCU if the work
involves ditching or excavating
For contracts $25,000 and over, include Contractual Liability
specifically covering this contract and Products Completed Opera-
tions Liability.

Automobile Liability (Owned, non-owned or hired units)- Same
Limits as Comprehensive General Liability.
All policies shall be endorsed to waive any right of subrogation
against Utility Company, its directors, officers, employees and agents
or against its affiliated companies, their directors, officers,
employees and agents.
City of Winter Springs, Conklin, Porter & Holmes, Engineers, Inc., and
persons or firms employed by either of the foregoing, prior to
commencing the Work, shall furnish to Utility Company certificate(s)
on forms furnished by Utility Company that insurance coverage as listed
above is in force. Utility Company shall receive 15 days prior written
notice of any cancellation of or change in coverage of the policies.
The certificate(s) shall be mailed or delivered to Utility Company.
Attention: Insurance Department, P.O. Box 44, Winter Park, Florida,
32790.

City of Winter Springs, Conklin, Porter & Holmes, Engineers, Inc., and
persons or firms employed by either of the foregoing shall defend
Utility Company against claims or suits for injury, sickness or death
of persons or damage or loss to property (including loss of use)
caused in whole or in part by acts or omissions of Utility Company or
City of Winter Springs, Conklin, Porter & Homes, Engineers, Inc., and
persons or firms employed by either of the foregoing, their employees,
agents, contractors or suppliers arising out of the performance of this
contract. City of ~!inter Springs, Conklin, Porter & Holmes, Engineers,
Inc., and persons or firms employed by either of the foregoing shall
indemnify and hold Utility Company harmless from and against damages,
losses, costs and expenses (including attorneys' fees) which Utility
Company may incur by reason of such claims or suits. This obligation
to defend, indemnify and hold harmless includes liability caused in
whole or in part by the negligence of Utility Company and liability
resulting from the injury, sickness or death of any employee of City of
Winter Springs, Conklin, Porter & Holmes, Engineers, Inc., and persons
or firms employed by either of the foregoing or subcontractor, regard-
less of whether such employee has been paid pursuant to any Workmen's
Compensation law or other similar federal or state legislation for
the protection of employees.
It is our understanding that sepias of the master water and sewer plans are
being sent directly to your office, by our engineers. The other documentation
which you requested on December 2, 1983, will be fon~arded to you under a
separate cover letter by me.
