received from DOT regarding our Wade Street Railroad Crossing Change.
They are recommending we deal directly with Seaboard as DOT feels it is
not necessary for the Department to be involved in the change. As a
result I am taking the following action:

Dear Mr. Rozansky:
I have received your letter of September 23, 1983, on the above
referenced Railroad Crossing. As discussed with you on the
telephone this date, you advised that this is a Public Railroad
Crossing which needs to be relocated 50+ in order to be in the
center of Public R/W. With this relocation being the only
Railroad involvement, we recommend that you contact the Seaboard
System Railroad Company Inc., and handle the Crossing relocation
directly with them, as it appears that the Department does not
need to be involved.

SUBJECT: Upgrading of Winter Springs Boulevard
The Staff met on Thursday, October 13, 1983, at 11:00 A}1 and again on Tuesday,
October 18, 1983, at 11:00 M1 to consider the need for upgrading Winter Springs
Boulevard, assuming there will be connection with SR 426 or the proposed 1134
Corridor eventually.
It is the consensus that such connection to an arterial road will change the
function of Hinter Springs Boulevard to a minor arterial comparable to Tuscawilla
Road.
First and foremost it is strongly recormnended by the Staff that the speed limit
be maintained at 30 HPH.
Second, it is recommended that paving not be permitted to extend to the Hinter
Springs-Oviedo boundary until after both collector roads planned to connect to
SR 419 on the north are completed and open to relieve some of the t::affic impact.
Third, it is recommended that the current paving and drainage improvements of
I'!inter Springs Boulevard be upgraded to meet the Code requirements for a divided
arterial road. This would require the following:
(1) Increase paving width 2 feet each direction to be two 20-foot sections
plus curbs. This width is satisfactory only at 30 ~~H speed. Greater
speeds would require wider paving for two lanes of vehicles moving in
one direction side by side.
(2) Utilize part of the medi~D to gain the added width racher than disturb
the right-of-way outside the present paving to avoid possible dis-
ruption and need for relocation of utility lines and streetlights.
(3) Place a condition on the approval of TuscaYrilla Unit 14 that the
construction needed to upgrade Winter Springs Boulevard be accomplished
simultaneously with either the connection of the roadway through to
the East (SR 426 or the 434 Corridor) or (2) the development of the
last single family unit in Tuscawilla east of Tuscmvilla ?oad, '\{hi.chever
comes first, so that construction takes place prior to build-out by
Winter Springs Development Corp.
(11) Monitor the traffic counts on Winter Springs Boulevard to determine vrhen
to install traffic lights. Explore the idea of an escrm.r account to
fund traffic lights by assessment to developers along the road,.,ay-both
single-famjly and multi-fwrrily.

Dear Dick:

I can unders tand your rel uctance to use Ci ty funds for street 1 i ghting
along Winter Springs Blvd. However, I feel it's unfair for the City
to expect Winter Springs Develop~~nt Corp. to pay for lighting a street
that the City has owned, accepted, and agreed to maintain since 1975.
There is a reasonable solution to this dilemma, that I thinK we both can
accept. As you know, the high cost of the lighting as quoted by Florida
Power is a result of almost no underground electric distribution systems
adjJcent to w~st of this section at Winter Springs Blvd. If there ~ere
adjacent projects with underground systems already installed. it would be
little or no problem to install street lights. As it is, the cost is
exarbi tant~

Th2refore, I suggest that the City require provisions for street lighting
along Hinter Springs Blvd. be included with final development plans on
all undevelope9 property contiguous to this section of Winter Springs
B1 vd. The City shaul d al so request the owners of developed property
along Winter Springs Blvd. to help pay for lighting in front of their
property. This is the most equitable way to resolve this question.
Dick, on new roads I feel it should also be the City's policy not to require
und~rground wiring for street lighting to be installed until the contiguous
property is developed. The additional cost to install lighting along res-
idential streets where no one lives or works is an unfair burden on a
developer and the City which has to pay the ~~nthly light bills.

Cj ty H:mager Richard Rozi:lnsky explained that a question posed to the Staff \vas \vhether
or not the Hinter Springs Elderly ComrrJunities \-la,-; considered a nursing home. The
attorney determined that the statute under which the Winter Springs Elderly Communities
bond issue was reqllested and approved recognizes it as a nursing home.
The applicant desires the option of placing the facility in C-l zoning - C-l zoning
a1](11;,,-; nursing ho;oes. The Staff was concerned that the COuLoission possibly did not
understand (based upon presentations/submittals) that the Winter Springs Elderly
Communities was considered a nursing home. The majority of the Commission asserted
that they understood the facility to be a nursing home.
Street Lights - Ihnter Springs Boulev:ud:
The Commission ,vas provided a letter from ~"'inter Springs Development Corporation dated
}~y 17 and also a letter from the City Engineer dated May 7 regarding our p6sition on
street lights. We are going to try and discuss this once more with Winter Springs
Development Corporation. Hanager Rozansky said He are sort of at an im;:>asse. The
City requires underground service for street lights in the P.D.D. Manager Rozansky
felt the City should not spend $15,000 for the lights; and we are researching
approvals on Winter Springs Boulevard. For a possible solutio~, the ~fanager
suggested that future approvals along Winter Springs Boulevard would be contingent
upon acceptable and adequate street lighting being provided by the developer.

asked that a yearly calendar be provided.

next to the treatment plant by Big Cypress Golf Course. The City Engineer Jack Cooper

A Workshop }feeting was called for 7:00 p. m. next Tuesday evening, June 1, 1982 to
review the Co~mittee Report on Sec. 8 and Sec. 44.
Public Right-of-Way/Gilbertson:
Commissioner Adkins said that Mr. Gilbertson, Panama Circle, has requested the City
abandon or allow the citizens out there to put up fences with a guaranteed access for
.the City crews to get into. Jacqueline Koch, City Planner explained the specific
area is adjacent to four lots on Panama Circle. The general area is Gee Creek area
separating the Ter-races from Foxmoor. The creek runs all through; each side of the
creek is a drainage right-of-way; it is land dedicated to the public. Hithin that
right of Hay there are retention ponds \vhich store \vater before it overflmvs back
into tile creek. The property adjacent to these lots is the drainage right of way
adjacent to probably the largest one of the retention ponds in the system.

position of Winter Springs D~ve'opment Corp. as it r2lates to street
lighting along t-linter Springs Blvd. b2tween Northarn ~:ay and Howell
Creek:
1. Citizens of Tuscawi11a not ~lil1ter Springs Development Corp. re-
quested of the CitY that street lights be placed along the
remainder of Winter Springs Blvd.
2. The City P.U.O. ordinance calls for wiring of this type to be
uncerground.
3. Winter Springs Development Corp. has agreed to defray any additional
cost to the City beb'ieen To'll"" & Co~try street lights and street
lights on concrete poles if and when the City places lighting along
Winter Springs Blvd.
4. Ed ~~ens of Florida Power Corp. has informed us there is no addit-
ional cost to the City for Town & Country lighting. He also in-
fOTrrp-d us that the additional $15,000 cost given the City by John
Branch of Florida Power was for underground service in place of th2
overhead service called for on the original work order. In addition
he stated there probablY would be no difference in cost between under-
ground service on the sid2S of the road vs. undergroLmd service dewn

THEREFORE OUR POSITION IS:
1. Winter Springs Development Corp. and many citizens of Tuscawilla
would like to see the continuance of Town & Country lighting down
the whole length of Winter Springs Blvd. if any lighting is put in.
2. When t~e City decides to light Winter Springs Blvd., no additional
cost should be charged to Winter Springs Developw~nt Corp. since
additional costs are for underground service not Town & Country
1 i ghting.
3. Pole and fixture lighting fees are charged with the filing of
new plats and therefor~ not an issue here.

Yesterday a conference was held with city personnel
and the representatives of \'finter Springs Development Corp.
regarding the subj ect proj ect from Northern ~':ay to the
Tennis Villas. At the conference the subject matter was
defined as follows:
1. Lighting with concrete poles in the median ani overhead
vIires.
2. Lighting with carriage lamps on both sides of the street
with underground wires.
3. Pole fees.

It ~;as further established that the nw~bsr of fixtures
vlOuld be almost similar ';'ihether faedian lighting "I.'laS used or
uhether side rig;ht-of-Hay lighting VIas used. BOHaver, undcr-
grollild lighting by either means would require pay~ent to the
pov;er compO-ny of an addifunal 815,000.. 'rhe ultimate result
of the conference was as follows:
1. The developer, and in his opinion, the citizens \'lould
not want overhead wires.
2. The developer would not pay the extra cost to install
underground wires.
3.
The develoDer ,,';ould not pay the pole fees (approximately
$6 , 500 ) " ...
4. The developer ",':ould install the street lighting at the
time the area is developed, and ""lOuld pay the pole fees
at that time.

PROPOSED SETTLEMENT BETWEEN THE CITY OF
WINTER SPRINGS AND FLORIDA LAND COMPANY
1. The subject tract is approximately 400 acres in size.
The following is the plan for d8velopment of the tract:
A. Development of approximately 260 acres for single
family residences of 1.54 per acre.
B. Approximately 100 acres reserved for conservation
purposes.
C. Approximately 40 acres devoted to affluent discharge
purpose.
2. Florida Land will extend the right-of-way on Shore Road.
3. Florida Land will use sewer and/or septics when permissable
4. Florida Land will pave and develop all roads with gutters,
curbs, sidewalks, underground street lighting wiring and conform with
the City Code where applicable in developing streets; unless speci-
fically waived by the City Commissioners.
5. Florida Land will agree to reimburse the City its
attorney's fees in the amount of $20,193.38.
6. Florida Land and the City agree to dismiss and waive
with prejudice any and all claims arising out of any and all pending
lawsuits by and between Florida Land and the City of Winter Springs.
7. That as a condition precedent to this agreement being
binding upon both parties, appropriate zoning to enact said agreement
must be enacted and/or continued, if possible. The City Attorney
shall determine the method to accomplish same.

SUBJECT: Recording Plats of Tuscawilla Units 12 and 13
Winter Springs Development Corp. requests approval to record the plats of Units
12 and 13 in Tuscawilla. As of this afternoon, all doc~~entation was re-
submitted with corrections requested by the City. Subject to further checking
on a few technical and legal details, the plats are in c02pliance with the Code.
As discussed during engineering review, with these deve::Copment tvo more inter-
sections of Hinter Springs Blvd. and Northern 1,.!ay will be created, making a total
of three identically named intersections. The Police an::: Fire Chiefs advise tlwt
they see no alternatives to this situation, such as vaY':.-:ng the street na..>r,es,
that would help alleviate the problem. Therefore, they recommend the plats be
approved with the streets as named, but that the developer be required to identifJ
fully each of the three intersections by addint; block m:.c"'lbers to the street naT".e
signs.
Approval to record the plats of Units 12 and 13 in Tusca;.;illa is recommende:::
subject to:
(1) provision of additional signago to the Chiefs' satisfaction at all
three intersections of Hinter Springs Blvd. and Northern 1,-lay;
(2) review and approval by the City Engineer of an off-site drainage
easement on pages 1 and 2 of the plat of Unit 12 and correction
of the certification letter for Unit 12 to include this easement;
(3) approval by the City Attorney of the form of the performance bond
and deed restrictions for both units;
(4) correction of the dedication on the plat of Hinter Springs Blvd.

I have reviewed the subject units and find no reason for them not to
