RE Highlands village ~ - Final Plat Request

The staff and I have reviewed the request for final
platting of Highlands Village I. During this review, the
staff and I discussed with the developers the various issues
as they arose.
At this time, the following three items remain
unresolved:
1. The developer must submit to the City a letter
from DER resolving the April 13, 1983 cease and desist
reguest issued by DER. A copy of this request is attached
hereto.
2. The City Attorney's office must issue final legal
approval of the Declaration of Easements, Covenants, Conditions
and Resolutions.
3. The developer must furnish the City a bond or
letter of credit that meets the approval of the City Engineer
and City Attorney. The bond and assignment previously sub-
mitted were unsatisfactory.

The present status of the matter presents you with
two options:
A. Approve the final platting but direct that
signing of the final plat by the Mayor and recording of
the plat be withheld until resolution of items 1, 2 and 3
above.
B. Withhold approval of the final platting until
resolution of items 1, 2 and 3 above. Then, place this
matter on a new public meeting agenda.

On April 7, 1983 the above site was investigated by our field
representative in-response to a public complaint.

Observations were made that approy.L~ately 150 cubic yards had
been dredged, draining a wetland area, with the dominant
vegetation listed in Rule 17-4.02(17) of the Florida Administrative
Code, which is now considered the landward extent of the waters
of the state.
Observations were also made that a section of the above wetlands,
approximately 15,000 square feet, was being cleared with resulting
fill and the placement of yard trash within the landward extent
of the waters of the StateG
The above activities were conducted without a valid and current
permit issued by the Department and are directly in violation of

trative Code.. Therefore, you are requested to cease and desist .
these activities and arrange a meeting in this office, within
fifteen (15) days from the receipt of this letter, to discuss
corrective means to resolve the existing violations
