REGULAR MEETING
CITY COMMISSION
CITY OF WINTER SPRINGS
MAY 25, 1982
The Regular Meeting of the City Commission of the City of Winter Springs, Florida,
was called to order by Mayor Troy Piland. The invocation was given by Commissioner
Jim Hartman. The pledge of allegiance to the flag was led by City Manager Richard
Rozansky.

Motion was made by Commissioner Hartman to approve the minutes of May 11, 1982.
Seconded by Commissioner Trencher. Discussion. Vote on the motion: Commissioner
Boyd, aye; Commissioner Torcaso, aye; Commissioner Hartman, aye; Commissioner Adkins,
aye; Commissioner Trencher, aye; motion carried.
Public Input:
Mrs. Marge Malich, Camphorwood and Mrs. Debbie Kearns, Camphorwood St., spoke about
their neighbor and the problems he is creating. They asked for some help in this
situation.

Bill Jacobs, S. Edgemon Ave., asked about the status of the purchase of the North
Orlando Water & Sewer Corp.
Dave Dearolph, Deer Run, asked about the status of the Southern States Utility Co.
Mayor Piland said for the Commission's information, Attorney Morrison was present this
evening because Attorney Cook is on vacation and will be back at the next meeting.
General Agenda:
Tuscawilla Units 12 and 13 - Sec. 14-60 Approval:
Jacqueline Koch, the City Planner, explained that the land development ordinance has
a new provision that requires when any development involves flood prone areas or seasonal
year round high water tables that a special step be added whereby soils reports are
furnished to the City, reviewed by the Engineer and recommendation be made to the
Commission whether or not the land is suitable for development as proposed. Mr. Cooper
has reviewed the soils studies for this area, including the extension of Northern Way,
and he finds that the soils studies do prove that the land can be developed in the
128 single family lots shown on this plan. The Code requires that there be a finding
made by motion by this Commission before we can proceed with this preliminary plan.
Staff recommends that you make a positive finding.
Motion was made by Commissioner Hartman that we accept the City Engineer's findings
that the soil is suitable for development for the preliminary plan as submitted for
Tuscawilla Units 12 and 13. Seconded by Commissioner Torcaso. Discussion. In discussion
Bill Jacobs, S. Edgemon Ave., and Inez Linville, Tuscawilla, spoke. Vote on the motion:

City Manager - Richard Rozansky:
Winter Springs Elderly Communities:
City Manager Richard Rozansky explained that a question posed to the Staff was whether
or not the Winter Springs Elderly Communities was considered a nursing home. The
attorney determined that the statute under which the Winter Springs Elderly Communities
bond issue was requested and approved recognizes it as a nursing home.
The applicant desires the option of placing the facility in C-1 zoning - C-1 zoning
allows nursing homes. The Staff was concerned that the Commission possibly did not
understand (based upon presentations/submittals) that the Winter Springs Elderly
Communities was considered a nursing home. The majority of the Commission asserted
that they understood the facility to be a nursing home.
Street Lights - Winter Springs Boulevard:
The Commission was provided a letter from Winter Springs Development Corporation dated
May 17 and also a letter from the City Engineer dated May 7 regarding our position on
street lights. We are going to try and discuss this once more with Winter Springs
Development Corporation. Manager Rozansky said we are sort of at an impasse. The
City requires underground service for street lights in the P.U.D. Manager Rozansky
felt the City should not spend $15,000 for the lights; and we are researching
approvals on Winter Springs Boulevard. For a possible solution, the Manager
suggested that future approvals along Winter Springs Boulevard would be contingent
upon acceptable and adequate street lighting being provided by the developer.
Manager Rozansky provided the Commission with a monthly calendar. Commissioner Hartman
asked that a yearly calendar be provided.

Mayor Piland said there have been some complaints of odors from the Ta1mo Avenue area
next to the treatment plant by Big Cypress Golf Course. The City Engineer Jack Cooper
explained there were excessive odors while they were re-doing their sludge beds, but
that is over now.
Commission Seat I - Jim Hartman:

Commission Seat II - Buck Adkins:
A Workshop Meeting was called for 7:00 p. m. next Tuesday evening, June 1, 1982 to
review the Committee Report on Sec. 8 and Sec. 44.
Public Right-of-Way/Gi1bertson:
Commissioner Adkins said that Mr. Gilbertson, Panama Circle, has requested the City
abandon or allow the citizens out there to put up fences with a guaranteed access for
the City crews to get into. Jacqueline Koch, City Planner explained the specific
area is adjacent to four lots on Panama Circle. The general area is Gee Creek area
separating the Terraces from Foxmoor. The creek runs all through; each side of the
creek is a drainage right-of-way; it is land dedicated to the public. Within that
right of way there are retention ponds which store water before it overflows back
into the creek. The property adjacent to these lots is the drainage right of way
adjacent to probably the largest one of the retention ponds in the system.
Mr. Gilbertson was present. He said he and his neighbors had no desire to own the
property, they just want to keep the public out of their backyards. Linda Sutton
and David Oakley spoke in discussion.

Motion was made by Commissioner Hartman that we allow the Homeowners on Lots 21, 22,
23, 24 and 25 to put two fences - one between Lots 26 and 25, and one between Lots 21
and 20 down to the water's edge, each with a double gate with padlocks and keys
provided to the City. Seconded by Commissioner Adkins for discussion.
Motion was amended by Commissioner Adkins, seconded by Commissioner Trencher that the
citizens of those five lots pay for that but let the City put their own locks on.
The City would be the only one that would have keys to those two gates and the
citizens would then donate that portion of those two fences to the City of Winter
Springs that fall on public property.
Motion was made by Commissioner Adkins, seconded by Commissioner Trencher to table
until the next meeting until they come in with some type of proposal. Vote on the
motion: Commissioner Hartman, aye; Commissioner Adkins, aye; Commissioner Trencher,
aye; Commissioner Boyd, aye; Commissioner Torcaso, aye; motion carried.

Commission Seat IV - Maureen Boyd:
Commissioner Boyd made comment in reference to amended agendas.
Commission Seat V - John Torcaso:
No report.
Mayor's Office:
rfuyor Piland asked City Manager Rozansky for a mosquito spraying schedule.
