SWEARING IN CEREMONY
DECEMBER 3, 1979

Mayor Troy Piland, Councilman Wilfred Arnold and Councilman Maureen Boyd were sworn
in by City Attorney Wallace Stalnaker.
The Special Session of the City Council of the City of Winter Springs, Florida, was
called to order by Mayor Troy Piland at 5:30 p.m.

Maureen Boyd, present
John Torcaso, present
City Attorney Stalnaker explained that the City has adopted the Southern Standard
Building Code. In that Code it allows for an appeal from a decision made by the
building inspector. By amending Sec. 111.1 and Sec. 111.2 of the Southern Standard
Building Code with Ordinance No. 207, this causes the five members of Council to be
the Board of Adjustment and Appeals. Attorney Stalnaker read Ordinance No. 207
(emergency ordinance) in its entirety.
Motion was made by Councilman Torcaso to adopt Ordinance No. 207. Seconded by
Councilman Arnold for discussion. In discussion Councilman Arnold suggested the
fee be raised considerably in order for Council to get advise from technical
people (architects, engineers, electricians,etc.) to handle these appeals. Vote
on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett,
no; Councilman Boyd, aye; Councilman Torcaso, aye; motion carried.

The appeal of Mr. Ray Savarese of J.S.I. Builders, was discussed. Mr. Savarese
explained that items could not be taken out of context in the Southern Standard
Building Code. Mr. Savarese said that he has built a balcony with a 36 inch rail.
The Building Inspector maintains the rail should be 42 inches. Mr. Savarese contends
it is not an exit nor means of egress therefore he does not have to comply with the
42 inch provision.
Motion was made by Councilman Jacobs that we table this appeal from Mr. Savarese
until we get an opinion from our Attorney and the Southern Standard Building Code
Congress. Seconded by Councilman Torcaso. Discussion. Vote on the motion:
Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, no; Councilman
Boyd, aye; Councilman Torcaso, aye; motion carried.
Meeting was adjourned 6:37 p. m.
