REGULAR SESSION

CITY OF WINTER SPRINGS
DECEMBER 19, 1978
The Regular Session of the City Council of the City of Winter Springs, Florida was
called to order by Mayor Troy Piland. The invocation was given by Councilman John
Bennett. The pledge of allegiance to the flag was led by Councilman Laurent
Pellerin.

There was no public input.
Motion was made by Councilman Torcaso to approve the minutes of December 12, 1978
with two corrections: under Council Seat IV change monthly "Fire Department" to
"Building and Public Works': and to add: "Council Seat V -John Torcaso. The monthly
Fire Department report was distributed." Seconded by Councilman Jacobs. Discussion.
Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, absent; Councilman
Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried.
Second Reading of Ordinance No. 164 & 165:
Motion was made by Councilman Pellerin to read Ordinances Nos. 164 and 165 on second
reading by title only. Seconded by Councilman Bennett. Discussion. Vote on the
motion: Councilman Jacobs, aye; Councilman Arnold, absent; Councilman Bennett, aye;
Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried.
Attorney Stalnaker read Ordinances Nos. 164 and 165 by title only.
Motion was made by Councilman Torcaso that we adopt Ordinance No. 165 on second
reading. Seconded by Councilman Jacobs. Discussion. Vote on the motion: Councilman
Jacobs, aye; Councilman Arnold, absent; Councilman Bennett, aye; Councilman Pellerin,
aye; Councilman Torcaso, aye; motion carried.
Motion was made by Councilman Torcaso that we adopt Ordinance No. 164 on second
reading. Seconded by Councilman Jacobs. Discussion. Vote on the motion: Councilman
Jacobs, aye; Councilman Arnold, absent; Councilman Bennett, aye; Councilman Pellerin,
no; Councilman Torcaso, aye; motion carried.
Councilman Arnold arrived at the meeting at 8:00 p.m.
There was discussion of assessments. Mr. Robert Wagner from Southeast Municipal
Bonds and the City Engineer were present. Attorney Stalnaker reported that there
are no restrictions upon the City regarding assessments, and that there are two
types of bonds. They are covered by Chapter 166 and 170 of the Florida Statutes.
Attorney Stalnaker said again the Council is not prohibited from 100% assessing
one time simply because they did not assess 100% on a previous bonding issue.
Mr. Robert Wagner briefed Council on the alternatives of a bonding program and
answered questions.

Motion was made by Councilman Pellerin that we engage Mr. Wagner of Southeast
Municipal Bonds to prepare and present a finance plan for a bonding program at the
next meeting. Seconded by Councilman Torcaso. Discussion. Vote on the motion:
Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman
Pellerin, aye; Councilman Torcaso, aye; motion carried.
Attorney Stalnaker was asked to research Sec. 14-89 Paving Costs.
City Engineer, Cal Conklin, discussed the methodology and city participation.
Motion was made by Councilman Pellerin to accept the engineering contract with
Clark, Dietz & Associates with the two modifications- 1. method of payment, and 2.
ownership of engineering drawings. Seconded by Councilman Torcaso. Discussion.
Vote on themotion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman
Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried.
Council is to decide the percentage of City participation at the next Council meeting.
Mr. Conklin is to proceed with the over-all study of improvements for the entire City.
Council Seat I - William Jacobs:
Motion was made by Councilman Jacobs to put on the agenda the paving of north and
south Edgemon Avenue. Seconded by Councilman Arnold. Discussion. Vote on the motion:
Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman
Pellerin, aye; Councilman Torcaso, aye; motion carried.
Motion was made by Councilman Jacobs that we get the engineering for north and south
Edgemon Avenue. Seconded by Councilman Torcaso. Discussion. Vote on the motion:
Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye; Councilman
Pellerin, aye; Councilman Torcaso, aye; motion carried.
Council Seat II - Wilfred Arnold:
Councilman Arnold reported he will be putting certain amounts of savings in
certificates of deposit in order to gain a higher rate of interest (9.75%).
Council Seat III - John Bennett:
Councilman Bennett discussed Sec. 8 of the Code. A new ordinance is to be drawn up
making necessary changes in Sec. 8 and Sec. 44, under Commercial zoning.
Council Seat IV - Laurent Pellerin:
Mayor Piland said he instructed the Building Department to come up with an applica-
tion form for occupational licenses.
Motion was made by Councilman Pellerin that the resolution to set the lake level in
Tuscawilla be placed on the agenda. Seconded by Councilman Arnold. Discussion.
Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman
Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried.
Motion was made by Councilman Pellerin that Resolution No. 241 setting the lake
level to the 48 feet MSL be approved as written. Seconded by Councilman Bennett.
Discussion. Vote on the motion: Councilman Jacobs, aye; Councilman Arnold, aye;
Councilman Bennett, aye; Councilman Pellerin, aye; Councilman Torcaso, aye; motion
carried.

There was discussion of the improvements in Units II and IV in Tuscawilla and
Council is to decide how many underdrains are to be installed in Unit IV.
Council Seat V - John Torcaso:
Councilman Torcaso discussed the changes to Sec. 6-33 and 6-35 of the Code. A new
ordinance is to be drawn up with these changes.
The Transmission Authority budget was discussed.
Motion was made by Councilman Pellerin that we authorize the payment of $12,859.00 to
be paid on a quarterly basis. Seconded by Councilman Arnold. Discussion. Vote on the
motion: Councilman Jacobs, aye; Councilman Arnold, aye; Councilman Bennett, aye;
Councilman Pellerin, aye; Councilman Torcaso, aye; motion carried.
