REGULAR SESSION
CITY COUNCIL
CITY OF WINTER SPRINGS
JULY 11, 1977
The Regular Session of the City Council of the City of Winter Springs, Florida was
called to order by Mayor Troy Piland. The invocation was given by Councilman Ernest
Hendrix. The pledge of allegiance to the flag was led by Attorney Massey.

Motion was made by Councilman John Daniels to approve the minutes of June 20 and
June 27, 1977. Seconded by Councilman Hendrix. In discussion Councilman Daniels
asked that on Page 3 of the June 20, 1977 minutes, 3rd paragraph dealing with
Section 6-32, change the word after "discussion of the ordinance" to changing
instead of repealing. Vote on the motion: Councilman Sines, aye; Councilman Hendrix,
aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, absent;
motion carried.
Mr. Cal Conklin, City Engineer, gave Council an update of the 201 Regional Sewer
Project. He said a new inter-local agreement will be forthcoming.
Planning & Zoning Report, Councilman Sines:
Councilman Sines said August 22nd will be the 60th day since the plan was presented
to Council and mailed to all required agencies.
Fire Department Report, Councilman Hendrix:
The monthly report has been distributed and a copy is on file.
Finance Department Report, Councilman Daniels:
The monthly finance report was not ready. Councilman Daniels discussed the change
in rates for the employee health insurance. Beginning in September for the next
12 months, the employee package which we are paying $20.03 now, effective Sept. 1
will be $22.73 and for the dependants coverage we now pay $40.62 will be $47.35 and
if the family does not want the pregnancy part of it they can deduct $4.25 from that
$47.35. Councilman Daniels said he would 60 some shopping around and come back with
a report next meeting.
The comments from the three department heads in reference to the Colonial Life
Insurance were that after reviewing the benefits of the plan they didn't feel that
it met the total needs of the various departments. They would not ask that the City
participate in any type of payroll deductions at this time but they had no objections
to Colonial Life representatives speaking to employees on their own time. Then
Colonial Life Representatives would have to get Council's authorization for payroll
deductions. Councilman Daniels said it should be pointed out to employees that this
is only an accident policy and that it does not pay for sickness.
Police Department Report, Councilman Ash:

Public Works Department Report, Councilman Sabatini:
Councilman Sabatini reported for the month of June a great deal of time was spent
mowing and 135 hours on miscellanous; police car maintenance 102 hours; Public Works
and equipment maintenance 11 hours; project Stoner Road was re-opened in June - usual
grading of roads, Recreation Building was repainted; parks 93 hours; street work and
signs 130 hours; drainage 39 hours; total of 510 hours; great deal of time spent in
Sunshine Park Cleanup and they are now working on South Edgemon park. Total revenue
received for the Building Department for the month was $4896.00.
There was discussion of the 7-11 Store in Tuscawilla.
Motion was made by Councilman Daniels that the Inspection Department be instructed
to not issue a certificate of occupancy or a final inspection on the 7-11 store in
the Tuscawilla Planned Unit Development until such time as the Building as seen from
Winter Springs Boulevard meets an outside architectural building configuration in
keeping with the visual architectural perspectives present in the Planned Unit
Development, i.e. the Information Center; further, that the builder be required to
provide prior to the issue of the cited documents necessary architecturally pleasing
fencing to block the view of trash containers and other service items normally found
at the rear of convenience stores.
Motion was made by Councilman Daniels that the Building Department fee schedule be
amended to include a $5.00 annual fee for the registration and filing of licensing
documents provided by contractors licensed by the State of Florida and other recognized
entities. Seconded by Councilman Sabatini. Discussion. Vote on the motion: Councilman
Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye;
Councilman Sabatini, aye; motion carried.

The 1977-78 Budget was discussed. Mayor Piland proposed a 1% reduction in Utility
taxes and reduce the property tax from 2.43 to 2.40 mills. His proposed budget
totalled $812,589. Councilman Daniels proposed a reduction of property tax from
2.43 to 1.85 mills and a 1% reduction in Utility taxes. His proposed budget
totalled $795,617.00. There will be a Workshop on the budget Monday Night, 7:30 p.m.
at the Community Building.
There was discussion on the proposed ordinance adopting a policy for pits, quarries,
etc. Mayor Piland gave a report of the various pit and retention ponds. Councilman
Hendrix said he was not ready to vote on an ordinance that would require that expendi-
ture for fencing. He said developers should be required to grade the pits so they
would not be such a hazard. He said fencing is too costly and that more parental
concern is necessary. He said the City should not become fully responsible for all
the children in the City.
Councilman Daniels said he does not advocate public fencing of existing borrow pits
or lakes. He does not advocate the expenditure of one dollar of tax monies to fence
any existing body of water. Councilman Daniels said he does advocate the need for a
policy to control future pit dredging operations and that the pits should be sloped
so that the hazard is not there. He said he does not feel that we should require
fencing because fencing does not provide adequate safety features. Councilman
Daniels said he would advocate that we post signs that warn the public of the dangers
in those areas and also look into the ownerships of the lakes and perhaps abandon

~ those lakes that are surrounded by private land.
Councilman Sines asked that the Attorney and City Planner identify each location of
the pits and the situation surrounding it. Then Council can decide to either fence
or abandon the property. Councilman Sabatini spoke against fencing the pits and
against the ordinance.
Motion was made by Councilman Hendrix that this proposed ordinance on borrow pits
be set aside and any further action regarding borrow pits, quarries or excavations
be proposed by a new ordinance. Seconded by Councilman Daniels. Discussion. Vote
on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels,
aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried.
There was discussion of the ordinance to increase members of the Planning & Zoning
Board and terminate the Planning Commission.
Motion was made by Councilman Daniels that we advertise this particular ordinance and
we hold a public hearing as soon as possible. Seconded by Councilman Ash. Discussion.
Vote on the motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels,
aye; Councilman Ash, aye; Councilman Sabatini, aye; motion carried.
Mayor Piland recessed the Regular Session and opened the public hearing for Ordinance
No. 153, establishing a personnel policy. Attorney Massey read the first reading
of Ordinance No. 153. The following change was made in Section 3, paragraph B,
after "the Committee may direct its secretary" change to read "the Committee may
request the City Council to take corrective action as to any member of any Department."
Mayor Piland closed the public hearing and reconvened the Regular Session.

Motion was made by Councilman Hendrix to adopt Ordinance No. 153 as amended on the
first reading. Seconded by Councilman Sabatini. Discussion. Vote on the motion:

Ash, aye; Councilman Sabatini, aye; motion carried.
Attorney Massey read the second reading of Ordinance No. 152 by title only, changing
the zoning from RU to RC1.
Motion was made by Councilman Daniels to approve Ordinance No. 152 on the second
reading by title only.Seconded by Councilman Hendrix. Discussion. Vote on the
motion: Councilman Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye;
Councilman Ash, aye; Councilman Sabatini, aye; motion carried.
There was discussion of codification of City ordinances. After we get the latest
inserts, this will be done in-house. Mayor Piland is to come back with a recommenda-
tion as to which Commissioner's responsibility this would come under.
Councilman Hendrix asked the status of the EDA project. Mayor Piland reported that
EDA still has to accept the work and an audit has to be made.
Motion was made by Councilman Sabatini to put the subject of double taxation on the
agenda. Seconded by Councilman Sines. Discussion. Vote on the motion: Councilman
Sines, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Ash, aye;
Councilman Sabatini, aye; motion carried.

There was discussion of entering the double taxation lawsuit with Sanford. Councilman
Daniels said we would be doing the citizens an injustice to commit to spend any
funds to join the suit when the results of the Sanford suit will be applied to us
when they come back.
Motion was made by Councilman Hendrix to table until the next meeting. Seconded by
Councilman Sines. Vote on the motion: Councilman Sines, aye; Councilman Hendrix,
aye; Councilman Daniels, aye; Councilman Ash, aye; Councilman Sabatini, aye;
motion carried.
