Authorization REQUEST: Information Services requests direction from the Commission regarding a request from Florida By Day & Night to use the City seal on their website. PURPOSE: To inform the Commission of a request to use the City seal by Florida By Day & Night for use on their website and to obtain Commission direction on this issue. CONSIDERATIONS: Mr. Ronald V. Barker of Florida By Day & Night is requesting authorization to use the City seal on his business website. The seal will be used with the Florida By Day & Night logo to promote various City events. Florida By Day & Night is a new entertainment website for the Central Florida area that showcases different events, parks, restaurants, attractions and other various items. These items are divided up by county and municipalities. The Information Services Department has discussed the request with the Office of the City attorney. We have been informed by the attorney of a State statute that prohibits the use of a governing body's seal without the express written consent as a second degree misdemeanor. Florida State Statute 165.043 states: --The governing body of a county or municipality may, by ordinance, designate an official county or municipal seal. It is not clear exactly how the City seal will be displayed on their website nor has a visual aid been provided. The current business website is still under construction and has not been fully launched at this time. While we do see the benefit of such a site as a tool to promote City events, there are concerns with regard to the timeliness and accuracy of information on the site, as well as the potential for people to assume that the site is owned, operated, or endorsed by the City.
