Motion was made by Councilman Browning to approve the minutes of November 3, 1975.
Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter,
aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes;
Councilman Browning, aye; motion carried.
Discussion of Refuse Contract:
Mayor Piland read the letter from John T. Pattillo, Attorney for H & W Refuse
Service. This was a request to enter into a new three year contract, and at the
same price. Attorney Massey said the bond was too low and as far as letting the
contract, it is up to the Council.

Motion was made by Councilman Hendrix to negotiate the Refuse Contract for renewal
with Mr. Zaccare110 of H & W Refuse Service. Seconded by Councilman Hunter. Discussion.
Vote on the motion: Councilman Hunter, aye; Councilman HendriX, aye; Councilman Daniels,
aye; Councilman Van Eepoe1, yes; Councilman Browning, aye; motion carried.
A committee consisting of Councilman Daniels, Councilman Van Eepoel, and Councilman
Browning was appointed to negotiate the refuse contract.
Mr. Fred Roberts, Public Works Director, presented a report to continue the mosquito
control program.
Motion was made by Councilman Hendrix to extend our fogging operation based on
Mr. Robert's report for three weeks. Seconded by Councilman Van EEpoel. Discussion.
Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman
Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried.
Mayor Piland read the letter from Mrs. Mary Daniels and Mr. Paul Smith in reference
to street lights. Mayor Piland said he would have the Attorney review the letter from
Mr. Smith.
Motion was made by Councilman Daniels to table this issue until next week when Mr.
Smith and Mr. Charlie True can be here. Seconded by Councilman Browning. Discussion.
Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels,
aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried.
Mr. Jack Schraaf of the V.F.W. said they would offer transportation for people who
want to vote. He said the V.F.W. would like to thank the two girls that came before
Council with the smoking problem. Thirdly he said they are going to participate in
the Christmas parade. The parade will be December 14, 3:00 p. m.

The Cumberland Farms drainage problem was discussed and it was suggested that the
City engineer be called to look at the problem. Councilman Daniels said the other
problem of water running off the parking lot is on private property and should not be
a matter of city concern.
Mayor Piland said he has been in contact with Mr. Lavender in reference to the road
program and Mr. Lavender is to forward a letter of what they will and will not do and
also include prices. Mr. Lavender will also look at the problem of Gee Creek near the
bridge.
Mayor Piland recommended that a resolution be drawn up for Kathy Holzman and Pam Roy.
Motion was made by Councilman Hunter that this item be placed on the agenda. Seconded

Motion was made by Councilman Van Eepoel that we instruct the Attorney to draft a
~esolution commending the two girls for their Courage. Seconded by Councilman Hunter.
Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye;
Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye;
motion carried.
Motion was made by Councilman Daniels that we bring the matter of the City Attorney's
resignation on the agenda, for consideration. Seconded by Councilman Browning.
Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye;
Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye;

Motion was made by Councilman Browning, to accept the resignation of Attorney Brockwith
extreme regrets. Seconded by Councilman Hendrix. Discussion. Vote on the motion:
Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman
Van Eepoe1, yes; Councilman Browning, aye; motion carried.
Motion was made by Councilman Daniels that we bestow on the Assistant City
Attorney, Gary Massey, the full authority and title as City Attorney during the
interim period of time that he is serving as the assistant. Seconded by
Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, aye;
Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes;
Councilman Browning, aye; mo1:4on carried.
There was a discussion of the issuance of a subpoena to Mrs. Sharon Patrick who
did not attend the meeting.
There will be a meeting of the Civil Service Committee at the office of Gary Massey
next Tuesday evening.
