REGULAR SESSION
CITY COUNCIL
CITY OF WINTER SPRINGS
SEPTEMBER 8, 1975
The Regular Session of the City Council of the City of Winter Springs, Florida was
called to order by Mayor Troy Piland. The invocation was gi.en by Councilman Irene
Van Eepoel. The Pledge of Allegiance to the flag was led by Councilman Ernest
Hendrix.

Motion was made by Councilman Daniels to approve the minutes of September 2, 1975.
Seconded by Councilman Hendrix. Dis;cussion. Vote on the motion: Councilman Hunter,
aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes;
motion carried.
Mayor Piland recessed the Regular Session and opened the public hearing for the
budget. Attorney Brock read the notice of public hearing that was published in
the Sanford Herald. After a short discussion, the Mayor closed the public hearing
.and reconvened the Regular Session.
Motion was made by Councilman Hendrix that the fiscal budget as presented be accepted
by Council and also that the procedure for adopting the budget be by ordinance and
have that ordinance prepared as soon as possible. SEconded by Councilman Daniels.
Discussion. Vote on the motion: Councilman Hunter, aye; Councilman HendriX, aye;
Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye;
motion carried.
Motion was made by Councilman Daniels that while we are making the amendment to
the code to provide for adoption of budget by ordinance that we liberalize the
procedure for transferring budgeted monies that already are in the budget from
department to -department and to provide for the necessary referendum .ote to be
developed and placed on the ballot at the forthcoming election to provide for
the transfer of funds between departments so long as the total annual city budget
is not exceeded without recourse to public hearing and ordinance adoption.

Motion was made by Councilman Daniels to table this for two weeks to give the
Attorney a chance to look into the legal ramifications. Seconded by Councilman
Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, no; Councilman
Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman
Browning, no; motion carried.
Mayor Piland recessed the Regular Session and opened the public hearing to
reconsider the conditional land use permit to allow the building of a Kingdom
Hall for the Jehovah Witnesses on Lot 1, Blk. A, North Orlando Ranches, Section 4.
Attorney Brock read the notice of public hearing that was published in the newspaper.
Mr. G. Hunt, Mr. S. Musgrove, Mrs. S. Patrick, Mrs. L. Helzer, Mr. L. Pellerin,
Mr. W. Parkhurst, Mrs. Williamson, Mr. R. DeFazio, Mrs. M. Rossiter, Hr. Don Sines,
Mr. B. Williams and Mrs. Caviness spoke against the permit. No one spoke for the
permit.

Mayor Piland closed the public hearing and reconvened the Regular Session.
Motion was made by Councilman Daniels that the conditional use permit for Jehovah
Witnesses be rescinded and such conditional use not be granted. Seconded by
Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, on basis
of public reaction, aye; Councilman" Hendrix, aye; Councilman Daniels, aye;
Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried.
In discussion of Mr. Bradshaw's questions of signs in reference to Section lO,
Ordinance No. ll9, Council felt the ordinance should be followed as it stands.
Mayor Piland asked Attorney Brock if he could call for an investigation of the
Building .epartment and was told he could not. Mayor Piland suggested that
Council call for an investigation, pursuant to Section 4.11 of the City Charter.
Motion was made by Councilman Hendrix that we have an investigation of the Building
Department regarding the possible irregularities and procedure in the issuance of
the building permit of the Seminole Baptist Temple. The investigating committee
to be composed of everyone on the Council headed by the Mayor and the committee
report back within three weeks from this tUDe with an affidavit by the investiga-
ting committee as to the acceptance of the correctness or incorrectness of the
procedure followed in the issuance of that permit. Seconded by Councilman Hunter.
Discussion.
Councilman Van Eepoel amended the motion on the floor to set a tUne period to a
month during which tUDe Council, acting as an investigating body, will receive
affidavits from concerned people (concerned me~aning pertinent) and upon receipt
of these statements Council will investigate any and all allegations. Seconded
by Councilman Hunter. Discussion. Vote on the amendment to the motion:
Councilman Hunter, aye; Councilman Hendrix, no; Councilman Daniels, aye;
Councilman Van Eepoel, yes; Councilman Browning, no; motion carried.
Vote on the motion as amended: Councilman Hunter, on the basis that we will
never get this settled unless this is done, aye; Councilman Hendrix, aye;
Councilman Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, no;
motion carried.
Motion was made by Councilman Hunter that we authorize the Mayor1s office to
proceed in getting these ditches cleaned. Seconded by Councilman Hendrix.
Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye;
Councilman Daniels, aye; Councilman Van Eepoe1, yes; Councilman Browning, aye;
motion carried.
Councilman Daniels distributed copies of the job description for the City Planner.
Motion was made by Councilman Hendrix to adjourn. Seconded by Councilman Van
Eepoel. Mot;~.cl1rried.
