CITY OF WINTER SPRINGS
AUGUST 18, 1975
The Regular Session of the City Council of the City of Winter Springs, Florida was
called to order by Deputy Mayor Donald Browning. The invocation was given by
Councilman Irwin Hunter. The pledge of allegiance to the flag was led by Councilman
Ernest Hendrix.

Motion was made by Councilman Van Eepoel to approve the minutes of August 11, 1975.
Seconded by Councilman Daniels. Discussion. Vote on the motion: Councilman Hunter,
aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes;
motion carried.
Mr. Cliff Guillet and Mr. Carl Gosline from the East Central Florida Regional
Planning Council were present per Council's request for information for the best
use of the property "Crooked Creek." Councilman Daniels explained that we have a
Planning Commission which has the responsibility for our Comprehensive Land Use
Plan. We will be hiring a Planner within the next sixty days, and we need informa-
tion from the Council that this Group can use in arriving at the alternatives for
that particular piece of property. A Workshop Session is to be set up as soon as
possible.
Attorney Massey read the second reading of Ordinance No. 124 by title only.
Motion was made by Councilman Van Eepoel to adopt Ordinance No. 124 on the second
reading by title only. Seconded by Councilman Daniels. Discussion. Vote on the
motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye;
Councilman Van Eepoel, yes; motion carried.
The offer by the County for a total road maintenance program was discussed.
Motion was made by Councilman Hendrix that we table this item for one week with
the idea of contacting and getting a commitment from the County as far as what
they are going to provide for the $420.00 per month; If they are just going to
provide a machine or if they are going to supply the proper materials at the
proper tUne in the maintenance program and supervision. Seconded by Councilman
Daniels. Discussion. Vote on the motion: Councilman Hunter, aye; Councilman
Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; motion carried.
Councilman Van Eepoel requested that a letter be sent to Casselberry to notify
them that to continue draining Casselberry property on to Winter Springs roads at
our expense is totally unacceptable; they dug a ditch right to a terminal stake
which was the boundary between Winter Springs and Casselberry (Seminole Downs
property). They drained that entire west south area of the track property onto
our roads and that is the reason we have the drainage problem. A letter is to
be sent to the City Engineer to provide us with a definitive recommendation of
action that should be taken, and this will be on the agenda next week.
The offer by the County to build the Hayes Road Bridge was discussed.
Motion was made by Councilman Hunter that the Mayor be instructed to contact the

County to find out if they would build the bridge and allow us to pay them back
at some future date. Seconded by Councilman Daniels. Discussion. Vote on the
motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye;
Councilman Van Eepoel, no; motion carried.
The offer by the County to build a bike path was discussed.
Motion was made by Councilman Hunter that we go ahead and notify the County of our
desires that they go ahead and construct the sidewalk and that the City Finance
officer find the necessary funds to pay the County; and request the linear footage,
the cost of linear footage and the depth of the setback be outlined and the depth
be far enough back for safety factors and that a spur be added at the crosswalk to
the road. All of this is contingent upon information by the Department of Transporta-
tion. Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman
Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel,
yes; motion carried.
Motion was made by Councilman Daniels that we accept the maintenance bonds for
Highlands, Section IV and Section V and Sheoah Boulevard provided that Florida
Land will furnish the City the second year's extension as required by City Ordinance
No. 124 and with the further understanding that Florida Land will continue to
maintain Sheoah Boulevard until it is substantially built out (majority).
Seconded by Councilman Van Eepoel. Discussion. Vote on the motion: Councilman
Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van
Eepoel, yes; motion carried.
Motion was made by Councilman Daniels to transfer $200.00 from Fire Dept. Line Code
206 and transfer $300.00 from Fire Dept. Line Code 355 to Fire Dept. Line Code 345,
$500.00. Seconded by Councilman Hunter. Discussion. Vote on the motion: Councilman
Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel,
yes; motion carried.
Motion was made by Councilman Daniels that the City of Winter Springs formally
advise the Seminole County Commissioners that we are desirous of completing a
contract with them for them to take over the anUnal control function for the City
of Winter Springs, effective October 1, 1975. Seconded by Councilman Hunter.
Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye;
Councilman Daniels, aye; Councilman Van Eepoel, no; motion carried.
Motion was made by Councilman Daniels that the Attorney be instructed to draft an
ordinance for the City of Winter Springs to accept the Seminole County ordinance
on anUnal control; further, that the City Attorney assure that the provision of
the current city of Winter Springs AnUna1 Control Code that specifies the maxi-
mum number of dogs and cats that can be maintained in anyone household be
retained in the City of Winter Springs Code. Seconded by Councilman Hunter.
Discussion. Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye;
Councilman Daniels, aye; Councilman Van Eepoel, yes; motion carried.
Councilman Daniels reported that he had reported to Council several weeks ago
that the County had approved the allocation of a Planner under the CETA Program to
the City of Winter Springs. He said that they formally approved their informal
act of some three weeks ago at last Tuesday's County Commission meeting and because
of our push and urgency for this Planner, they also allocated one to Altamonte
Springs and offered an allocation of one to four other cities provided they desire
it. This is a great step toward getting the Seminole County Lana Use Plan<.started.

Mr. Pellerin asked about the report of the investigation of the issuance of the
building permit for the church and Councilman Hunter said that Mr. Bradshaw had
given him a report and this is in; the hands of the Attorney.
Councilman Van Eepoel reported that she had not received a cover letter of
explanation about the six page report turned in by Ray Bradshaw and cannot
understand the annotated context. She requested a copy of the cover letter.
Motion was made by Councilman Daniels that all city employees be instruceed,
as a result of this Council Meeting, that all of their actions will be in accord-
ance with the governing laws, codes, etc., and that they will not take it upon
themselves to approve plans or other issues that are not strictly in accordance
with the laws and codes, etc., provided normal discretionary decisions may be
made when the applicable laws or codes are not specific. Seconded by Councilman
Van Eepoel. Discussion. Vote on the motion: Councilman HUnter, aye; Councilman
Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes; motion carried.
