CITY OF WINTER SPRINGS
July 14, 1975
The Regular Session of the City Council of the City of Winter Springs, Florida was
called to order by Mayor Troy Piland. The invocation was given by Councilman
Ernest Hendrix. The pledge of allegiance to the flag was led by Councibaan Daniels.

Motion was made by Councilman Daniels to approve the minutes of July 7th. as
presented. Seconded by Councilman Hunter. Discussion. Vote on the motion:
Councilman Hunter, aye; Councilmaa Hendrix, aye; Councilman Daniels, aye;
Councilman Van Eepoel, yes; Councilman Browning, aye; motion carried.
Hr. Robert W. Farrell, Manager of ComBank, Longwood was present to provide us with a
brochure aad a year end report on the services ComBank Corporation could offer to the
City of Winter Springs. He coaaented ComBank Longwood is a local and convenient bank
for the City of Winter Springs.
Hr. Hill spoke for the Southeast First National Bank of Maitland. He stated the
Southeast First National Bank of Maitland takes an intrest in the City of Winter
Springs.
Hotion was made by Councilman Daniels that the City change its operational banking
services to the ComBank/Longwood effective October 1, 1975. Further that necessary
actions be taken to prepare for and make the transition with minimum interuption of
banking service. Seconded by Councilman Van Eepoel. Discussion. Vot.e on the motion:
Councilman Hunter, no; Councilman Hendrix, no; Councilman Daniels, aye; Councilman
Van Eepoe1, yes; Councilman Browning, no; motion fails.
Councilman Hunter's reason for voting no as he stated, is on the basis of a personal
intrest shown by the Southeast First National Bank of Maitland.
Attorney Brock read the second reading of Ordinance Number 121 by title only.
Motion was _de by Councilman Van Eepoel to adopt Ordinance Number 121 on the second
reading by title only. Seconded by Councilman Hendrix. Discussion. Vote on the motion:
Councilaan Hunter, aye; Councilman Hendrix, aye; Councilman Daniels, aye;
Councilman Van Eepoel, yes; Councilman Browning, aye; motion carries.
Mayor Piland recessed the Council Meeting and opened the Public Hearing for Ordinance
Number 122. Attorney Brock read the ordinance in its entirely. No one spoke for
or against the ordinance. Mayor Piland closed the public hearing and reconvened the
Regular Session. .
Hotion was made by Councilman Daniels that we approve on 1st. reading of this
ordinance with the proviso that Section 6-33 be as just read and Section currently
numbered 6-33 on; be renumbered 6-34 on. Seconded by Councilman Hunter.

Motion was made by Councilman Daniels that the City request that the County provide
pound services for the City at no costs, similar to those pound services that
would be provided if the City entered into animal control service agreements with
the County. Further, that these services be retroactive to the date of animal
control service was provided to the first City in the County. Seconded by Councilman
Hunter. Discussion. Vote on the motion: CouncibDan Hunter, aye; Councilman
Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, no; Councilman
Browning, aye; motion carried.
Councilman Browning requested the Mayor's Office handle a letter to the County
requesting the services provided by the animal control kennel be extended to the
City of Winter Springs without charge.
Motion was made by Councilman Browning to change court dates and plea nights
commencing in August to the first and third Thursday of the .oath. The first
Thursday being plea night and the third Thursday being court night. Seconded
by Councilman Hunter. Discussion. Vote on the motion: Councilman Hunter,
aye; Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel,
yes; Councilman Browning, aye; tllOtion carried.
City Judge Edmund Woolfolk disqualified himself to the case Winter Springs verses
Borgen at the request of the Attorney for the defense. City Attorney N....n Brock
also disqualified himself in as .u4h as he was City Judge at the time of trial.

Motion was made by Councilman Browning that Wally Stalnaker be appointed as Judge
for the case Winter Springs verses Borgen; and John Jones be appointed prosecutor
for that case; these individuals also handle the case load for that evening. The
court date to be set. Seconded by Councilman Hunter. Discussion. Vote on the
motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman Daniels,' aye;
Councilman Van Eepoel, yes; Councilman Browning, aye; tllOtion carried.
Annual message on the Budget was given by Mayor Piland to the Council and Tuesday
July 22, 1975 be assigned as a Special Workshop Session devoted to discussion
of the Budget for the fiscal year 1975-76.
Councilman Hendrix gave Council a copy of all department proposed budgets and
estimated revenues. CouncibDan Hunter commented the Planning Department figures
were omitted and they will be added. Councilman Daniels coaaaeuted that we
cousolidate all telephone services into one budget; suggested the Finance
Budget and consolidate all janatorial services into one budget possibly the
Public Works Budget.

Motion was made by CouncibDan Daniels that the Attorney be instructed to prepare
an ordinance covering the coustruetiou, operatiou, and maintenance of family
swilBing pools in the City, and that he set up a..public hearing on said ordinance
for the llth. of August, 1975, or as soon thereafter as possible. Seconded by
Councilman Van Eepoel. Discussion. Vote on the motion: Councilman Hunter, aye;
Councilman Hendrix, aye; Councilman Daniels, aye; Councilman Van Eepoel, yes;
Councilman Browning, aye; motion carried.

f' Motion was made by Councilman Daniels that the City Inspector be instructed to
assure that swi.Daing pools under construction in the City are adequately enclosed
with either teaporary or permanent fencing during all phases of construction to
safeguard against children being injured. Further that permanent fencing or
enclosure is in place at the time swiDllling pool construction is completed and
pool is filled with water. Seconded by Councilman Hendrix. Discussion. Vote
on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman
Daniels, aye; Councilman Van Eepoel, yes; Councilman Browning, aye; motion
carried.

Mayor Piland recommended to appoint Councilman Daniels to the committee of
CALNO to discuss double taxation. Seconded by Councilman Van Eepoel. Discussion.
Vote on the motion: Councilman Hunter, aye; Councilman Hendrix, aye; Councilman
Daniels, aye; Councilman Van lepoe1, yes; Councilman Browning, aye; motion carried.
Motion was made by Councilman Van lepoel that we participate in the DCA goals
and objective study. Seconded by Councilman Hendrix. Discussion. Vote on the
motion: Councilman Hunter, aye; Councilman Hendrix, no; Councilman Daniels, no;
CouncibDan Van Eepoel, yes; CouncibDan Browning, aye; motion carried.
CouncibDan Daniels stated that he disagrees with this fo~ of operation. We
as a municipality should not participate in the goals and objective study.
Councilman Hunter stated that he objected in the mannor in which the planning has
been presented he also objected to the expenditure being presented in this
mannor without consultation.
Councilman Browning stated as not ..ing in agreement to the fact that these
would be wasted funds, the results would be worthless; any planning has to take
place, it is not my anticipated conclusion that it would be worthless planning
even before it starts, the Regional Planning Council is a good organization.
Hotion was made by Councilman Hendrix that the Council allow Attorney Brock to
make an offer of judgeaent in the amount of twelve hundred and fifty dollars
($ 1,250.00) in the Albritton case; not for the fact that we doubt his ability
to pursue the case to its end but from the nuisance stand point. Seconded by
Councilman Daniels. Discussion. Vote on the motion.: CouncibDan Hunter, aye;
Councilman Hendrix, aye; Councilman Daniels, aye; CouncibDan Van Eepoel, absent;
Councilman Browning, aye; motion carried.
Motion was made by Councilman Hunter to adjourn. Seconded by CouncibDan
Daniels. Motion carried.
