Dear Mayor,
Thank you for your letter of November 16, 1973 concerning our commitment to improve the
City park area on Moss Road within the Terrace subdivision.
Our commitment to improve the park area was based on the belief that such improvement
would benefit the City, residents of the development and our own building program. We
had hoped other builders and developers would be encouraged to participate in similar
efforts, but made the commitment with full understanding that the development cost for
this particular park area would very likely be ours alone. We also understood that the
City's ability to help was limited to points:
1. Permission to build on City property
2. Waiver of any permit or inspection fees, and
3. Maintenance of the facilities after completion.
We shared a concern that whatever facilities were developed be as free from maintenance
problems as possible.
Development of the park area in a proper manner is dependent upon design and completion
of improvements to the adjacent portion of Moss Road and to the adjacent portion of the
power easement to the South. Soil and drainage conditions in that pocket will only be
borderline at best. Without suitable soil conditions and drainage and improvements,
other than landscaping, and passive recreation would have substantial maintenance prob-
lems from the day they were completed. We believe, however, that if the common drainage
problem can be resolved, we can create an acceptable soils condition for at least one
hard surface playing area.

By February 15, Wilco will thoroughly investigate the soil and drainage conditions on the
park area, encourage the developer and, power company to have completed a plan for the
easement area, have obtained as built plans for Moss Road and taking into account all three
factors, submit plans for the improvements to the City for review. To the extent
feasible, those plans will include two (2) tennis courts, a basketball court area and
landscaping. Upon approval of the plans by the City, the improvements will be made with-
in 120 days.
We regret the confusion and misunderstanding associated with this project. While failure
or lack of communication is often convenently blamed for problems caused by other reasons,
it is clearly the reason here. We also regret any unauthorized improper statements by
persons associated with the Wilco Group that may have misled our customers and citizens
of the City, or mistated the position of the city.
We ask that this letter be incorporated as part of the official City records on this
matter.

We respectfully request a change of zoning from Rural Urban
to Planned Unit Development of the following described property
presently lying within the city limits of the City of Winter Springs,
(colored yellow on the attached city map) and more fully described
as follows:
The South 189 feet of lots 99, 100, 101, and 102
(the portion East of Shore Road). The Northwest
10 acres of lot 110, all of lot 111 lying east
of Shore Road, South of Panama Road and East of
Fisher Road, and all portions of the following
lots lying East of Fisher Road-lots 119, 127,
135, and 143, All in Block D, DR Mitchell's
survey of the Moses E. Levy Grant, Plat Book 1,
Page 5 of the Public Records of Seminole County.
Preliminary plans will be submitted to the City of Winter Springs
zoning board on October 25, 1973.

We request annexation to the City of Winter Springs of the
property colored brown on the attached city map with a change of
zoning from Agricultural to Planned Unit Development.
The property consists of the South 175 feet of lot 118, all
of lots 126, 134, 142 and all lot 147, except a strip 300 feet
deep and approximately 2000 feet wide along the South boundry;
as identified in DR. Mitchell's Survey of the Moses E. Levy Grant
as recorded in Plat Book 1, Page 5 of the Public Records of
Seminole County.
