PROCEEDINGS AT COUNCIL MEETING
VILLAGE OF NORTH ORLANDO, FLORIDA
MAY 2, 1961, at 8:00 P.M.
Mayor Fasula called the meeting to order. In attendance
were: Mayor Fasula, Councilmen Jackson, Memory, Terebo and Webster.
The Village Clerk read the minutes of the previous meeting
held April 4, 1961. Mayor Fasula called for any corrections or
additions. Hearing none, the minutes were approved as read.
The Mayor asked for reports, and the following were there-
upon given: Chief Stevenson on behalf of the Fire Department; Mr.
Woody Anderson on behalf of the newly formed Civic Association; and
Mr. Sutton on behalf of the Police Department.
The Mayor reported that in connection with the Police Depart-
ment, notices had not yet been sent out to the residents regarding
contributions, but that they would probably be sent out the first
of the month along with utility bills. That the percentage of
contributions the past month had been very small, but that there
were enough funds on hand to maintain the Police Department for
one more month. Councilman Jackson stated that the notices to be
sent out would state that the contributions would be due on the
15th of the month, and if not received by then, that they would
turn over the unpaid ones to the block captains for collection.
Regarding the permit for the Wilkins Asphalt Plant, the
Mayor reported that its petition had been withdrawn.
Mr. Dean reported that four residents were trying out the
facilities of the Sanford Gas Company; that there had been some

difficulty in getting the old service disconnected; that the
Sanford Gas Company would put residents so desiring their service
on a four month trial basis. After some discussion, several
residents expressed a desire to try the new company. It was noted
by several of the residents now using this gas that they had already
found the rates very much less.
Mayor Fasula asked if there was any new business. Councilman
Jackson stated that the Village had received quite a few petitions
for annexation and that a resolution had been prepared. Whereupon
he read the following resolution:
RESOLUTION
.....
WHEREAS the Village Council of the Village of North Orlando,
Florida, has the power under its Corporate Charter to annex property
into its territorial limits when so petitioned by the owners of a
majority of said property, and
WHEREAS the owners of 58 % of the land have so petitioned
the Council to annex certain parcels of land adjacent to, or within
two miles of, the present Village limits, described as follows:

All that property and adjacent streets lying within the
following boundaries: BEGINNING at the southeast corner of
Lot 10, Block 17, run southeasterly along the south property
line of Lots 12 and 9, Block 16, to the southeast corner of
said Lot 9, Block 16; run northeasterly along the west right-
of-way line of Flamingo Avenue and the prolongation thereof
to the north right-of-way line of North Third Street; run
northwesterly along the north right-of-way line of North
Third Street and the prolongation thereof to the west right-
of-way line of Edgemon Avenue; run southerly along the west
right-of-way line of Edgemon Avenue to the north right-of-
way line of North Third Street; thence run westerly along
the north right-of-way line of North Third Street to the
west right-of-way line of Bombay Avenue; thence run southerly
along the west right-of-way line of Bombay Avenue to the
north right-of-way line of North First Street; thence run
southeasterly along the north right-of-way line of North
First Street to the east right-of-way line of Edgemon Avenue;
thence run southerly along the east right-of-way line of
Edgemon Avenue to the southwest corner of Lot 9, Block 19;

thence run easterly along the south property line of
Lots 9 and 7, Block 19, and a prolongation thereof to
the southwest corner of Lot 7, Block 18; thence run
easterly along the south property line of said Lot 7,
Block 18, to the southeast corner of said lot; thence
run northerly along the west property line of Lots 5,
4, 3, 2, 1, Block 18, and the prolongation thereof to
the southwest corner of Lot 11, Block 17; thence run
southeasterly along the south property line of said
Lot 11, Block 17, to the southeast corner of said lot;
thence run northeasterly along the west right-of-way
line of Fairfax Avenue to the southeast corner of Lot
10, Block 17, the POINT OF BEGINNING. All of which
consists of Blocks 16, 17, 18, 19, 20, North Orlando,
as recorded in Plat Book 12, Pages 10 and 11, Public
Records of Seminole County, Florida, and Blocks 21,
22, 23, North Orlando First Addition, as recorded in
Plat Book 12, Pages 23 and 24 of the Public Records of
Seminole County, Florida, and all adjacent streets.
Also, the property known as Block "E" of Chase and
Company's Subdivision of Wagner, as recorded in Plat
Book 6, Page 64 of the Public Records of Seminole
County, Florida.

Said land situate, lying and being in Seminole County,
Florida.
NOW, THEREFORE, BE IT RESOLVED, that the Village Council
of the Village of North Orlando, Florida, approve and accept
these petitions and
BE IT FURTHER RESOLVED that an Ordinance be drawn and
presented to the Council for its approval at this meeting of
such annexation.
NORTH ORLANDO, FLORIDA
this 2nd day of May, 1961.
Councilman Webster moved that this resolution be adopted.
The motion was seconded by Councilman Terebo, and there being no
opposition, the motion was unanimously car!ied.
Mr. Jackson then read the following ordinance stating that
it would be known as Ordinance #19:

AN ORDINANCE OF THE VILLAGE COUNCIL OF THE VILLAGE OF
NORTH ORLANDO, FLORIDA, ANNEXING CERTAIN PROPERTIES
INTO ITS TERRITORIAL LIMITS.

BE IT ORDAINED that the Village of North Orlando, Florida,
shall hereby annex into its territorial limits the following des-
cribed property:
All that property and adjacent streets lying within the
following boundaries: BEGINNING at the southeast corner
of Lot 10, Block 17, running southeasterly along the south
property line of Lots 12 and 9, Block 16, to the southeast
corner of said Lot 9, Block 16, run northeasterly along the
west right-of-way line of Flamingo Avenue and the prolonga-
tion thereof to the north right-of-way line of North Third
Street; run northwesterly along the north right-of-way line
of North Third Street and the prolongation thereof to the
west right-of-way line of Edgemon Avenue; run southerly
along the west right-of-way line of Edgemon Avenue to the
north right-of-way line of North Third Street; thence run
westerly along the north right-of-way line of North Third
Street to the west right-of-way line of Bombay Avenue;
thence run southerly along the west right-of-way line of
Bombay Avenue to the north right-of-way line of North First
Street; thence run southeasterly along the north right-of-
way line of North First Street to the east right-of-way line
of Edgemon Avenue; thence run southerly along the east right-
of-way line of Edgemon Avenue to the southwest corner of
Lot 9, Block 19; thence run easterly along the south property
line of Lots 9 and 7, Block 19, and a prolongation thereof
to the southwest corner of Lot 7, Block 18; thence run easterly
along the south property line of said Lot 7, Block 18, to the
southeast corner of said lot; thence run northerly along the
west property line of Lots 5, 4, 3, 2, 1, Block 18, and the
prolongation thereof to the southwest corner of Lot 11,
Block 17; thence run southeasterly along the south property
line of said Lot 11, Block 17, to the southeast corner of
said lot; thence run northeasterly along the west right-of-
way line of Fairfax Avenue to the southeast corner of Lot 10,
Block 17, the POINT OF BEGINNING. All of which consists of
Blocks 16, 17, 18, 19, 20, North Orlando, as recorded in
Plat Book 12, Pages 10 and 11, Public Records of Seminole
County, Florida, and Blocks 21, 22, 23, North Orlando First
Addition, as recorded in Plat Book 12, Pages 23 and 24 of
the Public Records of Seminole County, Florida, and all
adjacent streets.
Also, the property known as Block "E" of Chase and Company's
Subdivision of Wagner, as recorded in Plat Book 6, Page 64
of the Public Records of Seminole County, Florida.

Said land situate, lying and being in Seminole County,
Florida.

BE IT FURTHER ORDAINED that this annexation be full and
complete, and the owners of the annexed property shall have the
same rights, privileges, liabilities, and responsibilities of all
other owners of property within the territorial limits of the
Village of North Orlando, Florida.
Mr. Webster moved that this Ordinance be adopted. The
motion was seconded by Mr. Memory and unanimously carried. Some
discussion followed the adoption of this resolution and ordinance.
The Mayor pointed out that there had been a misinterpretation of
the section of the Charter providing for annexation, which provides
that the owners of the majority of the lands in a given area could
petition for such annexation. Mr. Jackson stated that the majority
of the lands involved were represented in these petitions. He
then read from the Charter the following section under Article V:

"(29) Upon petition of the owners of the majority of
the lands adjoining or within two (2) miles of the terri-
torial boundaries of said municipality, to annex such
lands by ordinance to the territorial limits of the
municipality hereby established."
He stated that the total combined area constituted a majority
of the lands involved. It was noted, therefore, that Council was
within its jurisdiction to make such annexation.
The Mayor asked if there was any more business to come
before the meeting. Hearing none, on motion of Mr. Terebo the
meeting was adjourned.
