CALL TO ORDER
The Planning and Zoning Board/Local Planning Agency Regular Meeting of Wednesday,
May 2, 2007 was called to Order at 7:00 p.m. by Chairman William H. Poe in the
Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434,
Winter Springs, Florida 32708).

Workshop Minutes dated February 28,2007, on Page 2, I have a copy before you with an
addition to the Minutes under 'Public Input' when Commissioner [Joanne M.] Krebs
spoke and when I went back to listen to the tape, I made an addition and I ask the
Planning and Zoning Board to accept this change, if you will, and the submission and to
replace this Page 2. If you do accept this change as presented, could you include in the
Motion, 'And with the change that the Clerk made'?"

Chairman Poe said, "Our normal Meeting falls on a Wednesday, and I have taken note
that the 4th of July falls on a Wednesday and most probably will be scheduled as a
Holiday." Chairman Poe then said, "Do we want to look at scheduling another date for
that particular Meeting?" Ms. Eloise S ahl strom, AICP, ASLA, Senior Planner,
Community Development Department said, "I suggest that we do go ahead and schedule
a date at this point in time."
Advisory Board Member Torn Brown said, "The 10th [July] looks like the only day ifit is
open." Chairman Poe asked Ms. Sahlstrom, "Does July 10th [2007] fit your schedule?"
Ms. Sahlstrom said, "Yes."

Requests That The Local Planning Agency Hold A Public Hearing For Ordinance
2007-06, A Large Scale Comprehensive Plan Amendment, Which Changes The
Future Land Use Map Designation Of Two (2) Parcels Containing 28.9 Gross Acres,
More Or Less, Located At 1900 DeLeon Street (The Southwest Corner Of DeLeon
Street And Howard Avenue) From (Seminole County) "Rural-3" (1 Dwelling Unit
Per 3 Acres) To (Winter Springs) "Public/Semi-Public" With "Conservation
Overlay" (On Those Affected Areas).
Ms. Sahlstrom presented this Agenda Item and displayed a PowerPoint presentation of
the 'Location Map' .
Ms. Sahlstrom said, "There is a sheet in the Lobby. It is a Comprehensive Plan Citizen
Courtesy Information List. This is something that the State asks that we make available
for anybody to be notified from the State." Ms. Sahlstrom then said, "Right now I am
anticipating the Public Hearing for Second Reading and Adoption to be September 10th
[2007] depending on if this Board makes their recommendation tonight, whether that be a
recommendation for or against this Item, I am expecting it to go to the City Commission
for Public Hearing on May 29th [2007]."
A Concept drawing was shown next.
Ms. Sahlstrom stated, "Staff believes that this project meets all of those requirements -
Staff does support this item and ask that this Board would hold the Public Hearing and
make a recommendation of Approval to the City Commission for First Reading and
Transmittal. "
Ms. Sahlstrom said, "On Attachment 'A' under the Legal Notices - you will notice that in
the Title of these Ordinances, the two (2) that are being Transmitted to the State, there is
a reference and in this particular case it says, referenced as LS-CPA-07-03. That actually
has been an internal designation and in talking with the City Attorney, we determined
that we felt that that designation was confusing and we should just stick with the
Ordinance Numbers. So, the Ordinance that is included in your packet, no longer carries
that reference."
Mr. Peter Brown, Policy Analyst, St. John's River Water Management District, 4049
Reid Street, Highway 100 West, Palatka, Florida: as a representative on behalf of the
District, Mr. Brown and stated, "I believe the 'Staff Report' covers the justification very
well of why this Amendment should be approved."

District, 4049 Reid Street, 100 West, Palatka, Florida: gave a briefing on how this
project would work.
The Salary Canal Project site was displayed.

Requests That The Local Planning Agency Hold A Public Hearing For Ordinance
2007-07, A Large Scale Comprehensive Plan Amendment, Which Changes The
Future Land Use Map Designation Of Three (3) Parcels Containing 29.3 Gross
Acres, More Or Less, Located Immediately West Of DeLeon Street At Cress Run
From (Seminole County) "Rural-3" (1 Dwelling Unit Per 3 Acres) To (Winter
Springs) "Rural Residential" (Up To 1 Unit Per Gross Acre) With "Conservation
Overlay" (On Those Affected Areas).
Ms. Sahlstrom introduced this Agenda Item and said, "There again, we do have the
Citizen Courtesy Information List if you are here on this particular item, there is a sheet
out there and it is designated to the Weaver property, and if you were not in here earlier
when I mentioned that this is something that is transmitted with the item to the State and
then the State will notify you as it moves forward."
A Map was shown of the property site.

Ms. Sahlstrom stated, "At the direction of the City Commission, Staff is proceeding with
this item as a City initiated Large Scale Future Land Use Map (FLUM) Amendment to
change the designation from its existing Seminole County designation to a Winter
Springs designation."
Furthermore, Ms. Sahlstrom said, "When it went to the Commission for Transmittal for
the Public Hearing and for the Transmittal Hearing, the Commission declined to move it
forward and it was at that time that the Commission directed Staff to come back in at the
next cycle because Large Scale Comp[prehensive] Plan Amendments are only allowed to
go to the State twice a year."
An Aerial Map of the property was then shown.
Next, Ms. Sahlstrom said, "We feel that this is justified as 'Rural Residential' in keeping
with the idea of a transition between higher intensive Uses to the 'Rural' Black
Hammock area as desired particularly by the City Commission." Ms. Sahlstrom also
stated, "We have sent Notices to the County and to the various cities and I have had
several conversations with the County and they determined that they would not send
anybody to the Meeting tonight, but I have asked them to draft a letter giving their
response so that we would have that when it goes to the Commission Meeting."
Ms. Sahlstrom stated, "Staff does recommend that you Approve this item to go forward
to the Commission for First Reading and Transmittal Hearing."
Ms. Margaret A. Wharton, P.A., Esquire, 103 South Brown Avenue, Orlando, Florida:
and stated for the Record that she is not the Applicant. Representing Mr. Weaver, the
owner of the property, Ms. Wharton distributed correspondence to the Board Members.
Ms. Wharton is opposed to this Ordinance going forward.

Mr. Gary Adair, 476 Verandah Court, Winter Springs, Florida: as the owner of Mid-
Florida Motorsports, Mr. Adair expressed his concerns if the current Land Use is
changed. Also spoke about the permits on the buildings. Concerned about the future
'Use' of industrial buildings.

Requests The Planning And Zoning Board Hold A Public Hearing Related To
Ordinance 2007-14 Which Rezones 29.3 Acres (More Or Less), Located
Immediately West Of DeLeon St. At Cress Run From (Seminole County) "A-3"
Agricultural To (Winter Springs) "R-Cl" Single Family Dwelling District"
(Minimum Lot Size- 1 Acre).
Ms. Sahlstrom presented this Agenda Item and said, "Staff has reviewed this and does
believe that we meet those Criteria." Ms. Sahlstrom said, "When you do have a City
initiated action, the City does notify the Applicant by 'Certified' letter and the Florida
Statutes state that the Applicant is to be notified within a certain period of time before
any Adoption takes place if it should take place, and we did meet those requirements.
We met the requirements for the Noticing in the paper and we also did Notice the
adjacent property owners within one hundred fifty feet (150') about both of these
actions. "
Next, Ms. Sahlstrom stated, "Staff does ask that you would make a recommendation to
the City Commission to Adopt the Zoning change. Zoning is dependent upon the Land
Use so, since it has a Large Scale Land Use in process, the Zoning would not be Adopted
until the Land Use was in fact Adopted."

Ms. Sahlstrom said, "Actually I have a mistake in here and I apologize. If you look at the
very last page of the Staff Report, the dates under the 'Anticipated Implementation
Schedule', we anticipate that the City Commission would have First Reading of the Re-
Zoning Ordinance on May 29th [2007], that the City Commission would most probably
have the Second Reading in consideration for Adoption of the Large Scale Amendment
on September lOth [2007] and then after that consideration, if in fact the Commission
were to Adopt the Large Scale Comprehensive Plan Amendment, then also at the
September 10th [2007] Meeting, the City Commission could then Adopt this after having
a Public Hearing for Second Reading. So, that date of June 25th [2007] is incorrect. It
should say September 10th [2007]."

2007-09, A Small Scale Comprehensive Plan Amendment, To Change The Future
Land Use Map Designation Of One (1) Parcel Containing 4.32 Acres, More Or Less,
Located On The West Side Of DeLeon Street At 1740 DeLeon Street From
(Seminole County) "Rural-3" (1 Dwelling Unit Per 3 Acres) To (Winter Springs)
"Rural Residential" (Minimum 1 Acre) With "Conservation Overlay" On Those
Affected Areas.
Ms. Sahlstrom introduced this Agenda Item, displayed an Aerial view of the property and
said, "Staff does recommend that you hold a Public Hearing and recommend Approval to
the City Commission for Adoption of this Ordinance which is a Small Scale
Comprehensive Plan Amendment to change the Future Land Use Map (FLUM)
designation of one (1) parcel from 'Rural-3' to Winter Springs 'Rural Residential' with
'Conservation Overlay' on those affected areas. And, if you do make a recommendation
to move this forward, it will go to the City Commission on May 29th [2007] and because
it is a Small Scale Comprehensive Plan Amendment, it does not have to be Transmitted
to the State for review. We transmit it to them after an Adoption just for their records.
And so, Adoption is anticipated most likely for June 25th [2007]."

Requests That The Planning And Zoning Board / Local Planning Agency Hold A
Public Hearing For Ordinance 2007-15, Which Rezones A Parcel Containing 4.32
Acres, More Or Less, Located On The West Side Of DeLeon Street At 1740 DeLeon
Street From "A-3" Agricultural (Seminole County) To "R-Cl" (City Of Winter
Springs) Single Family Dwelling District" (Minimum Lot Size- 1 Acre).
Ms. Sahlstrom presented this Agenda Item and said, "The property owner was notified by
'Certified' mail as well as the adjacent property owners. This is a City initiated request
to change it from 'A-3' Agriculture to 'R-Cl' which would be a minimum lot size of one
(1) acre."
Ms. Sahlstrom stated, "We analyzed the Request against the fourteen (14) Criteria in the
Code and found that it met the review standards, it satisfied those standards, and
therefore, Staff does recommend you hold a Public Hearing related to Ordinance 2007-15
and that you would make a recommendation of Adoption to the City Commission to
Adopt the change of Zoning to 'R-Cl'."

Or Less, Located Immediately West Of DeLeon Street At 201 Cress Run From
(Seminole County) "Rural-3" (1 Dwelling Unit Per 3 Acres) To (Winter Springs)
"Rural Residential" (Up To 1 Unit Per Gross Acre) With "Conservation Overlay"
(On Those Affected Areas).
Ms. Sahlstrom introduced this Agenda Item and said, "We evaluated the Request which
is City initiated at the direction of the City Commission and we found that it met the nine
(9) Criteria which are in your Staff Report under the Findings and Staff does recommend
that you, the Local Planning Agency hold a Public Hearing and recommend Approval for
Ordinance 2007-10 which is also a Small Scale Comprehensive Plan Amendment and
that means that it can go for First and Second Reading during a faster time period, so we
anticipate that that could occur going forward on May 29th [2007] for the First Readin~
and then followed up with the possible Second Reading and Adoption on June 25
[2007] ."

Requests The Planning And Zoning Board Hold A Public Hearing Related To
Ordinance 2007-16 Which Rezones 1.6 Acres, More Or Less, Located Immediately
West Of DeLeon Street At 201 Cress Run From (Seminole County) "A-3"
Agricultural To (City Of Winter Springs) "R-Cl" Single Family Dwelling District"
(Minimum Lot Size- 1 Acre).
Ms. Sahlstrom presented this Agenda Item and said, "This is a City initiated Zoning
request and the property owner was notified by 'Certified' mail as well as adjacent
property owners and [Seminole] County. We evaluated the Request based on the
fourteen (14) Code requirements and found that it was in Compliance and we, therefore,
recommend the change in Zoning and there again, it does not affect the property owners
rights to continue under the fifteen (15) year Development Order and so, therefore, Staff
