CALL TO ORDER Tape I/Side B The Planning and Zoning Board/Local Planning Agency Regular Meeting of Wednesday, February 4, 2004 was called to order at 7:02 p.m. by Vice Chairperson Joanne Krebs in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Chairman Tom Brown, absent Vice Chairperson Joanne Krebs, present Board Member Rosanne Karr, present Board Member William Poe, present Board Member Ned Voska, present Vice Chairperson Joanne Krebs led the Pledge of Allegiance. II. CONSENT AGENDA CONSENT A. Approval Of The November 11,2003 Special Meeting Minutes. "I MOVE THAT WE APPROVE THE NOVEMBER 11th [2003] SPECIAL MEETING MINUTES." MOTION BY BOARD MEMBER KARR. SECONDED BY BOARD MEMBER POE. WITH CONSENSUS OF THE BOARD, THE MOTION WAS APPROVED. MOTION CARRIED. "I RECOMMEND WE APPROVE THE MINUTES OF NOVEMBER 5th [2003J." MOTION BY BOARD MEMBER POE. SECONDED BY BOARD MEMBER KARR. WITH CONSENSUS OF THE BOARD, THE MOTION WAS APPROVED. MOTION CARRIED. Community Development Department - Planning Division Requests The Planning And Zoning Board/Local Planning Agency Hold A Public Hearing Related To Ordinance 2004-05 Which Adopts A Small Scale FLUM (Future Land Use Map) Amendment By Changing The Future Land Use Map Designation Of 8.9 Acres (More Or Less), Located At 900 East State Road 434 Adjacent To Central Winds Park, From "Suburban Estates" (Seminole County) To "Town Center" (City Of Winter Sprin~s). Ms. Eloise Sahlstrom, AICP, ASLA, Senior Planner, Community Development Department, stated, "Staff requests that the Local Planning Agency make the recommendation to the City Commission to approve the Future Land Use Map change to 'Town Center'." Vice Chairperson Krebs opened the "Public Input" portion of this Agenda Item. No one spoke. Vice Chairperson Krebs closed the "Public Input" portion of this Agenda Item. "I WOULD MAKE A MOTION TO RECOMMEND THE APPROVAL, WHICH RELATES TO ORDINANCE 2004-05, WHICH ADOPTS A SMALL SCALE FLUM [FUTURE LAND USE MAPJ AMENDMENT BY CHANGING THE FLUM [FUTURE LAND USE MAPJ DESIGNATOR FROM 'SUBURBAN ESTATES' TO 'TOWN CENTER'." No one spoke. Vice Chairperson Krebs closed the "Public Input" portion of this Agenda Item. "I WOULD MOVE TO APPROVE ORDINANCE 2004-06 WHICH REZONES SUBJECT PROPERTY FROM 'A-I' SEMINOLE COUNTY TO CITY OF WINTER SPRINGS 'TOWN CENTER'." MOTION BY BOARD MEMBER POE. SECONDED BY BOARD MEMBER VOSKA. DISCUSSION. MS. SAHLSTROM STATED, "THOSE PARCELS - ARE IN SEMINOLE COUNTY AND ALL THOSE PROPERTY OWNERS WERE NOTIFIED BY CERTIFIED LETTER. WELL, ALL PROPERTY OWNERS WITHIN ONE HUNDRED AND FIFTY FEET (150') WERE NOTIFIED BY CERTIFIED LETTER TO LET THEM KNOW ABOUT THE ANNEXATION AND NONE OF THEM BROUGHT FORTH ANY - CONCERNS WHATSOEVER." VOTE: VICE CHAIRPERSON KREBS: AYE BOARD MEMBER KARR: AYE BOARD MEMBER POE: AYE BOARD MEMBER VOSKA: AYE MOTION CARRIED. PUBLIC HEARINGS C. Community Development Department - Planning Division Requests The Planning And Zoning Board/Local Planning Agency Hold A Public Hearing Related To Ordinance 2004-07 Which Adopts A Small Scale FLUM (Future Land Use Map) Amendment By Changing The Future Land Use Map Designation Of A 8.5 Acre Parcel, Located At Bird Road And Tusca Trail, From "Low Density Residential" (Seminole County) To "Rural Residential" (City Of Winter Springs). Ms. Sahlstrom said, "Recommend that the Local Planning Agency hold a Public Hearing relating to Ordinance 2004-07 and recommend adoption for this piece of property changing it from 'Low Density Residential' to 'Rural Residential'." Board Member Rosanne Karr stated, "I went out to the site, it is Tusca Trai1." Board Member Karr then asked, "Is that an abbreviation for Tuscawilla Trail?" Ms. Sahlstrom replied, "No. Tusca Trail is the correct name of the location." Furthermore, Ms. Sahlstrom added, "The Agenda - says that the property is located at Bird Road and Tuscawilla Trai1. It should say 'Tusca Trail', not 'Tuscawilla'." Discussion. Vice Chairperson Krebs opened the "Public Input" portion of this Agenda Item. CITY OF WINTER SPRINGS MINUTES PLANNING AND ZONING/LOCAL PLANNING AGENCY REGULAR MEETING - FEBRUARY 4, 2004 PAGE 4 OF 8 Mr. Bruce Broadfier, 1415 Tusca Trail, Winter Springs, Florida: commented on the need to have some sort of a buffer for the rather large lots around the subject site when it is developed and indicated that the property owners on Tusca Trail would like to preserve the natural aspect of it. Mr. Broadfier stated, "There is a written Agreement in place which is on record with Seminole County that this property can only be accessed off of Tusca Trail with one (1) driveway serving one (1) single-family residence." Vice Chairperson Krebs closed the "Public Input" portion of this Agenda Item. "I MAKE A MOTION THAT THE PLANNING AND ZONING BOARD/LOCAL PLANNING AGENCY IN RESPONSE TO THIS, AS A RESULT OF THIS PUBLIC HEARING - ADOPT A SMALL SCALE FLUM [FUTURE LAND USE MAPJ AMENDMENT BY CHANGING THE FUTURE LAND USE MAP DESIGNATION ON THE SUBJECT PROPERTY AT BIRD ROAD AND TUSCA TRAIL FROM 'LOW DENSITY RESIDENTIAL', WHICH IS SEMINOLE COUNTY ZONING, TO 'RURAL RESIDENTIAL' CITY OF WINTER SPRINGS ZONING." MOTION BY BOARD MEMBER KARR. SECONDED BY BOARD MEMBER POE. DISCUSSION. VOTE: BOARD MEMBER KARR: AYE BOARD MEMBER POE: AYE BOARD MEMBER VOSKA: AYE VICE CHAIRPERSON KREBS: AYE MOTION CARRIED. Vice Chairperson Krebs requested, "Can we see the concerns of this gentleman, [Mr. Broadfier] are recorded and given to the [City] Commission so that when they do go to vote on this they have this information and his concerns in their hands." PUBLIC HEARINGS D. The Community Development Department - Planning Division Requests The Planning And Zoning Board Hold A Public Hearing Related To Ordinance 2004-08 Which Rezones 8.5 Acres (More Or Less), Located At Bird Road And Tusca Trail, From "A-I" (Seminole County) To "R-CI" (City Of Winter Springs). Ms. Sahlstrom stated, "Staff has determined that the fourteen (14) review standards have been satisfied and recommends that the Planning and Zoning Board [/Local Planning Agency] hold a Public Hearing relating to Ordinance 2004-08 which changes the Zoning classification on the Renshaw property at Bird Road and Tusca Trail, from 'A-I' Seminole County to 'R-Cl' City of Winter Springs." Vice Chairperson Krebs opened the "Public Input" portion of this Agenda Item. CITY OF WINTER SPRINGS MINUTES PLANNING AND ZONING/LOCAL PLANNING AGENCY REGULAR MEETING - FEBRUARY 4, 2004 PAGE 5 OF 8 Mr. Steve Rike, 1416 Tusca Trail, Winter Springs, Florida: asked for an explanation as to why there were two (2) Agenda Items for this issue. Discussion. Ms. Sahlstrom briefly explained the two (2) separate processes related to Annexation from Seminole County. Vice Chairperson Krebs closed the "Public Input" portion of this Agenda Item. Discussion. "I RECOMMEND THAT THE PLANNING AND ZONING BOARD, AS A RESULT OF THIS PUBLIC HEARING, RELATED TO ORDINANCE 2004-08, WHICH CHANGES THE ZONING CLASSIFICATION ON THE SUBJECT PROPERTY AT BIRD ROAD AND TUSCA TRAIL, FROM "A-I" SEMINOLE COUNTY TO "R-CI" CITY OF WINTER SPRINGS. I RECOMMEND THAT WE APPROVE THIS AND MOVE IT ALONG." MOTION BY BOARD MEMBER KARR. SECONDED BY BOARD MEMBER POE. DISCUSSION. Final Engineering/Site Plan For Phil ReeselNursery Road Commercial Development. Ms. Sahlstrom introduced the Agenda Item. Ms. Sahlstrom indicated that, "There is a scrivener's error. The correct number of trees is twenty-two (22) instead of twenty-three (23)." Next, Ms. Sahlstrom stated, "Staff recommends the Planning and Zoning Board/Local Planning Agency consider and recommend to the City Commission approval of the Final Engineering/Site Plan for a 6.628 - acre tract at the northeast comer of the intersection of [US] Highway 17-92 and Nursery Road. The site has a Commercial Future Land Use designation and is within the 'C-2' Commercial Zoning District." CITY OF WINTER SPRINGS MINUTES PLANNING AND ZONING/LOCAL PLANNING AGENCY REGULAR MEETING - FEBRUARY 4, 2004 PAGE60F8 "I RECOMMEND THAT THE CITY COMMISSION APPROVE A FINAL ENGINEERING/SITE PLAN FOR THE 6.628 - ACRE TRACT AT THE NORTHEAST CORNER OF THE INTERSECTION OF US HIGHWAY 17-92 AND NURSERY ROAD WITH THE CORRECTION TO THE SCRIVENER'S ERROR MENTIONED BY MS. Election Of Officers. "I WOULD LIKE TO NOMINATE VICE CHAIRPERSON JOANNE KREBS AS OUR NEW CHAIRPERSON OF THE PLANNING AND ZONING BOARD [/LOCAL PLANNING AGENCY)." MOTION BY BOARD MEMBER POE. SECONDED BY BOARD MEMBER KARR. DISCUSSION. "I WOULD LIKE TO NOMINATE BOARD MEMBER ROSANNE KARR AS VICE CHAIRPERSON OF THE PLANNING AND ZONING BOARD [/LOCAL PLANNING AGENCY)." Tape II Side A VI. REPORTS Ms. Sahlstrom briefly reported that the [City] Commission adopted the Zoning map in January that the Planning and Zoning Board recommended at the November Workshops, and commented on the February 2, 2004 City Commission Workshop. Also, Ms. Sahlstrom reported that the "Belle Avenue Commerce Zoning District" is anticipated to be approved at the February 9, 2004 City Commission Meeting. CITY OF WINTER SPRINGS MINUTES PLANNING AND ZONING/LOCAL PLANNING AGENCY REGULAR MEETING - FEBRUAR Y 4, 2004 PAGE70F8 Discussion ensued regarding holding a Special Meeting on Thursday, February 19, 2004. Ms. Sahlstrom stated, "We have an Annexation that will be having its Second Reading. It is for a parcel on Orange A venue. The property owner is Estevez and he has made application to be annexed; so we want to move forward with the Future Land Use change and the Rezoning on that property." Ms. Sahlstrom also stated, "We want to move forward with the Belle Avenue Rezoning to our new 'Commerce Center District'. Letters will be going out again. Those property owners were notified last July, but it was different because we were notifying them of changing it from 'C-2' to '1-1', which was Tabled and did not move forward." With consensus of the Board, it was agreed that a Special Meeting of the Planning and Zoning Board/Local Planning Agency would be held on Thursday, February 19,2004 at 7:00 p.m. In addition, Ms. Sahlstrom stated, "I would like to request our March Meeting - be held the third Thursday of the month - moving our regular March Meeting from March 3rd [2004] to March 18th [2004] and I would like to request that our permanent meeting time be on the third Thursday. But, if you - wanted to wait - that could be an Agenda Item - on the [February] 19th [2004]. Vice Chairperson Krebs indicated, "I think we will put it on the Agenda if nobody has any objections to that so we can discuss it then." A brief discussion ensued regarding the Adult Entertainment Ordinance. Board Member Karr asked Ms. Sahlstrom, "Do you have a copy of that Code here? Could you email it to me?" Ms. Sahlstrom replied, "Yes." Discussion ensued on the availability of Agenda Items on the Website. Discussion followed regarding the "American Planning Association" audio conference training. Vice Chairperson Krebs asked Ms. Sahlstrom, "Could you find out more information on that [American Planning Association] for us?" Mr. Sahlstrom replied, "Yes, I could find out. Which one did you particularly want to look into?" Board Member Karr stated, "The "Environmental" one." With discussion, Ms. Sahlstrom requested, "Do you want that - as an Agenda Item to discuss - further the next time, for the Land Use Planning and Environmental Law session?" Vice Chairperson Krebs replied, "Yes." Ms. Sahlstrom replied, "Okay." Vice Chairperson Krebs also requested, "Could you find out any other information of future ones that they are going to have, that would be really helpful." Ms. Sahlstrom replied, "Okay." Lastly, discussion ensued on the property next to City Hall and actions related to the removal of trees.
