I. CALL TO ORDER, PLEDGE OF ALLEGIANCE
The meeting was called to order by Chairperson Hoffinann at 7:05 p.m. in the Commission Chambers,
Municipal Building.

APPROVAL OF MINUTES OF JUNE 5. 1996 LPA WORKSHOP MEETING
Motion: Approval of the June 5, 1996 LPA Workshop Meeting Minutes.
Motion by Fernandez. Second by Stephens.
Vote: Hoffmann, aye; Lein, abstain; Stephens, aye; Fernandez, aye.
Motion carried.

II. NEW BUSINESS
Hopkins arrived. Grimms and four individuals were sworn in for testimony.
A) PALMER SMALL SCALE COMPREHENSIVE PLAN AMENDMENT (SM-CPA-3-96)
Grimms explained Palmer Homes' small scale amendment request is to change the property located
between S.R. 434 and the north end of Shore Road from Commercial to Lower Density Residential.
Palmer Homes is also requesting rezoning to R-1. Grimms read pertinent sections of the staff report.
Neil Hiler of Genesis Engineering Group, said he read the 434 Visioning Plan, and he noted on page
1: "The objective is to enhance and preserve the remaining natural environmental features". Gee
Creek, and the hammock forest that borders it, presents an obstacle in the Commercial development
of the parcel. In order to access the property, a bridge would need to be built. He passed around
several photographs. A reasonable request would be to allow Palmer to develop Low Density
Residential. There is an existing road at the south end of Shore Road that runs north, and the right
of way stops just south of the property. He said he doesn't see Commercial ever being viable on the
property due to the economic problem of building a bridge, and the permitting problems of trying to
knock down enough trees in order to see the Commercial property.
Paul Palmer of Palmer Homes, Winter Park, said that when he got the property it was zoned for
r homes, then he had the zoning changed to Commercial. The widening of S.R. 434 has restricted the
entrance, but extending Shore Road seems reasonable for access. He is requesting to zone the
property to Low Density Residential.

Chairperson Hoffinann asked what the OUT on the map meant, and asked for the County zoning of
the adjacent property. Grimms said OUT meant County Enclave, and the adjacent property is zoned
A-I, Agriculture.
Elizabeth Brazel/e, owner of the property on the east side of Palmer Property, said she prefers to see
residential over commercial next to her property, but feels that 60 foot lots are small. She requests
that a 30 foot wooded buffer be put between the properties. She asked if Shore Road would ever
have an entrance from S.R. 434. Grimms said F.D.O. T. has no intentions of opening Shore Road to
S.R. 434.
Fernandez informed the applicant of having the option of de-annexing from the City.
Dennis Waylin, resides at one of the four houses on Temple Way. One of his concerns was the size
of the homes being built for almost double the price of what he paid for his larger lot five years ago.
His other concern was a 300 foot easement from S.R. 434. The amount of wooding that would have
to come down, if a Residential area, then Commercial were to be developed, would take away from
the environment which drew the residents of the four homes to that area. He also wanted to know
what the affect would be for children playing on the Florida Power easement.

Stephens asked what a developer would do with a creek running in front of the property, if the
property remained Commercial. Grimms said it could be piped and covered over. Chairperson
Hoffinann asked about the parcel between S.R. 434 and the creek. Palmer said that it is wetlands.
BrazeUe said there has been problems of Gee Creek flooding, and she wondered if piping the creek
would hold back even more water. Grimms said that ifit is sized correctly, then there shouldn't be
a problem. Fernandez again informed the developer of the right to de-annex from the city. Hopkins
said that he would not want to see the creek piped or covered over in that area; the Residential Land
Use would be more beneficial to the environment, and to the city as a whole.
Motion: Approve the Palmer request on the property in question to change from Commercial to
Lower Density Residential.
Fernandez asked Stephens to provide finding offacts of the motion. Stephens said that the property
in question would be more compatible if made into Residential with consideration of existing property
around it, including the county property which is zoned Agricultural. There will be problems with
flooding, and Gee Creek will be affected. There still needs to be some green along S.R. 434, possibly
parks.
Motion by Stephens. Second by Hopkins.
Hoffinann said he agreed with the motion and the arguments. Fernandez said he supports the motion.
Lein asked Palmer if he considered a larger frontage for the homes. Palmer said it would not be a
workable project if considered any larger. Hopkins asked if preliminary engineering would come
r" before their board. Grimms said he thought it would.
Vote: Lein, nay; Stephens, aye; Hopkins, aye; Fernandez, aye; Hoffmann, aye.
Motion passed.

Chairperson Hoffinann asked if this recommendation will be passed on to the Commission. Grimms
said, yes.
B) REVISIONS TO MAY 9. 1996 DRAFT LAND DEVELOPMENT
REGULATIONS
The Chair asked for comments from the board members. Grimms said that to the best of his ability,
all the changes of the April 10th meeting have been made as per the board's request.
Fred Goodrow of Berryman and Henigar said his comments are included in his memo, and he was
present to answer any questions. Chairperson Hoffinann recommended that Goodrow's comments
be included in the presentation to the Commission.
Frank Schrimsher of 600 East Colonial Drive, Orlando, said he has reviewed the document, and
there were recommendations made by McIntosh and Associates that he agrees with, but were not put
in the revisions. Chairperson Hoffinann said that the board has been working on these regulations for
a couple of years, and for the time being this is the best thoughts of all of the people involved. When
difficulties arise, the regulations can be amended. Grimms stated that the board's recommendation
will go to the Commission, and they will hold workshops to review the regulations. Grimms said
he would make sure that suggested changes from various individuals would get to the Commission.
Schrimsher said he would submit written comments to Grimms, and attend future hearings.

Motion: Recommend approval of the LDR's as prepared and submitted by the Local Planning
Agency, Goodrow, Grimms, and all other help the board has received, and forward to the City
Commission for their review.
Motion by Hopkins. Second by Lein.
The chair asked for the specific date of the document. Grimms said, May 9, 1996.
Vote: Stephens, aye; Hopkins, aye; Hoffmann, aye; Fernandez, aye; Lein, aye.
Motion carried.
