There were outstanding comments from three (3) departments - Fire, Police and Public Works/
Utility Department (see attached Staff comments).
Motion by Lallathin that the project be recommended for approval contingent on the three (3)
departmental comments being satisfied and the Land Management Specialist be notified by the
Department Heads that these were satisfied. Seconded by Grirnms. All voted aye.
NOTE: Because this project is on fast track (scheduled to open September 96), this is being
presented to the Planning and Zoning Board on July 5, 1995.

Th~ subjeqt engineering. plans. and stQrmwa~er pollution
abatement calculations were received on June 16, '" 1995. The 25-
yearj24~hour storm cal cuI ations and revised pl"ans were received on
June 30, 1995. The following deficienci es were noted during
review:
1. For both Basins #1 and #2, the 25-yearj24-hour stormwater
calculations are missing the pipe sizing and hydraulic grade
line (HGL) calculations that are required in Sec. 9-241
(revised by Ord. #581) of the Land Development Code (LDC).
This is the piping leading to the ponds and the HGL in the
inlets and manholes. This requirement was relayed to Rusty
Zimmerman by telephone on the morning of June 23, 1995. A
copy of Ord. #581 is attached and sample output sheets from
the "aDICPR" Users Manual.
2. Regarding the ponds; Page 9 of the Ardaman & Associates
soils report states that underdrains "...may be necessary to
prevent aquatic vegetation." What was your rational e for not
using underdrains?
3.
On.sheet 1.6 of the engineering, you are showing regular
and handicap parking spaces that are 10-feet X l8-feet and 12-
feet X IS-feet, respectively. Sec. 9-276 of the LDC requires
200 s.f. of area for regular parking spaces. Generally, this
has been 10-feet X 20-feet dimensionally. To the best of my
knowledge, handicap spaces are to be 12-feet X 20-feet, not
counting the ramp area. Please check with the Building
Official on the handicap dimensions.

Environmental Comments
On May 20, 1994, Universal Engineering Sciences in a Phase 1 Environmental SUlVey conducted
for Calton Homes Incorporated stated on Page 7 of the report that "there is potential for impact to
the subject site from the former contents of the extensively corroded 55 gallon drum observed on
the site". It is further stated that ''It is our opinion that the groundwater beneath the subject site be
tested for volatile organics via EP A Methods 601/602".
In another Phase 1 Environmental Survey conducted for the School Board dated July 5, 1994,
Universal Engineering Sciences, in the Summary and Conclusions, does not mention the 55 gallon
drum (it is mentioned on Page 4 of this report) and now states that the groundwater contamination
at the Sprague Electric site "does not pose a probable threat to the subject site. .....UES
recommends no further investigation at this time. If
In another letter from UES dated July 26, 1994, to the School Board, it was stated "UES
recommends no further investigation at this time."
I voiced my concerns to Ms. Chris Birkebak on the contradictions noted in a meeting held at City
Hall on J1.Ule 28, 1995. She stated that she wi1llook into this matter.

In response to your comments regarding the Phase I Environmental Swvey for the proposed
Elementary School E site, I contacted Rohert Cronin, P.G. vvith Universal Engineering Sciences to
<.IisCUS1~ lheir findings. The following is a reit.eration of that discussion:
1. The initial survey. dated May 20, 1995,indicated that there might be some potential hazards
resulting from an ahandoned 55 gallon drum on the site and the existence of groundwater
contamination at th~ Sprague Electric site.
2. Upon receipt of this report, the School Board requested furthcl" investigations by Universal
Engineering Sciences (DES).
3. UES pelfo1"rneo additional investigations, which are outlined in theu- letters of July 5 and July
26, 1994. They concluded tllat the old drum posed no hazards because the surrounding soil
and vegetation appeared healthy. They also found that the contamination at the Sprague
Electric site was not a concern, since the contamination was localized to that site.
4. Robert Cronin spoke with Tim Larson at the FDE? in Tallahassee last week to check on thO'
status of the clean-up at the Sprague Electric site. Mr. Larson said that they are completin~
the design of the clean-up plan and will begin work on the site within the next several
months. He felt that the contamination would pose no threat to the school site. because of
the distance between the sites, the lack of migration, and the fact that the school is utilizing
the city water system.

HigWands Elementary Final Engineering
We have reviewed the final engineering for the proposed elementary school in the Highlands
and have the following comments:
1. The proposed connection to the existing water main shall be by tapping sleeve and valve.
The proposed method does not rninlrnize the disruption of service to the Wildwood
community. Please revise this connection. Also, a temporary jumper connection will be
required for pressurizing the water main prior to receiving DEP certification.
2. The proposed gravity sewer main which is completely different than what was previously
submitted should be reconsidered. The new route is over 1,000 feet longer and is a much
more expensive alternative. Our plat records show that Tract "e" of the Highlands common
area has a dedicated utility easement over the entire area of Tract "C" and a dedicated utility
easement exists over the lots on Dundee Drive. Access should not be a problem and it would
be a simpler and more economical solution.
3. The plans delineate an 8" X 3/4" tee along the west side of the school which really should
be a 3/4" tap with a double strap tapping saddle and corporation.
4 The fire line master meter will not be supplied by the City of Winter Springs. The notes
should be changed to reflect the School Board/contractor will be responsible for purchase
and installation. The City will only inspect.
5. Water and sewer capacity is available for this project and the connection fees have been
computed based on the DEP permit applications. The consultant has estimated flow of 4490
gpd based on a per capita consumption of 5.1 gallons per day and a population of 880. I find
their calculations consistent with our historical data and concur with their determination. The
capacity charges are $1.12 per gallon for water and $6.30 per gallon for sewer for a total of
$33,315.80.

PLANNING AND ZONING BOARD AGENDA ITEM:
III. ANNUAL ELECTION OF OFFICERS
BACKGROUND:
Sec. 20-54 of the City Code provide for the selection of a chairman
and vice-chairman of the Planning and Zoning Board. It states:
There shall be a chairman and vice-chairman of the
Planning and Zoning Board selected from and by the
members. They shall serve a term of one (1) year
or until their appointment to the board is terminated,
whichever is shorter, unless sooner removed by the
board.
NOTE:
Apparently, there have been no rules of conduct adopted
by the Planning and Zoning Board/Local Planning Agency
with respect to time of election of officers, and other
matters.
Also, the P & Z Board is potentially a quasi-judicial
body in certain matters that come before it, such as
rezonings, site specific land use amendments, or other
site-specific development requests.
The Florida Supreme Court ruling of Snvder v. Board of
Countv Commissioners of Brevard County, the ruling on
Jenninqs v. Dade County and other recent developments of
case law, have caused a transition in public hearing
proceedings for local government relating to quasi-
jUdicial matters.
In view of the Snyder and Jennings rulings by the Florida
Supreme Court that have prompted more formal procedures
as a result, it is advisable that the board consider
adopting rules of conduct/procedure for the conduct of
hearings and other matters coming before it.
There was discussion on traffic patterns, reclaimed water, water
front recreation, etc.
STAFF RECOMMENDATION:
The Staff Review Board recommends that request be approved.

BACKGROUND:
Attached for your review is the overall layout for the proposed
elementary school to be constructed on the north side of Shepard
Road, between Sheoah Boulevard and U.S. 17/92.
ANALYSIS:
Attached is the interlocal agreement between the city and the
School Board in regards to the school.
The review process is to be in an expeditious manner as the school
is scheduled to open in September 1996.
The Staff will ensure that all Code requirements are met.
STAFF RECOMMENDATION:
NOTE:
The Staff will conduct its initial review of this plan on
the morning of July 5, 1995.
By having this before you at this time, there will be no
delay in presenting this to the Commission.
ELEMENTARY SCHOOL "E"
An InterlocaI Agreement between
the City of Winter Springs and the School Board of Seminole County
This INTERLOCAL AGREEMENT (the "Agreement") is made and entered into
by the CITY OF WINTER SPRINGS, a body corporate eXisting under the laws of the
State of Florida (the "City") and the SCHOOL BOARD OF SEl\HNOLE COUNlY,
FLORIDA, a body corporate existing under the laws of the State of Florida (the "School
Board").
WHEREAS, the parties to this Agreement have determined to collectively utilize
their individual powers in the public interest to promote the expeditious development of
Elementary School "E"; and
WHEREAS, the State Regulations for Educational Facilities of the Florida
Administrative Code govern the planning and construction of schools in Seminole County
and the comprehensive plan and land development regulations govern planning and
construction in the City of Winter Springs; and
WHEREAS, Section 235.193, Florida Statutes requires the coordination of
planning between the School Board and the City of Winter Springs; and
'WHEREAS, Section 235.193(9), Florida Statutes, provides authority for a local
governing body and district school Board to establish an alternative process for reviewing
a proposed educational facility and site plan, and off-site impacts; and
WHEREAS, Section 235.02, Florida Statutes, permits and authorizes the use of
school buildings and school grounds as community centers; and
WHEREAS, the City and the School Board serve the same public constituency;
THEREFORE, in consideration of the premises and for good and valuable
consideration, receipt of which is hereby acknowledged by both parties, the parties hereby
agree, stipulate, and covenant as follows:
1. This Agreement is entered into pursuant to the provisions of the Florida Interlocal
Cooperation Act contained in Section 163.01, Florida Statutes.
2. In order to coordinate and expedite the planning of Elementary School "E" and comply
with Section 235.193, Florida Statutes, the City Commission will serve as the approving
authority and the School Board will submit the following infonnation on the property
under review:
1
a. legal description
b. topograhical survey and location of existing natural features including trees
c.environmental survey
d. identification of existing soil types and conditions
e. surrounding land use and zoning
f. proposed site plan
g. existing and proposed utilities
h. proposed on-site and off-site improvements
i. stormwater management plan. with drainage calculations
j. identification of any proposed deviations to specified standards of the land development
regulations, \Vith explanations for request
k. additional information that the City requests in order to identify and evaluate the site plan and
its adequacy as it relates to environmental concerns, health, safety, and welfare, offsite impact, and effects
on adjacent property.
The City staff will review the submitted documents, advise the School Board of
deficiencies, and make recommendations to address the concerns. The revised submittal
will then be scheduled for a public hearing before the City Commission at the earliest
possible date. Following approval by the City Commission, school construction may
proceed with normal utility and site development inspections.
3. The School Board will pay to the City the appropriate connection fees for water and
sewer service based on proposed usage calculations approved by the City.

4. Because the primary access to Elementary School"E" will be a Seminole County (the
"County") facility, the City will accept the County transportation concurrency evaluation
and determination unless there is an overriding public safety concern.
5. All notices and' clarifications required under this Agreement shall be directed to the
following offices:

hereof is illegal or invalid for any reason whatsoever, such legality or invalidity shall not
affect the remainder of this Agreement.
8.This Agreement and the rights of the parties shall be governed by and construed or
enforced in accordance with the laws of the State of Florida.

LEFFLER REZONING REQUEST
STAFF REPORT:
BACKGROUND:
Judge K. Leffler, on behalf of the Leffler Company, has made
request to change that zoning assigned to approximately 177 acres
north of S.R. 434 and east of the Seminole County School Board
facilities from Rural Urban (R-U) to Planned Unit Development
(P.U.D.) .

In conjunction with this request, a Master Plan (Wagner station
PUD) was submitted as per Code requirements.
The Staff Review Board had this request as an agenda item at their
meeting of June 6, 1995.
ANALYSIS:
The Future Land Use Designation for this property is Mixed Use
which is compatible with the rezoning request.
At the Staff Review Board meeting, D. McIntosh, representing the
project, discussed the Master Plan and stated that the approach
used was that of flexible land use - assigning multi-uses to a
parcel while a decision is made as to the best use of the land.
Then the preliminary engineering would be submitted for review.
Different land uses addressed were residential, retirement/nursing
facilities, apartments, condos, professional offices and commercial
uses.
The applicant is aware that there is a very strong possibility that
the CSX Railroad and that there are a multitude of proposed uses
for this right-of-way once it is abandoned.
There was discussion on traffic patterns, reclaimed water, water
front recreation, etc.
STAFF RECOMMENDATION:
The Staff Review Board recommends that request be approved.

Review of Wagner Station P.U.D. (Leffler Property)
The following observations are offered:
1. The developer should coordinate the park development with the
City per Objective D, Policy 2; Objective E, Policy 2;
Objective H, Policies 1 and 3 of the Recreation and Open Space
Element of the city's Comprehensive Plan. It should be noted
that in Policy 1) under Objective C) in Goal 3 of the the Land
Use Element, Mixed Use requires that. ." open space shall
not be less than 20%, and public uses, utilities or wetland
conservation easements not less than 5%. . ."
2. The CSX Railroad has made request to abandon the rail line.
There have been various proposals to utilize the rail bed if
and when it is abandoned. The developer should be aware of
this possibility.
3. The City's Future Land Use Map indicates the northwestern
portion of the property is designated "Conservation". This
designated area is approximately 1,500 feet north of S.R. 434
and seems to trend along the tree line roughly paralleling
S.R. 434 approximately 1,500 feet eastward and then southward
250 feet and eastward approximately 650 feet and northward to
the shore.
The precise boundaries of land to be permanently classified
"Conservation" shall be those jurisdictional lines prescribed
by state agencies at the time of field review preparatory to
engineering contiguous property for development. [per POlicy
2) and Policy 3)f. under Objective A) of Goal 2 of the Land
Use Element]
4. Lands designated as "Conservation" on the Future Land Use Map
are subject to the requirements of Policy 3) under Objective
A) of Goal 2) of the Land Use Element of the Comprehensive
Plan.
5. It may be noted that developer indicates on sheet 2 of 2 under
MINIMUM BUILDING SETBACKS/LANDSCAPE BUFFERS 5) BSL/buffer from
'limits of wetlands: 25'. Policy 3)a. does state in part. .
."A larger buffer shall be required on a site-by-site basis
when required to protect the resource".
5. The predominant soil map unit in the area of the project
designated as "Conservation" is (22) Nittaw muck, occasionally
flooded. According to the Soil Survey of Seminole Countv,
Florida, this soil is nearly level and very poorly drained.
It is on the flood plains and is occasionally flooded for long
periods following prolonged, high intensity rains. The slopes
are dominantly less than 2 percent. Other soil units are (9)
Basinger and Delray fine sands and (10) Basinger, Samsula, and
Hontoon soils, depressional. Basinger and Delray fine sands
are nearly level and poorly drained and very poorly drained.
Basinger soil is poorly drained and Delray soil is very poorly
drained. These soils are in sloughs and poorly defined
drainageways. The slopes dominantly are less than 2 percent.
Basinger, Samsula, and Hontoon soils are nearly level and very
poorly drained. These soils are in swamps and depressions.
The slopes are dominantly less than 2 percent.

Written comments as per ouyr request for the June 2, 1995 meeting:
After having reviewed the Master Plan for the Wagner station PUD,
my only concern at this time is for the traffic turning eastbound
from the central Boulevard II A II . Traff ic turning westbound onto SR
434 from Wagner station will have their choice of three different
egresses (two of them being Right In/Right Out only), spreading out
the volume. Eastbound traffic, however, will all have to make left
turns from the single central roadway. Since this Boulevard "A"
will also be aligned with Winding Hollow Blvd., it must obviously
be a signalized intersection to safely handle the anticipated
traffic patterns.
Further comments on public safety and roadway markings will be
provided when site plans are prepared.
Please note: on sheet 2 of the Master Plan under the heading
DESCRIPTION OF LAND USES, #3 and # 5 are in conflict as to the
maximum height, in stories, of uses on Tracts B & E. One says two
stories, the other says three stories.

LEFFLER REZONING REQUEST - Judge K. Leffler, on behalf of the Leffler Company, has
made request to change that zoning assigned to approximately 177 acres north of SR 434 and east
of the Seminole County School Board facilities from Rural Urban (R-U) to Planned Unit
Development (p.U.D.). The Future Land Use Designation for this property is :Mixed Use which is
compatible with the rezoning request. Please refer to the Staff Review Minutes of June 6, 1995
and the Master PUD Plan submitted by the applicant.
PROPOSED ELEMENTARY SCHOOL "E" - Attached for your review is the overall layout
for the proposed elementaty school to be constructed on the north side of Shepard Road, between
Sheoah Boulevard and U.S. 17-92. The Staff will conduct its initial review of this plan on the
moming of July 5, 1995. Also attached is the interlocal agreement between the City and the
School Board in regards to the school. The review process is to be in an expeditious manner as
the school is scheduled to open in September 1996. The Staff will ensure that all Code
requirements are met. By having this before you at this time, there will be no delay in presenting
this to the Commission.
