HomeMy WebLinkAbout1993 07 21 Planning and Zoning Board Regular Minutes e e Planning & Zoning Board Minutes Wednesday, July 21,1993 Amended August 05,1993 Board Members: David Hopkins, Chairman, Present Grace Anne Glavin, Vice-Chairman, Absent David McLeod, Present Thomas Brown, Present John Ferring, Present City Official(s): Greg Kern, City Planner The meeting was called to order at 7:30 P.M. Ms. Glavin will not be attending this evening due to not being reappointed. Approval of the Minutes of June 16. 1993 Brown made a motion to approve the minutes of June 16, 1993, seconded by Ferring. Vote: all -aye. Motion carried. Public Hearios! and Determination of Vested Ri2hts for Sprin2s Land Kern outlined with the Board the Vested Rights Special Use Permit VR 93-02's Section A Findings of Fact. Hopkins asked for a clarification on #8 regarding the timing of the variance approved by the Winter Springs Board of Adjustment. Kern restated that the site plan approval was valid up to six months after the completion of the Florida Department of Transportation's (FOOT's) State Road 434 realignment. McLeod asked Kern ifhe knew when this realignment was planned, Kern answered that it is scheduled for 1997 - 1998. Ferring asked when the variance was granted by the Board of Adjustment, Kern answered that the date was April 2, 1992. Kern explained #12, that physical development of the property could not occur due to FDOT's roadway plans which require substantial portions of the property for the programmed improvement of State Road 434. It is the desire of the owner to proceed with physical development once FDOT's plans are finalized. Kern also explained # 13 regarding the deferring of development plans by FDOT recording a map of reservation which establishes a building setback line with a five (5) year moratorium on the issuance of development permits. Discussion ensued regarding the issue of a wet bottom pond versus dry bottom pond and its impact on the amount of space either would occupy on the property. Ferring and McLeod pointed out that the wet bottom pond would require less space than the dry bottom pond. Kern explained that the City Code specified dry bottom ponds to combat the problem of mosquitos, etc. He was informed by Leonard Kozlov, City Engineer, that dry bottom ponds were placed in the City Code with the knowledge that in some instances they were not feasible, therefore, variances could be granted through the Board of Adjustments. McLeod ask if the final engineering plans were available for review today, and Donald W. McIntosh, attorney, for the property owner, brought them forward to show the .Board. Kern explained the commercial layout of the proposed development. McLeod questioned McIntosh on the future plans due to the FDOT's right-of-way through the property. Kern reiterated that their plans for development would be coming before this Board prior to beginning of construction. McLeod pointed out to the Board that this project will no doubt be presented to this Board again with new plans but they must adhere to the same restrictions that were in place prior to the Comp Plan or any new LDRs being proposed. McIntosh reminded the Board that the property owner gave to the City part of his property to gain access to Central Winds Park without asking for any monetary compensation. Ferring made a motion to approve the Vested Rights Special Use Permit VR 93-02 for Springs Land, seconded by Brown. Vote: all- aye. Motion carried. Annual Elections of Officers Ferring recommended tabling this issue to the meeting next week, in hopes that the vacant seat would be filled.
