HomeMy WebLinkAbout1991 08 21 Planning and Zoning Board Regular Minutes ..-...- '" PLANNING AND ZONING BOARD MINUTES August 21, 1991 The meeting was called to order at 7:38 p.m. BOARD MEMBERS: David Hopkins, Chairman, Present David McLeod, Vice-Chairman, Present Grace Anne Glavin, Absent Martin Trencher, Present John Ferring, Present Approval of Minutes of Julv 17. 1991. Trencher moved to approve the minutes of July 17, 1991. Seconded by McLeod. Vote: All aye. Approval of Minutes of Julv 24. 1991. Trencher moved to approve the minutes of July 17, 1991. Seconded by McLeod. Hopkins made an ammendment to page five. Vote: All aye. Approval of Minutes of Julv 31. 1991. McLeod moved to approve the minutes of July 31, 1991. Seconded by Trencher. Vote: All aye. Annual Election of Officers to the Plannina and Zonina Board. Hopkins asked the Board for nominations for Chairman. Ferring nominated Hopkins. Trencher nominated McLeod. Trencher noted that these elections should be postponed till Glavin returns. Ferring made a motion to table the election. Seconded by Trencher. Vote: All aye. Hopkins opened the floor for discussions about the Tuscawilla rezoning issue. Nicholas Pope, an attorney with Lowndes, Drosdick, Doster, Kantor & Reed, representing the Winter Springs Development Joint Venture, addressed the Board. Pope has substantial experience with the PUD concept. He noted there seemed to be several areas of concern regarding the Tuscawilla PUD, namely the question of vested rights, the concept of a PUD, the presence of animosity between residents and commercial interests, and the discussion of the golf course project. The golf course discussion should not be directed toward the Joint Venture as its not their project. He maintained there is an existing development plan in place (with the PUD) and the developer does have vested rights with respect to this plan. Changes to the plan would require the consent of the Joint Venture. Brian Canin, a planning and landscape architect with Canin & Associates, invited by Nick Pope, discussed the concept of a PUD in terms of land planning, noting the various benefits of such a designation. Can in stated a PUD provides a more balanced community, including land use and traffic flow coordination and the quality-of-life benefits of mixed land uses within the PUD. Hopkins read to the public the memorandum from the City Attorney regarding the lawsuit between Florida Country Clubs and the City. The City Attorney reqested the Board, City staff, City Council members and members of any other City Board ~, ~ Planning and Zoning Board Minutes Month XX, 1991 Page 2 refrain discussing the PUD at this time. Donald Greer, President of Magnolia. Service corp., community builder for Georgetowne, distributed a letter to the Board stating any proposal to rezone Georgetowne be withdrawn. He stated neither the Georgetowne Homeowners Association nor he was contacted regarding a potential rezoning of the property. Moti Khemlani, President of the Tuscawilla Homeowners Association, reviewed his proposal for the rezoning of the PUD. He noted there were several slight modifications since the last presentation regarding the designations for Braewick, the churches, and Parcel 15. The Homeowners Board met and approved the recommendations, which were later ratified at the Homeowners meeting. Rae Lawrence, Greenbriar, complained about the small rear yard setbacks between homes, and stated if this was due to PUD definitions, it's a problem. She also stated that commercial development would cause problems for future land and home values.
