PLANNING AND ZONING BOARD WORKSHOP MINUTES
July 31, 1991
The meeting was called to order at 7:38 p.m.

Hopkins opened the floor to any residents who may have specific concerns
regarding the Tuscawilla rezoning issue. Charles McAlister, 1115 Wingfoot
Circle, stated all residents in attendance have concerns.
Moti Khemlani presented to the Board a series of tables and maps delineating the
individual units in Tuscawilla, noting minimum lot sizes, lot setbacks, number
of total lots per unit, and proposed zoning classifications. These tables and
maps are attached hereto. Khemlani noted that much of the data came from the
City. Khemlani took the requirements from the City's zoning table and applied
them to the units to come up with the proposed zoning. Glavin asked Khemlani
if the lot sizes shown were average or minimum sizes. Khemlani noted they were
minimum values.
Hopkins asked Koch what the City's parks are currently zoned. Koch replied
outside the PUD, there is no zoning for recreation. The new plan is proposing
a recreational classification. Parks were cut out of developments as they were
dedicated so property which was zoned residential now had parks dedicated to the
City. Hopkins noted that in the Comprehensive Plan, we are providing for a
recreation zoning classification. Koch said recreation is under the category
of an inset zone and is allowed in any zoning category, as far as public parks
are concerned.
Hopkins noted that during the development of the Comprehensive Land Plan, the
Board noted several inadequacies in the zoning classifications. A recommendation
was made that these classifications be reviewed and revised. At this time,
rezoning to classifications which are not adequate may not be the answer for the
Tuscawilla PUD.
Hopkins stated that a Public Meeting will be held August 21st. with a workshop
to follow, probably -on the 28th.
Trencher wanted Koch to take Khemlani' s map and overlay it on the map she
produced showing the remaining undeveloped areas. This would provide a "before
and after" view of the PUD.
McLeod asked Khemlani if the tables and maps were done by committee of residents
and the homeowner association board, or by a vote; what was the input of the
homeowners. Khemlani said the residents have been involved from day one in the
entire process. It really is the homeowners board's recommendation. The

proposed classifications will be presented to the residents at the next
homeowners meeting.
Glavin asked Khem1ani if the homeowners association was incorporated. Khemlani
responded is was incorporated. Glavin then asked if the bylaws had quorum
provisions. Khemlani noted that they changed the bylaws to eliminate the quorum
requirement so as not to penalize those residents who regularly attend meetings.
Glavin suggested Khemlani get a ratification of the homeowners association to
indicate the strength of the support for the proposals.
Lisa Miskinis, an independent consultant for Winter Springs Development Joint
Venture, stated she has been attending P & Z Board meetings regularly and attends
homeowner association meetings within Tuscawilla. She contended that the
developers have vested rights in the undeveloped properties within the PUD. They
have not submitted any plats for the City to review as the developers are
analyzing the entire PUD at this time. Glavin asked if it is the position of
the developers to not make any plans now or to discuss any of Khemlani' s
proposals. Miskinis replied it is unfortunate that there has not been a better
rapport between developer and homeowner, and the lack of a formal master
association hinders communication. The developer has plans to develop the rest
of the PUD but is not prepared to discuss giving up any rights until their plans
are more fully developed.
John Horan, Wood Duck Drive, stated the P & Z Board is an advisory unit and thus
should not be sensitive to political pressures. It doesn't matter what
percentage of the residents Khemlani represents, the issue is to provide planning
ideas for the residents of Winter Springs and, in this case, the residents of
Tuscawilla. He found it curious that the developer would come to a public
meeting and argue that you can't rezone because they have vested rights, knowing
vested rights are based on concrete plans submitted to the City then stating you
don't want to discuss such plans at this time. Further, the P & Z Board will
have to address the land use regulations next year and thus must be taken into
account.
McLeod recommended the Board members become familiar with the areas within the
PUD which are under consideration and review the code book to make sure you agree
with the recommendations. For the next workshop, the Board should be in
agreement with the proposed classifications for the units.
