Koch, Dir. Adm. / Compo Planning D. LeBlanc, Land Dev. Coordinator * Horan arrived at 8:15, after the regular meeting was adjourned. Approval of Minutes of Februarv 6. 1991: Trencher moved to approve the minutes of February 6, 1991. Seconded by Ferring. Vote: All aye. Motion passed for approval of minutes as recorded. Approval of Minutes of Februarv 13. 1991: Trencher moved to approve the minutes of February 13, 1991. Seconded by Ferring. Vote: All aye. Motion passed for approval of minutes as recorded. Approval of Minutes of Februarv 20. 1991: Trencher moved to approve the minutes of February 13, 1991. Discussion by McLeod: The minutes ended abruptly regarding the requirement for connection of sewer lines and potable water lines. He believes the tapes of the minutes should be reviewed and this portion appended. Trencher amended the motion to approve the minutes subject to this revision. Seconded by McLeod. Vote: All aye. Motion passed for approval of minutes with noted contingency. Request of Richard Kerns for home occupation approval to repair washers and drvers in zone R-1 (649 David street\. Hbpkins quoted from the City Code that a home occupation is allowed in R-1 provided no mechanical equipment shall be used on the premises except that which is normally used for purely domestic or household purposes. Kerns stated that his repair work requires only common hand tools. McLeod questioned the interpretation of the mechanical equipment stipulation of the Code, indicating the appliances to be repaired may themselves be considered such equipment. The Board questioned whether Kerns has received any complaints from nearby residents. Don LeBlanc of city staff noted that only one complaint has been logged by the Code Enforcement Board, that from a nearby laundromat. No complaints have been received from neighbors. Kerns agreed that he has received no formal or informal complaints from his neighbors. He noted that this business is a full time venture for him, but he only works in his garage two days a week - the rest of the time he repairs the appliances on site. Kerns noted that his operation is done within the confines of his garage, produces little traffic as he makes one or two trips daily in his pickup truck moving the appliances and he only has three to six appliances on the premises during a one week period. Trencher moved to allow Richard Kerns to operate his home occupation of repairing washers and dryers in his garage. Seconded by Ferring. Vote: Hopkins: aye; Trencher: aye; Ferring: no; McLeod: no. The motion is denied. Ferring noted that while he seconded the motion originally, he would like to see written comments from Kerns' neighbors regarding their opinions on his home occupation. The Board agreed with this request. Trencher amended his motion to allow Kerns to readmit his request to the Board after gathering documented statements from his neighbors regarding possible objections. Ferring Seconded. Vote: All aye. Motion to reexamine the issue of Kerns' home occupation upon receipt and review of neighbor's documented statements passed. WORKSHOP The regular meeting of the Planning And Zoning Board was adjourned at 8:05 and the Workshop addressing revisions of the Zoning Code to implement Conservation and Residential Land Use policies in the Comprehensive Plan was opened. Koch distributed to the Board several published studies on Affordable Housing, Community Residential Homes, Buffer Zones and Wetlands, and population estimates for April 1, 1991. Horan suggested the City look into retaining a Land Use Regulation consultant to draft the Zoning Code revisions necessitated by the changes called for in the Comprehensive Plan. Horan noted that the City of Ocoee has hired one for $15,000 to $20,000. Basically, they take our completed Comprehensive Plan and the ORC report from the DCA and rework our codes. The Land Use Regulations can then be adopted at the same time the Comprehensive Plan is adopted. Hopkins suggested this item be added to the agenda of the next meeting of the Board.
