Special Workshop
November 14, 1990
The meeting was called to order at 7:30 P.M.

Special Workshop on the Final Development Plan - Preliminary Engineering, Highland Lakes.
Hopkins said the Board has received copies of the information provided by Staff.
Hopkins asked LeBlanc to give a brief presentation. LeBlanc said this meeting is at
the request of the developer. The process for the developer prior to going to the
Commission, is the Staff Review and the Planning & Zoning Board.

Mr. Chancellor gave a synopsis of the actions that have been taken over the past year.
He explained the current plan. He said he understood that the City's portion of
Shepard Road would be constructed when th0 remaining properties were developed.
Hopkins said this is in direct conflict with the proposal that Chancellor submitted
last week. Chancellor said if the Planning & Zoning Board decides to forward the plan
that is before them tonight to the Commission, it is his understanding that the owner
of the property is willing to consider withdrawing his request in regard to the
solution of Shepard Road. He said the Board can submit a plan that shows Shepard Road
or one that deletes Shepard Road.
Koch said what is before this Board at the moment is whether this plan meets the City
Code. The Board is to look at the concept of the plan for Highland Lakes.
Hopkins asked that the public be allowed to give comments.
Mr. Warren Williams, 312 Wing Lane, Winter Park, spoke. He said he owns 17.26 acres
south of this property. He said he has a problem with the two applications pending,
in that he is at a loss to take any action regarding his land until he sees what the
results will be. He said he would like to see both of the applicants heard at the
same time by the Commission; otherwise, he is afraid that contradictory decisions
will be made, as the two applications are contradictory.
The developer's opposition to installing a 12 inch water line on Shepard Road was
discussed. Kozlov said if Shepard Road goes through, it will need to be a 12 inch
pipe. Kozlov said according to the recommendation of the Utility Manager, the pipe
to the north of this project had a twelve inch pipe in place, and if it does go
through to the south of Highlands Lake, it will need to be matching in size.

Chancellor said that subsequent development to the south needs to be served by City
facilities. McCleod said that Doug Taylor, the Utility Manager, said that with the
section of Shepard Road installed, the developer is required to install the 12 inch
water main in accordance with the City's Master Plan.
Hopkins asked about the existing gas line. Chancellor said it's a four inch line
which serves the Highalnds and the south. He said the responsibility to maintain
it is with the gas company. He said the City has an agreement with the gas company
saying that the gas company would relocate the gas line to the Shepard Road right-
of-way east of the City property. Chancellor said Florida Land Company would not
reach an agreement with the gas company in that the gas company proposed that the
Florida Land Company should pay not only for moving the gas line across their
property, but also across the City property and across Mr. William's property.
Hopkins asked whose responsibility it is to maintain the retention ponds. The
Highland Lakes Association will be responsible. Hopkins asked if this is infringing
on any of the 100 year Flood Plain. Kozlov said engineers have generally just looked
at the F.E.M.A. map, found the general location and noted the distance from it.
Hopkins asked Chancellor if he is opposed to adding the additional sized water main.
Chancellor said they question whether the 12 inch is appropriate or needed. Hopkins
asked about problems with the existing gas line. Chancellor said the gas line issue
will be resolved.
McLeod made a motion that we find the plans in compliance with the original PUD
Ordinance, and that they be passed on for acceptance with attachments but they must
comply with the additional recommendations of the staff. Torcaso seconded the motion
for discussion. Discussion. Roll Call: John Torcaso, aye; David McLeod, aye;
