Koch, Dir.Adm./Comp. Planning Approval of Minutes of July 19, 1989: Torcaso moved to approve the minutes of July 19, 1989. Seconded by McLeod. Vote: All aye. Motion carried. PUBLIC HEARING Small-Scale Amendment to Comprehensive Plan Land Use Element - Adopted Land Use Map Hopkins closed the Planning and Zoning meeting and opened the Land Planning Agency Public Hearing. SW Part of Lot 17, Blk. B, Mitchell Survey of Levy Grant, Plat Book 1, Page 5, 2.9 Acres at SW Corner of Lot 17 - North of Intersection of SR 434 and Brantley Avenue, North of Railroad - Add to Winter Springs Land Use Map at Light Industrial Classification (Zone C-2) (Reclassification from Seminole County Suburban Estates) : Koch stated that Mr. Kenneth McIntosh, representative for the estate of David M. Joyce, is present for the presentation. McIntosh presented to the Board a map of the property and also a copies of the application to D.O.T. and Seminole County for the right-of-way and construction on the road. McIntosh stated that previously when this item came before this Board there was concern among the surrounding residents about the use of Brantley Avenue and Orange Avenue. He stated that the owner does not intend to gain access to this parcel from Brantley and Orange Avenues, but will have access from Second Street and across Lot 23 to Lot 17. McIntosh stated that there is a question about the survey of the right-of-way of Second Street, which both he and the City are reviewing. Planning and Zoning Board Minutes July 26, 1989 Page 2 McIntosh stated that taking into consideration the property surrounding this parcel, it appears to the owner that the land use of conunercial light industrial, with zoning at C-2, is compatible. Koch asked at what point there will be access onto Second Street. McIntosh stated that it would be approximately 83 feet to the east of the south west corner of lot 23. Koch stated that the north right-of-way line along Lot 23 is under the jurisdiction of the City of Winter Springs, with the City having property on both sides of the street. She stated that everYthing on the south side of the road is in the Ci ty . Koch stated that the entire lot is under review simultaneously by the State for Rural Residential use as transmitted by the Commission. McLeod reviewed the permit from Seminole County and asked why it is to improve a driveway and not for road construction as was presented to this Board. He stated that in his opinion there is a discrepancy in this permit. McIntosh stated that it was presented to the County for road construction. McIntosh stated that when an application such as this is presented by a private entity it takes on the application as a driveway permit. Koch asked if the road would be opened to the public. McIntosh stated yes. McLeod asked about the road being paved to an existing paved road, which is a requirement by the City and Seminole County. McIntosh stated that he was not aware of this. There was discussion on the road. Hopkins asked if there was anyone present to speak for or against this request. Mr. Terry Hightly, George Hyde, Scott Wiseman, and Hugh Gary spoke against this request. Hopkins stated that the Board received four letters from residents surrounding this property and also one letter from the County speaking against this request. Hopkins read a letter from Walter and Sandra Gould, which was hand delivered to City Hall on July 26, 1989, speaking against the request. Planning and Zoning Board Minutes July 26, 1989 Page 3 Torcaso moved to disallow the request of this small-scale amendment to the Comprehensive Plan. Seconded by McLeod. Discussion. McLeod stated that he would like the motion amended to state that the denial of the request is based upon the letter from the County dated March 27, 1989, and the letters presented from the residents as part of the records to be attached to these minutes for reason of denial. Torcaso accepted this amendment to his motion. Vote: All aye. Motion carried. The meeting was adjourned at 8:40 P.M.
