MINUTES
March 29, 1989
The meeting was called to order at 7:30 P.M.

Approval of Minutes of March 22, 1989:
Torcaso moved to approve the minutes of March 22, 1989. Seconded by Hopkins.
Vote: All aye. Motion carried.
Saporito recessed the Planning and Zoning Board Meeting and opened the Public

Small-Scale Amendments to Comprehensive Plan
SW Part of Lot 17, Blk. B, Mitchell Survey of Levy Grant, Plat Book 1, Page 5,
2.85 Acres at SW Corner of Lot 17 - North of Intersection of SIt 434 and
Brantley Avenue, North of Railroad - Add to Winter Springs Land Use Map at
Light Industrial Classification (Zone C-2) (Reclassification from Seminole
County Suburban Estates) :
Saporito stated that the first item for the public hearing has been withdrawn
by the applicant, and is no longer pending before this Board. He stated that
when this application comes before the Board again, this will be advertised in
the newspaper.
Saporito read the letter of withdrawal for the people present in the audience
who were present for this item.

Acres Inunediately South of Intersection of SR 434 and Tuscawilla Road-
Reclassify Land Use to Liqht Industrial (Zone C-2):
Koch gave her presentation. She stated that this property is a 1.36 acre
parcel immediately to the south of the intersection of SR 434 and Tuscawilla
Road. The request is to change the land use to Light Industrial and the zoning
to C-2. It is ru:M zoned C-1. The applicant is interested in developing the
property with a gas station, small shop and car wash. In our Code, C-1 zoning
provides for a full-service gas station with mechanical repair, which this is
not. A convenience store with gas p\.'ll1q;>s is allowed in C-2 zoning.
Koch expressed concern that if the property were rezoned to C-2 it would be
possible then to develop it with other C-2 uses that would not be desirable in
this vicinity even though this particular proposed use may be. She stated that
there are two alternatives rather than rezoning to C-2; these are: 1} amend
the C-1 zoning to allew this type of operation; 2) make a determination that
this type of operation is not a convenience store and therefore prescribed in
neither C-1 nor C-2; therefore, the applicant can ask for a Special Exception
within C-1 zoning. Then the land use can remain unchanged - the less intense
commercial classification. Koch stated that the applicant is present for any
questions.
Frank Schrimsher, owner of the property, spoke for the request.
Saporito asked if anyone was present to speak for or against the request.
There was no one present to speak for or against this request.
Saporito closed the public hearing and reopened the Planning and Zoning Board
meeting.
Hopkins stated that in the list for allcwable uses under C-1 zoning, number 19
is a car wash, number 31 is a full service gas station requiring mechanical
repair, and number 33 is grocers/retail. He stated that everything that the
applicant wants is under C-l zoning except their combination with a snack shop.
He stated that he feels the best thing to do is to make a special exception or
to include this type of facility in the C-1 zoning allowable uses.
McLeod asked about the depth of the property. Schrimsher stated that the depth
on Tuscawilla Road side is 346.49 ft. McLeod stated that he wasn't sure if
this site was big enough for this. Schrimsher stated that the site met the
minimum site standards of the oil company.
KOch stated if this is approved, it will come up before Site Plan Review and
would have to meet all criteria before any developnent could start.

Sapori to stated that the issue before the Board is whether or not the Board
reconunends the zoning be changed. The problem is there is no classification
for this type of use. We have several choices; 1) reconunend that the code one
way or another be amended to provide for a classification, 2) change the zoning
classification, 3) made a determination that it does not fall in either C-1 or
C-2 zoning and the applicant can make an application for a Special Exception to
allCM this under the present zoning, and 4) make a recolIUllSndation to the
Canmission that the Commission reconsider to add this specific use under C-1
zoning.
Torcaso moved to reconunend denial of the request by the applicant for a change
of zoning and a finding be made that the use does not fall within either C-1 or
C-2 and the applicant is eligible for an application for a Special Exception.
Seconded by Hopkins.
Discussion on the motion.
Paul Earshot, representative for Mobil Oil, spoke on the request. He stated
that the major function for this project is gas. The snack shop is more of
impulse i terns such as cigarettes, candy, soft drinks, potato chips. The size
of the snack shop is approximately 985 s. ft., with an office, rest room, small
storage area, and a security desk, which leaves approximately about 500 s. ft.
for display of these i terns for sale. He stated that everything is under a
roof, even the gas pumps, the car wash is built off to the side and not
attached.
Vote on the motion: All aye. Motion carried.
Saporito asked if there was any other business to cane before the Board.
Hopkins asked that it be put on the agenda for the next meeting to recolIUllSnd
changing the C-1 zoning to allow a gas station/car wash/snack shop.
Saporito asked if Staff could assist the Board with information as to a name to
classify for this type of business. The Board was in agreement.
The meeting was adjourned at 8:05 P.M.
