PLANNING AND ZONING BOARD MINUTES
November 23, 1988
The meeting was called to order at 7:30 P.M.

Approval of Minutes of November 9, 1988:
Torcaso moved to approve the minutes of November 9, 1988.
Saporito. Vote: All aye. Motion carried.

Parcel 90 (Stable/Pasture) - Preliminary Enqineering/Final Development Plan:
leBlanc gave his presentation. He stated that the Staff has reviewed this and
has found that it meets all the Code requirements. There is one stipulation
and that is if the County needs more than 8 feet of right-of way that the
developer has left for this along Tuscawilla Road, then this project will be
null and void. He stated that the Board has received a letter stating this.
leBlanc stated that Brian Austin, P.E., Donald W. McIntosh Associates, engineer
of record is here to speak for the developer.
Austin stated that this is a 38 lot, single family addition to the Tuscawilla
POD. The streets will be public streets. He stated that they have ver1:a1
advice fran the County on the R-O-W, that the 8 foot the developer has set
aside has been agreed to, they will get sanething in writing stating this.
He stated that this is consistent with the rest of Tuscawilla.
Dorman stated for the people in the audience that this developnent will have an
entrance on Tuscawilla Road. There will be a looPed shaPed road through the
project.
Hopkins asked about the delay with the WI'i tten agreanent from the County for
the 8 foot right-of-way. Austin stated that it was administrative.
Sapori to asked if the developer has given any thought to hew the traffic from
this project will impact Tuscawilla Road. Austin stated that there will be an
estimated 380 trips a day. He stated that they have discussed this with
Seminole County and have discussed the intersection improvements that will be
necessary and that the County does not see a problem with this.
Saporito asked if there was any indication as to when the road would be
widened. Koch stated that Seminole County has it scheduled for the year 2003.
Dorman asked if the 50 I R-Q-W on the east side and a 56 I R-O-W on the west side
of the road is adequate for a four lane road. Austin stated that this is more
than sufficient for a four lane road.

Dorman also asked about lot 1, which has more than one-third of the land on the
};XMer easement and the haneowner will be p:l.ying taxes on property he cannot
build on. Austin stated that the homeamer can use it as a driveway/side entry
but cannot build anything on that portion of the property.
Dorman asked about the 6 I fence that will be build later to buffer the lots
bordering Tuscawilla Road. Austin stated that this will be a 6' masonry wall.
Dorman asked if this will be sufficient with a 4 lane road to provide the
visual and aural buffering that is needed to keep the traffic nuisance down.
Austin stated yes it will be. Dorman asked about a buffer bebam this
property and St. Stephens Church. Austin stated that the developer will get
wi th the Church to cane up with a buffer that the Church will agree upon and
this will cane in with the final engineering designs.
Dorman asked if the Homeamer I s Association will have to maintain the Tract C
retention pond. Austin stated yes. Koch stated that the haneowners w:Juld
maintain the grass area around the pond in Tract C.
Hopkins asked about the Staff agreeing on one entrance with respect to
emergency access. LeBlanc stated that the Staff had no problem in that there
will be tw:J lanes out and one lane in at the entrance way. Hopkins asked if
there is any recreation area planned for this project, he stated that the
Comprehensive Plan states that the developers are to provide adequate
recreation facilities for a new development. LeBlanc stated that this project
will use the recreation facilities that exist in the Tuscawilla PUD. Hopkins
asked heM the homeamers in this project will get to the recreation areas in
Tuscawilla if there is only one entrance which is on Tuscawilla Road.
There was discussion on the request.
Torcaso moved to recamnend approval of Parcel 90, Preliminary Engineering/Final
Development Plan to the City Conunission. Seconded by Saporito. Dorman made a
camnent that in 1987 a new PUD Ordinance came into effect. He stated that a
question has arisen that when there has been a change in land use in a
previously approved PUD, which Ordinance applies. He stated his interpretation
is that the new PUD Ordinance should apply in such cases. In the new ordinance
Section 44.85.4. p:l.r.4.g requires that any house along the perimeter of a PUD
should have a 35 I setback and in this plan it has a 25' set back; and in
addi tion this plan does not comply with Part B Section 44.85.7, Pars. 3., 7.,
9.h., and 13.a. He stated that it may be that he will be over ruled by the
Ci ty Camnission but he stated that he feels that the new POD Ordinance should
apply.

Project 434 Partnership - Preliminary Engineering:
LeBlanc gave his presentation. He stated that the Staff has reviewed this
project and the Board has a copy of the minutes fran that meeting. He stated
that there is one i tern not listed and that is for the public I s safety and
~lfare, the Police Chief and Fire Chief and the rest of the Staff recoJJUllends
that when the Phase that abuts Alton Road is developed the road be opened and
the same apply to the phase by Trotw::xxi Boulevard. Also before final
engineering approval that the developer get the necessary permits fran the
Department of Envirornnental Regulation and the St. John I s Water Management
District before this project goes before the Commission for final engineering.
LeBlanc stated that Allen Keen, developer of the project, and Donald McIntosh,
engineer for the project ~re present. Donna McIntosh, attorney for the
developer, was also present, along with Turgut Dervish, traffic engineer for
the developer.
Ms. McIntosh stated that in an effort to alert all concerned citizens of Winter
Springs, the developer delivered fliers and placed an ad in the Seminole
Sentinel alerting the citizens of this meeting tonight.
Donald McIntosh, engineer for the developer, stated that this property had been
rezoned to R-1A in April of 1988. He stated that this property is 400 acres,
east of the Ranchlands, south of SR 434, ~st of Tuscawilla, and north of Oak
Forest and lands owned by the City of Winter Springs presently used for
effluent disposal. The property contains conservation areas which have been
reviewed in great detail by the Staff of the St. John I s Water Management
District, the Army Corps of Engineers and Florida Department of Envirornnental
Regulation for the purpose of identifying the property sui table for
developnent. The only crossing that is proposed in the 100 Flood Plain is a
bridge which will have no negative impict on the creek.
McIntosh stated that the primary access to the project will be fran SR 434 with
a potential access fran Alton Road and with a collector road to the south, and
access via a proposed extension to Trotw::xxi Boulevard to the south, where there
is an existing stub. He stated that this was based on Staff input. The
developer will dedicate a R-Q-W for Bahama Road. Over 200 acres will be
dedicated to the City. There will be a mandatory Haneowner I s Association to
maintain the stormwater management facility.
McIntosh stated that there will be tw:> exiting lanes and one entrance lane into
the project fran SR 434. There will be a left hand ~t bound turn lane,
wi thin the R-Q-W on SR 434. There will be underdrains throughout the project.
The developer has provided the City with tw:> traffic studies which have been
reviewed with the City Staff. The conclusion from one study is that this
project will not have a negative impact.

The second study was fran Tipton Associates, which is the City's traffic
consul tant , and the study stated that the proposed project is a responsible
project as in relation to the traffic flew. TIle developer has agreed to fund a
traff ic signal and any studies pertaining to this.
McIntosh stated that the developer wants to assure the Board that they are
willing to provide the access roads to Al ton Road and Trotwood Boulevard if
necessary .
McIntosh stated that back in April the developer conuni tted to abide by and
accommodate the following: Dedicate 20 acre park, limit to 400 units,
canpliance with the City I S Code and Ordinances, dedication of a R-Q-W for
Bahama Road, contribute $25,000 to park facilities, improve project entry with
two outbound lanes and one inbound lane, pay $500 per unit to schools in Winter
Springs, and at Staff's request design a north-south collector road through
this development.
Koch asked the developer about a timetable for this project. McIntosh stated
that the site will be developed fran the north. TIle developer plans to begin
the project in the sununer of 1989, and plans to build 75 units annually and
plans for build-out in 1995, this is just a projection.
Koch asked if the collector road will be completed in Phase I. McIntosh stated
that the road will be done with each Phase.
Koch described for the audience the process by which the City will decide what
roads to connect, when to connect them, what new roads will be built and hew
these will be funded. There is a large undeveloped area in the middle of the
City. One thing ~ are looking at is how to tie the City together for fire
safety and rescue service and to make the City more cohesive. Right IlOW SR 434
is only a two lane road. At this time it is not scheduled for widening until
around 1992-93. There is no other p3.ved connection between the two halves of
the City. If there is an accident on SR 434 blocking traffic, a rescue vehicle
has to go dcwn to Lake Drive and Seminola Boulevard to get to the other side of
the City. Decisions on creating through streets in the central area will be
made by the Camnission after thorough study of the best traffic plan for the
City.
Dorman stated that the Board is here tonight to recamnend approval or
disapproval of the preliminary engineering on this project and that is the only
issue facing this Board tonight. He also stated that connector roads was not
an issue tonight but will be considered at a later date when the City's traffic
studies are canpleted.
Dorman stated that this is not a public hearing but if there is anyone present
who would like to speak on this project they are welcane.
John Ferring, President of the Oak Forest Homecwner's Association, spoke
against the connector road onto Trotwood Boulevard.

Car 1 Stephens, Chairman of the Ranchlands HOrne<:MIler I s Association, spoke
against the right-of-way for Bahama Road. He stated that Mr. Keen has stated
that it wasn I t necessary for this project.
Kathy Nucci, Dorma Eater, Charles Centron, Scott Kline, Tom Ferrell, Spencer
Harris, Dennis Burshwood, Al Davis, Neil Trautman, spoke on the project. They
spoke against connecting roads to TrotWJOd, Bahama and Alton Roads.
Dorman again noted to the public that the issue before the Board tonight is to
recommend approval or disapproval of the preliminary engineering for this
project.
Ferring stated that the Haneowner I s Association is stating on record that they
are in protest of this meeting if this is approved. He stated that the
developer has noted that the collector road through Trotwood Boulevard is not
necessary and it is the City Staff I s recommendation for the collector road. He
stated that it should not be needed for fire and rescue needs.
Koch stated that in the City's Canprehensive Plan which was adopted in 1982,
requires a collector road beb.een this property and property on the other end
of town, which is now Oak Forest.

connect to TrotWJOd. McIntosh stated that these lots will be more expensive to
build but this plan has the R-O-W stub that is planned to open onto Trotwood
Boulevard. He stated that it is a priority of the City to have this connector,
and the plan for Oak Forest has a R-Q-W stub.
Keen stated that these lots could be serviced without connection onto Trotwood.
Saporito asked about the temporary cul-de-sac on Bahama Road. McIntosh stated
that this is an issue that needs to be W'Jrked out with the City, that they are
only trying to accamnodate the City.
Saporito stated that he carmot believe the City can justify these connector
roads .
Dorman stated that if we approve the preliminary engineering plan as presented
that we are in effect also approving the Trotwood connection.
Further discussion brought out that the connector was not necessary for access
to all lots, and that we could approve the plan without the TrotWJOd
connection.
Koch reiterated that a connector road is in the previously approved
Canprehensive Plan. She stated that the connection is shown on this plan and
on the plan for Oak Forest Phase II, is a requirement of the City's
Corrprehensive Plan that was adopted in 1982 which states that no plan will

be approved for developnent on either of those properties that doesn I t provide
that connection. The only way that this connector road can be removed is by an
amendment to the Canprehensive Plan. The removal of this connector road carmot
be done by a regular vote by the Camnission. This would have to be done by a
spec if ic amendment procedure that is gone through for any land use amendment.
Dorman recessed the meeting to discuss the motion with City Attorney Lang.
Dorman reconvened the meeting.
Saporito moved to recamnend approval of the preliminary engineering plan of the
434 Partnership wi th the follcwing recormnendations: 1) reconunend that the
Trotw:xxi Boulevard connection be deleted from the City's Canprehensive Plan,
and 2) reccmnend that only lots 394 thru 400 be granted outlets onto Trotwood
Boulevard. Seconded by Torcaso. Vote: All aye. M:>tion carried.
Dorman asked if there were any other matters to come before this Board.
LeBlanc asked if there could be a special meeting on December 7, 1988, so the
Board could approve the minutes of this meeting so these i terns can go before
the Camnission at their December 12, 1988, meeting. The Board was in agreement
to this.
The meeting was adjourned at 10:15 P.M.
