REQUEST: The Parks and Recreation Department wishes to inform the City Commission about
Senior Center Membership benefits and Guest Fees, and Senior Center Rules and
Regulations and give the Commission an opportunity to provide comments.
PURPOSE: The purpose of this item is to inform the City Commission about Senior Center
Membership benefits and Guest Fees, and Senior Center Rules and Regulations and
give the Commission an opportunity to provide comments..
CONSIDERATIONS:
• Senior Center Rules and Regulations are attached.
• The City Commission at the December 8, 2008, Commission Meeting approved increasing fees
to be paid by individuals or groups for use of city facilities and Program participation.
• The new increased fees were implemented January 1, 2009.
• The City Commission at the January 12, 2009, Commission Meeting directed staff to provide
detailed information regarding Senior Center Membership benefits and Guest Fees.
• The Winter Springs Senior Center is a very unique and outstanding senior facility. Membership
includes many benefits and opportunities to participate in a variety of activities including:
Jazzercise; Computer classes, Card Playing, Tai Chi, Dancing classes, Bingo, Billiards, lunches,
AARP Medicare and Driving classes, and monthly day trips. The seniors also receive personal
help in any area from Senior Center Manager, Susie Coffman.
• Activities that require an additional fee to participate include:
o Lunches - $5
o Yoga - $1
o Line Dancing - $1
o Bingo - $5.50, $8.50, and $16 packages
o AARP Driving Class - $10
o Monthly Trips (cost varies)
The Guest Fee to attend the Senior Center or Therapy Pool is $10. This fee must be paid each
time a guest visits the center or pool.
Parks and Recreation 2008/2009 Athletic budget, Splash Playground, and Senior Center
budgets were approved with the intent of increasing fees to cover more of the operational costs.
The fees are in line with other Agencies (The YMCA Center for Health and Wellness in Oviedo
has the following policy regarding guests - 1 time for free and after that $10.00 per visit).

• The Parks and Recreation Department has a scholarship program for any resident who is needy
and cannot afford to participate in a program or use a facility. Scholarship dollars are budgeted
each year and also private individuals and organizations donate funding for scholarships.

None Required.
RECOMMENDATIONS:
It is recommended that the City Commission review Senior Center Membership benefits and Guest
Fees, and Senior Center Rules and Regulations and provide comments.

Requesting Commission Direction Relative To The Use Of The Senior Citizen
Center For Political Activities.
Manager McLemore introduced this Agenda Item and stated, "My feeling was that you
review this issue, if you want to make any changes and direct us to review this - it is a
good time for us to look at them and see if we want to make any rules, changes -other
set of rules, give some direction, and that we bring back finally a set of rules for you for
adoption by Resolution."
Discussion ensued on recent political events held at the Senior Citizens Center; whether
fees should be charged; and whether the Civic Center and/or the Senior Citizens Center
should be available for political events.
Commissioner Martinez spoke for the record about an event held on August 1St and
related rules and regulations. Commissioner Blake stated, "This situation here, I
absolutely think that this group should have to pay to rent the facility. It does not qualify
under what really doesn't appear to be a rule at all but just something that was written on
a study some fifteen (15) years or so ago, ten (10) years ago, by an employee who is long
gone. So I think we probably need to review these things."

Commissioner McLeod stated, "I do believe there should have been a fee charged. I do
believe probably a different method should have been gone about to secure the premises
for whatever that is." Commissioner McLeod suggested that "The Manager come forth
with a Resolution that gives us guidance as to how that Center will be used."
Commissioner McLeod stated further, "I think Mr. McLemore, you just need to bring this
thing back to us with the procedure that needs to be put in place -how this thing is going
to be operated, and the fee structure of how it is going to be feed, and make it a
Resolution and we no longer have a problem."
Deputy Mayor Gennell inquired about proof of insurance and asked if "The Ordinance
that we are in the process of passing right now about soliciting, the luncheons that
Commissioner Blake mentioned and which I have raised here in the past myself, every
one of those presentations is solicitation. Are those people going to the Senior Center
with a captive audience at large, going to be subject to our Solicitation Ordinance? You
can just think about it and bring it back to us Anthony [Garganese]."
Commissioner Martinez spoke for the record about a previous political event and added,
"The record will show that these rules do exist and they are in place to protect not only
the City but the Senior Citizens Center." Commissioner Martinez added, "There was a
clear violation here, an abuse of power and I am asking the Commission to make sure
that this does not occur again."
Commissioner Miller said, "If the City Manager will bring this Item back to us with some
clear guidance as to what the future rules and regulations governing the use of that
facility would be - I think that will probably put this issue to rest."

Discussion ensued on whether there should be a rate for Non-Senior activities.
Commissioner Martinez asked about the status of a previously requested document for
the Senior Center. Furthermore, Commissioner Martinez stated, "I am requesting some
rules for that building."

As stated earlier under "Public Input", Mayor Bush stated that regarding Informational
Agenda Item `303' - "Why don't we pull this one off the Agenda so we can discuss it."

Providing Information Requested By The City Commission Regarding The Civic
And Senior Center Rules And Regulations.
Commissioner Miller stated, "If need be, I think maybe we should instruct the City
Manager to send a letter to the Senior Citizens Center which would be posted there on the
board publicly that it is not the intention of these regulations to increase the dues."
Commissioner Miller added, "I thought the impact on this would be outside organizations
coming to use the Senior Citizens Center -they would be asked to bear the cost of their
functions."
Mr. Chuck Pula, Parks and Recreation Department Director agreed that this Agenda Item
addresses "Non-Senior use, during non-Senior hours."
Discussion.
Ms. Susie Coffman, Manager of the Senior Center also spoke on this Agenda Item.
Commissioner Miller then said to Ms. Coffman, "If you would keep us informed - if you
hear these rumors going around, please let somebody up here know."
With further brief discussion, Mr. Pula added, I will present it to the Seniors again and
make sure they get a copy."

Regular Meeting
The Parks and Recreation Department is requesting that the City
Commission approve the Senior Center Rules and Regulations and
Resolution No. 2004 -15, which establishes fees and charges for non-
senior use at the Senior Center.
PURPOSE:
The purpose of this item is to receive Commission approval for Senior
Rules and Regulations and Resolution No. 2004-15
CONSIDERATIONS:
. The City Commission at the March 22,2004 meeting requested information regarding
the
rules and regulations of the Senior Center and Civic Center.
. On October 27,2003, The City Commission approved Resolution No. 2003-43
establishing the fees to be paid by individuals or organizations for the use of the Civic
Center located at Sunshine Park; providing for repeal of prior inconsistent resolutions,
severability, and an effective date.
. The Senior Center has operated under departmental rules and regulations that were
established in 1995.
. The Senior Center currently does not have a resolution establishing fees for its use.
. Staff prepared an updated senior rules and regulations and a draft for resolution. These
were discussed at the April 12, 2004 Commission Meeting.
. Staff addressed senior's concerns by distributing copies of the revised Rules and
Regulations and Fee Resolution to the seniors and spoke again to them at their luncheon
meeting.

SENIOR CENTER RULES AND REGULATIONS
400 North Edgemon Avenue
Winter Springs, Florida 23708
The Senior Center located at 400 North Edgemon Avenue, within Sunshine Park, is a
public; City of Winter Springs owned and managed facility. The Center was constructed
and developed for the purpose and use in providing Senior Services to the Senior
Citizenry of the City of Winter Springs. The facility is programmed and scheduled by the
Parks and Recreation Department and through cooperative senior programming with
Senior, Civic, and Educational Institutions and Organizations. Senior programs and use
are first priority when considering facility scheduling and operation hours.
During non-operational hours the center may be offered for scheduling by any individual,
group or association legally wishing to obtain "exclusive use" of the center. The center
will only be made available for non-senior use during non-operational hours and when
the Civic Center has been previously scheduled or rented during the requested use hours.
1. SENIOR STATUS:
In order to be recognized as a "senior participant" you must be Fifty-Five (55)
years of age.
2. SENIOR PARTICIPANT:
Only senior participants and invited guests may partake in the senior programs,
activities, and events offered during the Senior Center operational hours.
3. OPERATIONAL HOURS:
Normally the Center operational hours will be from 8:OOam until 5:00 pm, plus
special events and evening program hours. Operational hours are
scheduled on "Program/Participant" needs basis and are subject to change by
management.
4. SCHEDULING:
All activities, special events, dinners, programs, and .any and all other facility uses
are scheduled and confirmed through the office of the Senior Center
Manager located on site.
5. CENTER REGISTRATION CARD:
All Senior Center participants will obtain, complete, and submit for filing a Senior
The card will serve as a record of information in the event of an emergency, such
as injury or patron incapacitation occurs. One time visiting guests will not be
requested to complete a registration card.
6. NON-SENIOR USES:
Resolution Number 2004- adopted by the City of Winter Springs establishes fees
to be paid by individuals or organizations for the use of the Senior Center located
at Sunshine Park.
The Senior Center Rental fee is
. $ 60.00 per hour or$ 350.00 per 8 hour rental
. Fees are included for set up/break down time.
. All rentals are based on a 2 hour minimum.
. $ 200.00 deposit ($ 100.00 of amount is refundable if cancelled).
The Senior Center will only be made available for non-senior use during non-
operational hours and when the Civic Center has been previously
scheduled/rented during the requested hours.
The facility rental fees do not apply to those organizations that have entered into
Recreational Program Agreements with the City. Those agreements provide for
financial compensation to the City.
7. INSURANCE CERTIFICATES:
Must list the City of Winter Springs as an additional insured and should be mailed
to the City of Winter Springs Parks and Recreation Department by the insuring
company.
STAFF ASSIGNMENTS:
A Parks and Recreation employee will always be present at the facility when
open. Staff employees are on site for the purpose of maintaining and supervising
the facility and the activities being conducted on or in the premises of the center.
9. SMOKING:
.All City of Winter Springs facilities are designated "non-smoking" facilities. As
a courtesy to others, smoking is restricted to the exterior of the facilities.
10. ALCOHOLIC BEVERAGE:
It shall be unlawful for any person or group to purchase, sell or offer for sale,
have in his/her possession or consume any alcoholic beverages as defined by the
laws ofthe state of Florida, in or on any park, playground, or recreation area,
their public parking lots within the corporate limits ofthe City except as follows:
The sale, possession and consumption, serving of alcoholic beverages shall be
permitted when specifically requested in writing and authorized by the City
Manager under such terms and conditions as he/she may impose for the protection
ofthe health, safety, and welfare ofthe public. This also requires assignment of
an off duty police officer. An alcoholic beverage waiver is available for this
purpose.
11. STORAGE:
No storage of any type or form is provided at the facility for use. Refrigerator is
available during use hours only and all items placed in the refrigerator or carried
into the facility during use hours are to be removed prior to vacating the premises.
12. FACILITY ENTRANCE KEYS:
Only Parks and Recreation Department Employees will be issued entrance keys to
the facility.
13. PARKING:
Parking is provided on site for facility guests utilizing the facilities and its
amenities. Use the specified marked parking spaces as provided. In the event that
the parking area is filled to capacity, do not park, or allow your guests to park
along the entrance/exit driveway. This is necessary to provide access for
emergency vehicles.
14. WALLS CEILINGS, EQUIPMENT:
Facility guests are requested to refrain from using thumb tacks, glue, tape, or
Staples, to attach anything to the facility during their use. The use of easels is
recommended for displaying of items in the facility.
15. TELEPHONE USE:
Telephones are located in the following areas:
Lobby/Reception
Kitchen
Card/Classroom
Managers Office
Manager's office phone is for City of Winter Springs business only; please do not
request use. of this phone. No long distance calls can be placed from the Center
telephones.
16. BULLETIN BOARDS AND PUBLIC DISPLAY: All bulletin boards and
display areas are provided for placing of public and employee notices. Any item
or notice appearing on these areas of display must first be reviewed and approved
(Initiated and dated) by the Senior Center Manager. The Manager will be
responsible for the placement of approved notice items.

RESOLUTION NUMBER 2004-15
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
ESTABLISHING THE FEES TO BE PAID BY INDIVIDUALS OR
ORGANIZATIONS FOR THE USE OF THE SENIOR CENTER LOCATED AT
SUNSHINE PARK.
WHEREAS, the City Commission of the City of Winter Springs, Florida,
has found it necessary to periodically review and establish fee schedules pertaining to
activities and facilities within the City.
WHEREAS, the City Commission of the City of Winter Springs, Florida has adopted
Resolution
Number 2003-43 establishing fees and charges for the Civic Center and the Senior Center
has operated under departmental rules and regulations.
WHEREAS, the City Commission of the City of Winter Springs, Florida has determined
that during non-operating hours the Senior Center may be offered for scheduling by any
individual, group, or association legally wishing to obtain "Exclusive Use" of the Center.
The Senior Center will only be made available for non-senior use during non-operational
hours and when the Civic Center has been previously scheduled or rented during the
requested use hours.
WHEREAS, the City Commission of the City of Winter Springs, Florida, has determined
that it needs to implement a fee schedule for the Senior Center.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA THAT:
SECTION I: The following fee schedule pertaining to activities and facilities is

Increasing Fees And Establishing New Fees To Be Paid By Individuals Or Groups
For Use Of City Facilities And Program Participation.
Mr. Chuck Pula, Director, Parks and Recreation Department presented this Agenda Item.

Mayor Bush said, "I think the Commission has brought up, number one, I think there's at
least a Consensus that non-City residents on those activities, where it makes sense to
collect it, such as in organized sports." Mayor Bush then stated, "I think raising the cost
for the non-residents - I get the sense that is okay with everybody, and it is easy to collect
- you collect it one (1) time."
Discussion.
Mr. Pula said, "We are concerned about the Senior Members that can't -afford the Fee. I
have talked with the Senior Board. Discussions have been going on for quite a while. I
spoke to their entire membership regarding this and -the perspective Fees coming and
scholarships and how important that was to cover Seniors who absolutely couldn't afford
- to pay these Fees. We do have a scholarship program in our -Recreation Budget that -
is available to be used across the board."
Regarding donations, Commissioner Joanne M. Krebs said, "I too, will donate to a fund
that would help aSenior - I know how important that is to them."

"I MOVE THAT WE ACCEPT THE FEE PROPOSAL FOR `YOUTH SPORTS'
AS PROPOSED IN THIS DOCUMENT." MOTION BY DEPUTY MAYOR

[dollars] ($400.00). That's an error right there." Mr. Pula added, "That's an error on the
PowerPoint."
On the next item, Mr. Pula explained, "This is for Field Rentals of the Facilities."
Mayor Bush said, "I think the non-resident Fee should be higher here, personally..."
Commissioner Krebs said, "...Yes..." Mayor Bush added, "So, if you make a Motion on
that, you add in what he would have added to the resident and to tack it on to the non-
resident."

Commissioner Donald A. Gilmore said, "Your terminology is `Fee increase' when in
fact, it is not a `Fee increase', it is the new rate. When you say `Fee increase' you are
taking the Fee, that number and adding it to the previous Fee. So, change that on your

non-resident?" Commissioner Miller said, "In other words, no differentiation in your
income."

support that." Mayor Bush then said, "Ten dollars ($10.00) for resident, forty dollars
($40.00) for the non-resident for the Senior Center. For the Therapy Pool, twenty dollars

City Facilities And Program Participation.
With discussion, Commissioner McGinnis spoke of scholarship funds and said to Mr.
Chuck Pula, Director, Parks and Recreation Department, "There is money in the
scholarship fund and that you are going to inform everyone that that money is available.
Is that correct?" Mr. Pula responded, "That is correct." Commissioner McGinnis also
asked that feedback on this be provided to the City Commission.
Further discussion.
Commissioner McGinnis spoke for the Record about regretting that the Fees had to be
raised; and asked for an update if attendance goes down. With further discussion,
Commissioner McGinnis suggested that Mr. Pula personally assist with any incomplete
Applications that are received.

REQUEST: The Parks and Recreation Department is requesting that the City Commission
approve Resolution # 2007-51, Increasing Fees and Establishing New Fees to be
paid by Individuals or Groups for use of City Facilities and Program Participation.
PURPOSE: The purpose of this item is to receive Commission approval for Resolution
# 2007-51 which establishes new fees and charges for use of City
Facilities and Program Participation.
CONSIDERATIONS:
• The cost to provide Parks and Recreation Programs and Facilities has increased and
continues to increase for supervision, utilities, and maintenance.
• The amount of General Fund Dollars available to provide Parks and Recreation Funding
may be less in the near future.
• Most fees and charges that have been charged for most Parks and Recreation Programs
and Facilities have not been increased in 2-6 years.
• No fees have been previously charged for use of the Senior Center, Splash Playground, or
Dog Park these activities have Cost Center Budgets: Senior Therapy Pool $ 40,058,
Splash Playground $34,972, and Hound Ground $ 142,777 ($ 17,777 operations +
$ 125,000 Capital).
• The proposed fees are in line with other Governmental Agencies.
• Parks and Recreation collection of the proposed fees can be done without hiring
additional staffing.
• The total of all proposed fees should generate projected revenue of $ 65,150 per year.
• Parks and Recreation also recommends an Implementation Schedule beginning January l ,
2008. This allows the department the opportunity to notify users of coming fees and
increases.
• Winter Springs Parks and Recreation Proposed Fee Increases & New Fees Chart is
attached.

RECOMMENDATIONS:
The Parks and Recreation Department recommends approval of Resolution 2007-51 Establishing
New Fees and Charges for use of City Facilities and Program Participation.
IMPLEMENTATION SCHEDULE:
January 1, 2008.

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA, AMENDING AND
REVISING ITS SCHEDULE OF FEES FOR VARIOUS
PARKS AND RECREATION FACILITY USES, ACTIVITIES
AND LABOR SERVICES; PROVIDING FOR REPEAL OF
PRIOR INCONSISTENT RESOLUTIONS; SEVERABILITY
AND AN EFFECTIVE DATE.
WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the
State Constitution, to exercise any power for municipal purposes, except when expressly
prohibited by law; and
WHEREAS, the City Commission has, the authority to establish fees pursuant to section
166.201, Florida Statutes; and
WHEREAS, the City Commission finds it necessary to periodically review its fee
schedules pertaining to activities, facility use and labor services within the City; and
WHEREAS, the City Commission desires to revise and amend certain fees as set forth in
this Resolution; and
WHEREAS, the City Commission of the City of Winter Springs finds that this Resolution
is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are deemed true and correct and are hereby fully
incorporated herein by this reference.
Section 2. Fees Established. The City Commission hereby adopts the fee schedule set forth
in Exhibit "A," attached hereto and fully incorporated herein by this reference. The fees set
forth in Exhibit "A" shall be effective January 1, 2008.
Section 3. Repeal of Prior Inconsistent Resolutions. All prior inconsistent resolutions adopted
by the City Commission, or parts of prior resolutions in conflict herewith, are hereby repealed to the
extent of the conflict.
Section 4. Severability. If any section, subsection, sentence, clause; please, word, or portion

of this resolution is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portion hereto.

REQUEST: The Parks and Recreation Department is requesting that the City Commission
approve new fees for the Splash Playground and Senior Center through Resolution
# 2007-51 which establishes new fees to be paid by individuals for use of city
facilities.
PURPOSE: The purpose of this item is to receive commission approval for new fees
for use of the Splash Playground and Senior Center Therapy Pool through
Resolution # 2007-51 which establishes new fees to be paid by individuals
for use of city facilities.
CONSIDERATIONS:
• The City Commission at the November 13, 2007, Special Meeting approved increasing
fees to be paid by individuals or groups for use of city facilities and Program participation
for Youth Sports, Sports Camps, Adult Sports, Field Rentals, Civic Center Programs,
Recreational Camps, Pavilion Rentals, and Civic Center Rentals.
• At that meeting the City Commission directed staff to contact the CDBG office regarding:
1. Not charging County Residents for the use of the Splash Playground and charging out
of County Residents.
2, Establishing an income scale for new fees for the Senior Center and Therapy Pool.

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA, AMENDING AND
REVISING ITS SCHEDULE OF FEES FOR VARIOUS
PARKS AND RECREATION FACILITY USES, ACTIVITIES
AND LABOR SERVICES; PROVIDING FOR REPEAL OF
PRIOR INCONSISTENT RESOLUTIONS; SEVERABILITY
AND AN EFFECTIVE DATE.
WHEREAS, the City is granted the authority, under Section 2(b), Article VIII, of the State
Constitution, to exercise any power for municipal purposes, except when expressly prohibited by
law; and
WHEREAS, the City Commission has the authority to establish fees pursuant to section
166.201, Florida Statutes; and
WHEREAS, the City Commission finds it necessary to periodically review its fee
schedules pertaining to activities, facility use and labor services within the City; and
WHEREAS, the City Commission desires to revise and amend certain fees as set forth in
this Resolution; and
WHEREAS, the City Commission of the City of Winter Springs finds that this Resolution
