The meeting was called to order by Vice-Chairman Dorman at 7:35 P.l1.

Approval of Minutes of September 24, 1986:
Joshi moved to approve the minutes of September 24, 1986. Seconded by DeFazio.
Vote: DeFazio: aye; Dorman: aye; Joshi: aye; Hartman: aye; Smedley: absent.
Motion carried.
Request of Dittmer Properties, Inc. to Annex the West 100 feet of the East 300 feet
of Lots 17 and 18, Spring Hammock Replat, Plat Book 7, Page 96 - North Side of
Shepard Road Near US 17-92:
Koch gave her presentation. She stated that Mr. Dittmer is asking to annex the 100
foot parcel adjacent to his existing facility. She explained that this parcel is
inbetween the existing parcel and one that is pending annexation from last year.
The Board needs to decide if this annexation will benefit the City and what is the
appropriate land use. She stated that the applicant would like the land use to be
Industrial. She also stated that this parcel is on the Seminole County Land Use
Map as Industrial, and if the Board decided to approve this request, this would not
be an amendment to the City's Land Use Map.
There W'lS discussion on the Ian': use of the property in the area. It was determined
that classification of C-2 zoning would be consistent to the area.
Hartman moved to recommend approval to the City Commission to annex the West 100 feet
of the East 300 feet of Lots 17 and 18, Spring Hammock Replat, Plat Book 7, Page 96 -
North Side of Shepard Road near US 17-92, and to note that there would be no change
to the City Land Use Map. Seconded by Dorman. Vote: Dorman: aye; Joshi: aye;
Hartman: aye; DeFazio: aye; Smedley: absent. Motion carried.
Request of the Winter Springs Development Corporation for Approval of Alteration to
Final Development Plan of Wastewater Plant Site in Tuscawilla PUD to Construct Add-
itional Treatment Facilities to Expand Capacity to Provide Central Sewer Service to
Remaining Undeveloped Land in Tuscawilla and to Property Outside the Boundaries of the
PUD Lying Within the City Limits of Oviedo:
Koch gave her presentation. She stated that the applicant is not here to represent
the request due to a death in the family. She stated that she spoke with the City
Manager and he suggested that the Board proceed with the request to get their opinions
and comments. Koch stated that Mr. Alpert presented plans to the Building Department
requesting to expand the sewer plant. The Final Development Plans were approved in
1972, and the plans indicated the expansion of the sewer plant, however the plans did
not provide the details required by the PUD Ordinance for a Final Development Plan
review for any construction beyond the initial facility. Therefore, such plans
need to be reviewed now as an addition to the Final Development Plan.
The City Code requires a determination be made by the Planning and Zoning Board
whether the request for addition is consistent with the approval of the original
Final Development Plan. In arriving at this decision, the Board must also examine

whether the request is consistent with the Preliminary (master) Development Plan
as well.
The sewer plant must obviously be expanded to serve the remaining undeveloped lands
in Tuscawilla. The fact that the developer wants also to pipe in sewage from its
property in Oviedo, to be treated and disposed of in Winter Springs, however, needs
to be considered at this point in time and a determination made as to the consistency
of such a change with the intent and purpose of the PUD district. It is known that
at the time of the approval of the existing plans the property in Oviedo was not in
the service area of this utility; so extension of sewage service outside the City
limits could not have been approved with the previous plans. The Board needs to
decide in 1986 whether this change is consistent now with the currently approved
master plan for Tuscawilla and the final development plan for the sewer plant site
near the golf course.
Discussion by the Board on the Final Development Plans that were approved in 1972,
as to their intent.
Hartman moved to recommend approval to the City Commission of the Final Development
Plans of the Winter Springs Development Corporation of Alteration to Final Develop-
ment Plan of the Wastewater Plant Site in Tuscawilla PUD to Construct Additional
Treatment Facilities to Expand Capacity to Provide Central Sewer Services to Remaining
Undeveloped Land In Tuscawilla and to Property Outside the Boundaries of the PUD
Lying Within the City Limits of Oviedo.
Motion died due to lack of a second.
There was discussion on what was the determination and intent of the Original
Preliminary Development Plan for Tuscawilla.
Mr. Paul R. Gougleman, Attorney was present and stated that he was asked by the
developer to attend the meeting. He did not have any an~wers to the questions
raised by the Board.
Further discussion on the 1972 approval.
Dorman moved to continue this item until the next scheduled meeting of the Board,
and if possible to have the City Attorney present for clarification to the legal
aspects of the proposed plans; he also stated that the Board needs more information
to determine what was intended in the Final Development Plans. Seconded by DeFazio.
Vote: Joshi: aye; Hartman: nay; Smedley : absent; DeFazio: aye; Dorman: aye.
Motion carried.
The meeting was adjourned at 8:28 P.M.
