PLANNING AND ZONING BOARD MINUTES
WEDNESDAY, JUNE 25, 1986
The meeting was called to order by Chairman Smedley at 7:35 PM.

APPROVAL OF MINUTES OF MAY 28. 1986
DeFazio moved to approve the minutes of May 28, 1986. Discussion. Hartman
asked that the minutes be amended to include his statement that we should
outline the areas on the Land Use Map that the City plans on annexing and
show the proposed land uses, in order to eliminate the 6-month amendment process.
Seconded by Dorman. Vote: DeFazio: aye; Dorman: aye; Joshi: absent; Hartmen:
aye; Smedley: aye. Motion carried.
BRIEFING ON 1986 AMENDMENTS TO WINTER SPRINGS COMPREHENSIVE PLAN: ADOPTED LAND USE MAP
Koch stated that the Planning and Zoning Board also acts as the City's Land Planning
Agency, and as such has the sole responsibility to recommend from the citizens'
point of view the acceptability of land use on a particular piece of property and
propose goals, policies, and objectives in the written plan.
Review of the 1975 Planning Act and the development of the City's 1977 Comprehensive
Plan and 1982 Evaluation and Appraisal Report.
Explanation of the 1985 Local Government Comprehensive Planning Act and its effect to
change the review procedures. Under the new statutes, the City is bound by its
existing Comprehensive Plan until it is amended (scheduled for November 1989).
All requests to alter land use that differ from the Land Use Map adopted in 1982
must be reviewed and found consistent with the overall plan. Rather than consider
each application separately, as in the past, which resulted in 25 amendments to
the map one at a time, now we can only amend the Land Use Map twice in a calendar
year. Therefore, changes will be considered in groups to- see how the over-all
effect remains consistent with our Plan as a whole, in addition to reviewing the
localized effect of each change individually.
The Land Use Map controls what the City can do from now on. In determining con-
sistency, the Board should visit the sites of all land use change requests prior
to a public hearing and subsequent development of its recommendations to the Com-
mission. The Commission then must consider the group of amendments and hold
additional hearings. The Commission then formulates its decisions and forwards
its intended changes on to the State, Planning Council, and County for review. The
State is charged by the new statute to determine whether it agrees that the changes
recommended do actually remain consistent with the City's plan, in the State's view.
The State must report back its findings within 90 days.
After receipt of the State's comments, the City may proceed to adopt ordinances to
change land uses as it prefers. It still has this option to follow its own choices;
however, whereas in the past there was no "penalty" for disagreeing with the State,
now the State has statutory power, if it feels a City is being inconsistent with
its own plan, to withhold State funds.

Koch also stated that the P&Z Board/LPA needs to develop a schedule for the
complete revision of the City's Comprehensive Plan. Although adoption will
not take place until November 1989, all work must essentially be complete
approximately a year in advance to allow time for lengthy review and hearing
requirements.
Hartman stated that there should be a working Land Use Map in addition to
the official one, so the Board can perceive the projected land uses. Koch
advised a large-scale land use map would be prepared the same scale as the
zoning map, for direct comparison with more detail.
