WORKSHOP MEETING Workshop was called to order by John Hatfield. City Planner., Jacqueline Koch nail prepared visual displays of the areas to be annexed. Ms. Koch went on to state the majority of the lands to be annexed are north of the City limits. The advantages of annexation to the property owners would be lower taxes, (approximately 1 mill), road maintenance by the City where applicable, and the County has no plans for expanded facilities in this area whereas the City is more likely to do so in that it is its intent to develop this area when possible. City Engineer, Jack Cooper gave a report on the topographical conditions. In short Mr. Cooper stated that over 50% of the soil in this annexation could be rated medium to poor. Discussion, John Hatfield summarized the workshop by stating that the topography is not any worse than in other areas in the conrrnunity, and the area is not significantly within the flood plane. The soil is over 50% on the poor side, but economically it can be overcome by a properly engineered and approved plan. Subsequently there is nothing in either of these areas that would preclude our interest in letting them become part of our conrrnunity. Discussion. Workshop was adjourned and John Hatfield, Chairman opened the Planning and Zoning Board Meeting. PLANNING AND ZONING BOARD MEETING The Pledge of Allegiance to the. Flag was led by Cindy Kaehler. ROLL: CITY OFFICIALS: John Hatfield-Chairman, present Cindy Kaehler-Vice Chairman, present George Kaplan, present Richard DeFazio, present Jacqueline Koch, City Planner Jack Cooper, City Engineer Motion was made by Kaplan to approve the minutes of October 20, 1982. Seconded by DeFazio. Vote. All aye, motion carried. REQUEST OF CHARLES O. COTTLE TO ANNEXT LOTS 19, 20, 21, 22, and 23, BLOCK D, D.R. MITCHELL SURVEY, SOUTH SIDE OF S.R. 419, EAST OF S.R. 434 INTERSECTION (42 ACRES AT ZONE C-2, 4.5 ACRES AT ZONE R-U). DeFazio brough up that traffic, particularly trucks on 419 might present a problem in the present zoning classification, C-2. Discussion. The City Planner stated the plan indicates the-north side of 419 beyond the railroad tracks would be proper as C-2. Chairman Hatfield stated that to be consistent on a long-range basis we should try and develop this area consistently, and not piece-meal. Discussion. The City Planner stated that currently we are changi~g the C-2 ordinances, and the City will only leave in C-2 the most desirable uses. Discussion. Question was asked of the City Planner by Kaplan, can this Board ask the Conrrnission to accept this zoning as C-2 on a conditional basis. Discussion, in which the City Planner reiterated that the current C-2 ordinances are being changed. Kaplan moved that it be reconrrnended to the City Commission to accept the annexation of Charles Cottle pertaining to the application as shown; lots 19, 20, 21, 22, and 23, Block D. D.R. Mitchell Survey, south side of SR 419, east of SR 434 intersection, and also moved that the City Commission accept the reconrrnendation of annexation of 4.5 acres as shown . e - Planning & Zoning Board Minutes November 10, 1982 Page 2 on the application as R-U. Seconded by Kaehler. Kaplan further, added at this time that this recommendation to the Commission be contingent upon revision of the C-2 ordinance. Question was then asked by DeFazio to the City Planner if this can be zoned C-2 prior to the 2 year waiting period. Ms. Koch commented that this question is currently being studied by the City Attorney. Kaplan restated the original motion that it be recommended to the City Commission to accept the annexation of Charles Cottle's 42 acres as shown on the application {at C'::'2) and that we also recommend to the Commission to accept the annexation of the 4.5 acres (at R-U) as shown on the application by Charles Cottle, contingent upon changing the zoning prior to the 2 years waiting period. Discussion. Kaehler made an amendment to the original motion that if this property cannot come into the City as C-2 that it be accepted into the City as R-U with the consent of the property owner. Seconded by Kaplan. Discussion on the amendment. Vote. All aye to the amendment. Discussion on the original motion. Kaehler offered a second amendment to the original motion that the Commission accept the property for annexation as C-2 with no development permit to be issued by the City for 2 years unless the County waives the 2 year waiting period. Seconded by Kaplan. Vote on amendment, all aye. Discussion. Vote on original motion. All aye, motion carried. REQUEST OF LEFFLER COMPANY TO ANNEX LOX A-F, SUBDIVISION OF WAGNER, AND LOTS 4-7, BLOCK C, AND WEST ~ OF LOT 4, ALL OF LOTS 5-7, AND LOT 9-0, BLOCK D, D.R. MITCHELL SURVEY, BETWEEN LAKE JESSUP AND NORTHERN CITY LIMITS EAST OF S.R. 434, ASTRIDE S.R. 419 (260 ACRES AT ZONE R-U). Kaehler made a motion to accept the request of the Leffler Company as stated on the agenda. Seconded by DeFazio. Discussion. Vote, all aye, motion oarried. REQUEST OF MADELELINE LUTTRELL TO ANNEX ALL OF LUTTRELL PARK PLUS PART OF LOT 1, JOHNSTON SURVEY, ON S.R. 419 EAST OF INDIAN WOODS. (9 ACRES AT ZONE R-l). The City Planner pointed out that this request is not consistent with the Plan on units per acre. R-IA would be the minimal residential category at which it could be zoned and still be in compliance with the adopted plan. Discussion. DeFazio made a motion to recommend the Luttrell property be annexed as R-IA into the City with the stipulation that no development permit be issued by the City prior to the 2 year waiting period, unless the County waives the 2 year period, and if the R-IA zoning classification is found to be unacceptable by the City Attorney then the parcel be zoned R-U with the acceptance of the property owner.
