PLANNING AND ZONING BOARD
Minutes of June 3, 1981
The meeting of the Planning and Zoning Board was called to order at 7:45 p.m. by
Chairman Jerry Fusco. Louise Poole led the pledge of allegiance.

Weiss moved to approve the minutes of May 6, 1981. Seconded by Dixon. Vote:
All aye. Motion carried.
REQUEST OF RICHIE'S ECONOMY CARS TO ANNEX NORTH 5 FEET OF LOT 16, BLOCK B, OAK
GROVE PARK, SAID 5 FOOT STRIP COMMENCING AT EASTERLY RIGHT-OF-WAY LINE OF 180
FOOT WIDE RIGHT-OF-WAY OF U.S. 17/92 AND RUNNING TO A DEPTH OF 546.73 FEET.
Jim Mitchell, the contractor was present with authorization from the owner, to
speak in behalf of the application.
When the expansion of Richie's Economy Cars on U.S. 17/92 was constructed on Lot
17 of Oak Grove Park, which is within the City limits, a small portion of the
structure inadvertently was located across the lot line on Lot 16, which is
Seminole County. The applicant requests the City annex the north 5 feet of Lot
16 so that the entire structure will be under one jurisdiction. The building
extends from 1.15 feet to 3.2 feet across the City limits, so the annexation of
a 5-foot strip will accomplish this. The applicant has provided a survey verifying
the exact location of the building.
The applicant was asked why the owner did not apply to annex the entirety of Lot
16. Mr. Mitchell explained that there is a mortgage on Lot 16 whereas Lot 17 is
unencumbered. The mortgagor has agreed to release this 5-foot strip from the
mortgage, and the owner therefore wishes to annex only this 5 feet at this time.
Weiss moved to recommend approval of the request of Richie's Economy Cars to
annex north 5 feet of Lot 16, Oak Grove Park on U.S. 17/92. Seconded by Dixon.
Vote: All aye. Motion carried.
PRELIMINARY ENGINEERING FOR GARDEN CLUB APARTMENTS AND GARDEN DRIVE OFF SOUTH MOSS
ROAD
Garden Club Apartments will comprise 10 townhouse quadruplexes. Previously platted
Garden Drive will be constructed to serve this property.
The Board questioned the Staff recommendation that a natural buffer rather than a
fence be required between this multi-family development and the single-family homes
to the west and south. The two Staff members present indicated they would defer

to the Board's preference for a fence. The developer, Jeff Ricketts, stated he
would construct a shadow box wood fence along the rear of the 10 lots.
Fusco pointed out that the single-family lots are graded to a lower elevation than
the Garden Club property and suggested that the developer be required to grade the
rear swales so as to eliminate the existing drop-off between properties. The
applicant concurred.
Poole moved to recommend approval of the preliminary engineering for Garden Club
Apartments and Garden Drive subject to the provisions of the Staff Review of
June 1, 1981, with the inclusion that a fence be recommended as the buffer for
the rear of the lots and that the rear property line grade of the proposed
development match that of the existing development, and subject to the Engineer's
letter of May 27, 1981. Seconded by Weiss. Vote: All aye. Motion carried.
CERTIFICATION OF OFFICIAL ZONING MAP
As required by Section 44.26(3) of the Code, the City Planner certified to the
Board that the Official Zoning Map is updated to the present time. She pointed
out the areas that have been rezoned during the last year.
Dixon moved to approve the updated zoning map up to June 3, 1981. Seconded by
Poole. Vote: All aye. Motion carried.
The meeting of the Board adjourned at 8:40 p. m.
