Pla.~il1g & Zoning Board: -- Some 5 weeks ago a formal request was submitted to the city of Winter Springs for re-zoning of subject property. At that time you sought a legal opinoin from the city attorney as to whether or not this property was actually within the corporate limits of Winter Springs. Even though city (Winter Springs) taxes are being paid on this parcel,. the city attorney advised the parcel be re-annexed. Both the con- tract m~er, Mr. Bill Jacobs, and the owner, Florida Land Co., agree with the city attorney. Therefore, as agent for the principals, I do h~r~by request re-annexation of subject parcel as recommended by the city attorney in addition to re-zoning as previously requested. This re-annexation re~lest is contingent on approval o~ the re-zoning request. Incidentally, please amend the initial re-zoning application to read C-l classifi- cation requested instead of "commercial". WALDEN ALTAMONTE SPRINGS, FLORIDA 32701 April 21, 1976 TBLE.PH:ONB (30151 834-8W Mr. Don Sine Planning & Zoning Board City of Winter Springs 102 North Moss Road Winter Springs, Florida 32707 Dear Don: In answer to your questions on reannexation of certain properties in Winter Springs, I will attempt to answer them as accurately as possible. It is my legal opinion, after reviewing the Winter Springs Code of Ordinances, Charter and the General Laws of Florida in reference to annexation that there is no procedure for the Planning and Zoning Board hearing any request for annexation and I therefore, do not feel that the Planning and Zoning Board may call a public hearing upon the same. I think the only way that the Planning and Zoning Board could get involved at all is if the City Council requested that specific re- commendations be made to the Council by the Planning and Zoning Board. Contiguous Zoning and Land Use may be taken into account by the City Council in determining what zoning classification a newly annexed piece of property would receive. It may also influence the decision of the Council as to the feasi- bility of annexation. However, it is one of many factors which may be taken into account. It would appear that the property has been included for ad valorem tax purposes in the City of Winter Springs, and was inadvertently left out of the original annexation. I have double-checked Mr. Ne~qman Brock's work and can state that the property is not in the City of Casselberry. Please refer to Chanter 171, Florida Statutes as to the State annexation laws. It is also my legal opinion that Mr. Don Sine Page Two April 21, 1976 the Mooney Bill which was a special act applying to Seminole County is no longer in effect and was repealed by the passage of Chapter 171, Florida Statutes. What little factual information I have as to the property being considered for annexation, I believe it complies with all requirements of State law for annexation.
