Zoning Commissioner Hendrix CALL TO ORDER: Meeting was called to order at 7:30 by Secretary Newsome, pre- siding in the absence of Chairperson Rossiter and Vice Chairman Sines. APPROVAL OF MINUTES: Minutes of the meeting of January 29, 1976, were approved as submitted. TUSCAWILLA PRESENTATION: Mr. Charles True, representing the Tuscawilla developer, appeared to discuss a proposed change the developer is seeking in the Preliminary Development Plan which has been approved for Tuscawilla. The developer seeks to change the use of an approximately 52-acre site, earmarked for condominiums with a maximum density of 121acre in the approved Preliminary Development Plan, to individually owned two-bedroom golf villas with a maximum density of less than 5/acre. This property would be sold to Nader Homes, which would build and sell the golf villas. Buyers of the golf villas would purchase the land on which their unit sits, but their would be common exterior maintenance and commonly owned pool/ recreation facilities for each cluster of 50-60 villas. Streets would not be eed- icated, but would be privately owned and commonly maintained. There would be a total of 229 units in the development; they reportedly will sell in the mid-$30's. In her memo to the Board dated 2-11-76, the Planner expresses some reservations about the Board approving the change without requiring the submission of a new Preliminary Development Plan, because she feels that what is being requested is a change in concept from the existing approved Preliminary Development Plan. In that same memo, she expresses the City Attorney's opinion that the golf villas will not be condominiums -- as called for in the current Preliminary Development Plan -- and that a new Preliminary Development Plan should be submitted for the Board's consideration. For these reasons, and because the Board feels that residents of Tuscawilla should have an opportunity to hear the proposal and express their opinion, the Board unan- imously voted to call a Public Hearing on the request for 7:30 p.m. Thursday, March 4. The Board directed the Planner to notify the Tuscawilla developer of the Public Hearing and to ask the developer to submit as part of the application a re- vised Preliminary Development Plan and any other information which will identify more clearly and define the proposed changes in the use of the property. The de- veloper will be asked to submit this information to the Planner prior to February 26, so that Board members can have and discuss it at the February 26 meeting. The Planner also was asked to contact the City Attorney on behalf of the Board and ask him to attend the Public Hearing or to submit his opinion on the Tuscawilla request to the Board in writing prior to that time. The Planner also was asked to prepare a written staff recommendation on the request. PUD ORDINANCE DRAFT: The Board reviewed with the Planner the draft of a revised PUD ordinance and the City Attorney's memo of 2-10-76. Several changes in the draft were agreed upon and are included in the draft which is being sent to the Mayor and Council, a copy of which also has been placed in each Board member's folder. P&Z Minutes of February 12, 1976 Page 2 REZONING PROCEDURES: The Planner's draft dated 2-7-76 dealing with procedures of the Board was discussed briefly and will appear on the agenda of the February 26 meeting. NEXT MEETING: Next meeting will be at 7:30 Thursday, February 19 -- a workshop with the Mayor and Council to review the PUD ordinance draft. BOARD TIMETABLE: Following the February 19 workshop, the Board will meet in regu- lar session on February 26. The agenda will include another review of the PUD ordinance draft and possible revisions in light of comments made by the Mayor and Council at the workshop and discussion of the Planner's 2-7-76 memo regarding rezoning procedures. Next will be the Public Hearing on the Tuscawilla request on March 4. Next will be our regular meeting on March 11, for which no agenda items are scheduled yet. .
