2010 04 12 Regular 601 Requesting Approval for Final Design for Proposed Right Turn Deceleration Lane on SR 434
COMMISSION AGENDA CONSENT INFORMATIONAL ITEM 601 PUBLIC HEARING REGULAR X April 12, 2010 MGR 4, /DEPT Meeting Authorization REQUEST: The Public Works Department requesting the City Commission approve the Final Design for the Proposed Right -turn Deceleration Lane on S.R. 434 Eastbound at Tuscora Drive and Authorize Staff to Proceed with Land Acquisition SYNOPSIS: The proposed right -turn deceleration lane on S.R. 434 eastbound at Tuscora Drive is a warranted safety improvement project. The design is complete and this agenda item seeks Commission approval of the final design and authorization to proceed with land acquisition activities necessary to obtain small portions of three parcels adjacent to the project. CONSIDERATIONS: • At the July 13, 2009 City Commission meeting, the Commission authorized proceeding with the design of a right -turn deceleration lane on S.R. 434 eastbound at Tuscora Drive in the amount of $32,277.01, funded from the Transportation Impact Fee Fund. The design is complete and has been approved by the Florida Department of Transportation. • A right -turn deceleration lane on S.R. 434 eastbound at Tuscora Drive is warranted as a safety improvement, based on the S.R. 434 Right Turn Deceleration Lane Study performed for the City by Professional Engineering Consultants (PEC) in 2004. The PEC Study was approved by the City Commission in 2004 and it included a prioritized list of projects plus recommended City Code criteria for deceleration lanes which has been adopted (Section 9 -206). • PEC's study identified and prioritized the following six locations on S.R. 434 where right -turn deceleration lanes are warranted: 1. Vistawilla Drive eastbound (under construction) 2. Hayes Road eastbound (under construction) 3. Winding Hollow Blvd. eastbound 4. Tuscora Drive eastbound 5. Moss Road eastbound (completed with S.R. 434 Village Walk project) 6. Courtney Springs eastbound Regular Agenda Item #601 April 12, 2010 Page 2 of 4 • The top two priorities, S.R. 434 eastbound at Vistawilla Drive and S.R. 434 eastbound at Hayes Road, are currently under construction. These two projects were approved for federal funding under the American Recovery and Reinvestment Act of 2009 (Economic Stimulus Plan). • The next two priorities from PEC's study were S.R. 434 eastbound at Winding Hollow Blvd. and S.R. 434 eastbound at Tuscora Drive. Of these two, staff recommended proceeding with the Tuscora Drive turn lane as the next project due to its greater safety need, lower cost of design and construction, and the ability to have the Tuscora Drive project "shovel ready" as early as possible to increase the chances of having it federally and /or state funded. Staff performed a PM peak -hour traffic count at S.R. 434 eastbound at Tuscora Drive in June 2009 which verified that the turn lane was still warranted. • If no federal or state funding is available for construction, the construction would be funded out of the City's Transportation Impact Fee Fund when sufficient funds are available (currently projected in 2014). • Right -turn deceleration lanes provide the following benefits: o Reduced rear -end collision potential o Reduced potential for evasive driving maneuvers o Improved Level of Service (LOS) of arterial, as turn lanes remove slower moving vehicles from the main traffic stream o Improved pedestrian safety • Design Overview: o The deceleration lane width is 11 -feet and the length is approximately 320 -feet plus a 50 -foot taper o The existing 4 -foot wide bike lane is continued between through lane and turn lane per FDOT standards o A 6 -foot wide sidewalk is proposed immediately adjacent to the new curb line o The new asphalt edge will be 11 -feet from the existing asphalt edge o The new back of sidewalk edge will be approximately 9 -feet from the existing back of sidewalk edge o No trees will be removed. Some minor trimming may be required. o Ground cover at Tuscawilla entrance sign impacted; offsetting landscape improvements are planned • Land Acquisition: o In order to construct the project in accordance with FDOT design criteria, small portions of three parcels are impacted and recommended for acquisition (see attached Exhibits B and C): • The Reserve at Tuscawilla HOA property at corner (141 SF) • 316 Heatherwood Court (217 SF) • 314 Heatherwood Court (405 SF) o All lands recommended for acquisition are on the S.R. 434 side of the existing brick wall, which is owned and maintained by The Reserve at Tuscawilla's HOA. Regular Agenda Item #601 April 12, 2010 Page 3 of 4 o Projects that still need right -of -way acquisition are not considered to be "shovel ready" and are not eligible for federal Stimulus funding. o Staffs communications to date with the affected property owners has been as follows: • December 11, 2009 — initial letter sent with project description, design drawing, and aerial photo of impacted land • February 1, 2010 — follow -up letter notifying the property owners that the impacted lands have been marked in the field for their information and review and that City Staff is available to meet onsite to answer any questions about the project or impacted lands • March 16, 2010 — Staff attended The Reserve at Tuscawilla HOA Board meeting and made a project presentation and answered questions about the project o No appraisal has been performed for the impacted lands. As a reference point, lands were acquired for the S.R. 434 at Vistawilla Drive turn lane at a unit price of $11.64 per square foot, and for the S.R. 434 at Hayes Road turn lane at $12.75 per square foot. Both of these projects were commercial properties, while the lands to be acquired for the Tuscora turn lane are residential and located outside of the subdivision's 6 -foot brick wall along S.R. 434. At $12.75 per square foot, the cost to acquire all land for the Tuscora turn lane would be $9,728 (763 SF at $12.75/SF). This does not include the cost of the appraisal or legal fees. o A portion of the lands to be acquired are within a "planting and screening easement" dedicated to The Reserve at Tuscawilla HOA. It is likely that the easement will have to be vacated within the lands to be acquired for the turn lane. • Input from The Reserve at Tuscawilla: o Staff attended The Reserve at Tuscawilla's HOA Board meeting on March 16, 2010 at their invitation. The purpose was to discuss the proposed turn lane, including a design overview, project status update, land acquisition summary, and the project's next steps. The HOA Board was notified about the April 12 Commission meeting agenda item and they were invited to attend and/or provide written input. o The HOA Board expressed the following concerns about the proposed turn lane: • Other projects have greater need; no need for this project right now; the Winding Hollow turn lane has a higher priority • Concern about having traffic closer to homes • Prefer to see a lower speed limit on SR 434 • Prefer to have the through lanes moved towards the median • Prefer to install a larger turning radius at the corner • More potential for vehicles to jump curb and hit wall • Concern about impacts to landscaping at Tuscawilla sign and along outside of wall • Concern about reduction of property values FISCAL IMPACT: No funding is requested as part of this agenda item. The HOA Board was notified about the April 12 Commission meeting agenda item and they were invited to attend and/or provide written input. Two letters have been sent to each of the three (3) property owners impacted by the required land acquisition. RECOMMENDATION: Staff recommends the Commission approve the Final Design for the Proposed Right -turn Deceleration Lane on S.R. 434 Eastbound at Tuscora Drive and Authorize Staff to Proceed with Land Acquisition. This is in reference to regular agenda item #601 on Monday's agenda. I spoke at the HOA Board meeting on March 16 and asked them to provide written input in advance of the April 12 meeting if possible. Regarding the issues raised in the letter: • The City's deceleration lane study performed in 2004 demonstrates that a turn lane is warranted at this location. The minimum standard for a turn lane per FDOT guidelines (and adopted in the City Code, Section 9- 206) is 40 right turns per hour in the peak hour. Tuscora had 53 right turns in 2004, and when we measured it again in 2009 it had 55 turns. This proposed turn lane would meet warrants using current criteria for FDOT, Seminole County, Orange County, City of Orlando, and others in the area. • Right -turn deceleration lanes improve intersection safety. The FHWA study referred to in the HOA's letter states: "Added right turn lanes are effective in improving safety at signalized and unsignalized intersections in both rural and urban areas." Statistics vary on the percentage reduction in accidents that can be expected, from as little as 2% to as much as 61 %. Unsignalized intersections, like Tuscora, generally show a greater percentage reduction in accidents compared to signalized intersections. • The SR 434 / Tuscora Drive intersection had 14 accidents over the past 5 years per WSPD records. After reviewing the accident reports in detail, it is difficult to say for sure how many of these accidents would have been avoided had there been a turn lane. • Some additional factors to consider at this intersection include: 1) it is unsignalized; 2) it is high speed (posted at 50 mph); 3) it is on a slight downhill, so approach speeds tend to be higher; and 4) it is the first major intersection east of the SR 434 /Tuskawilla signal, so vehicles on 434 eastbound still tend to be relatively close together (in a "platoon ") at Tuscora after releasing from the signal.
