HomeMy WebLinkAbout1986 09 17 Staff Review Regular Meeting Minutes STAFF REVIEW MEETING September 17, 1986 PRESENT WERE: Gil Artman, Public Works Director Sam Smith, Building Official Jacqueline Koch, Dir. Adm./City Planner Len Kozlov, City Engineer Doug Taylor, Utility Manager John Govoruhk, Police Chief Bob Powell, Land Development Coordinator Gerald Chancellor, Developer Continuation of Foxmoor East Replat: Powell gave his presentation. He read a letter he received from Chancellor which stated that the developer and his partners are in disagreement as to the applicability of Section 14-61 of the City Code. The developer feels that the remaining lots (balance) remains platted as North Orlando Ranches Section 3, and is not land locked. The letter stated that the developer is dedicating 3.169 acres in the subdivision as drainage and conservation easements and requests these dedications be considered as part of the requirements of Section 14-62 of the City Code. They offer $2,000 as a contribution amount to give for recreational fees. Koch stated that this would not be part of Section 3. Powell stated that the City Engineer, Police Chief, and himself met with the City Manager and stated that the City Manager's interpretation is that the back portions remain platted from before. He stated the City Manager doesn't agree with the need to designate those remaining portions in a replat. Koch asked what will the fragments become? She also stated that the fragments of the lots left over will not be eligible for building permits. Powell restated the City Manager does not believe that the remaining parcels are remnants. There was discussion on the 5% value of the property for recreational purposes. Chancellor stated that they felt that because they were dedicating 3.169 acres that they would give the City $2,000 instead of the $9,760 that was determined to be 5% of the accessed value. Koch stated that that does not qualify as the dedicated recreational acreage because it is not usable; it is a drainage easement and land dedicated for parks must be good, dry, usable land. Kozlov made the motion to accept the original replat and to modify the 5% accesed value for recreation from the $2,000 the developer offered to the original 5% of the accessed value of the replatted property that was originally quoted to the developer. Seconded by Smith. Vote: Six Aye votes were noted with one no recommendation voiced. There was discussion on whether there will be building permits issued for the three remnant lots. The majority of bhe Staff felt they would qualify. Kozlov made the motion to recommend approval to; the City Commission on Waiver to Sub- division for the Foxmoor East replat. Seconded by Govoruhk. Vote: All Aye . There was discussion, Koch stated that she didn't have any objections, but the remnants should be labeled as what they are - lots. Meeting was adjourned.
