REQUEST:
The Community Development Department requests the City Commission consider a
request from the Tuscawilla Home Owners Association for permission to install an
American Flag and flag pole in a roadway median at the rear entrance to the Tuscawilla
Subdivision on Winter Springs Boulevard.
PURPOSE:
The purpose of this agenda item is for the City Commission to consider a request of the
Tuscawilla Home Owners Association to furnish and install a second thirty (30) foot tall
flag pole and American Flag located within a roadway median on Winter Springs
Boulevard.
CONSIDERATION:
On June 23, 2008, at a regular Commission Meeting under Agenda Item R -601,
the City Commission agreed to allow an American Flag and flag pole to be installed by the
Tuscawilla Home Owners Association (THOA) in a median located at Winter Springs
Boulevard and Tuskawilla Road, at the western end (main entrance) of the Tuscawilla
Community. A condition placed on the approval of this project included the requirement of
an agreement between the THOA and the City for maintenance of the flag pole installation.
On November 20, 2009, the THOA submitted a request for an additional
American Flag and flag pole to be installed in a roadway median located near the intersection
of Winter Springs Boulevard and Seneca Boulevard, at the eastern end of the Tuscawilla
Community. The newest installation is specified to match the original flag pole installed at
the main entrance to Tuscawilla in 2008.
Pursuant to their request, Brian Fields who is the City's Engineer has reviewed the
installation site and found it to be an acceptable location. THOA has committed to funding
the cost of installation and ongoing maintenance of the additional American Flag and flag
pole at the eastern end of Tuscawilla on Winter Springs Boulevard. As with the first
installation, the City would be required to maintain, raise and lower the flag as per the
established standards for an American Flag on public display. The THOA would be required
to fund the ongoing maintenance and repair of the flag pole installation.
STAFF RECOMMENDATION:
Staff recommends the City Commission decide whether to allow the Tuscawilla
Home Owners Association permission to install a second flag pole and American Flag in a
roadway median located near the intersection of Winter Springs Boulevard and Seneca
Boulevard, at the eastern end of the Tuscawilla Community. If permission is granted, staff
recommends the City Commission authorize the City Manager and City Attorney to prepare and
execute any and all applicable documents required for this project.

Dear Mayor Bush and City Commissioners:
The Tuscawilla Homeowners' Association's Board of Directors voted to request
permission from the City of Winter Springs to use the eastern end of the center
median on Winter Springs Boulevard within Tuscawilla for the installation of a
second flag pole as indicated on the attached map.
It should be noted that a significant majority of handwritten comments on the
THOA's flagpole surveys indicated a strong desire by residents to have a
flagpole at this location.
Don Gilmore of the THOA Board has spent time investigating this location. He
has supplied detailed information including the manufacturer to Steven Richert,
Urban Beautification Manager. It should be noted that the manufacturer is the
same one that was used at the main entrance to Tuscawilla.
The THOA is prepared to donate the cost to purchase and install this flag pole. In
addition, the THOA will fund an escrow account and execute a separate flagpole
maintenance agreement for this pole.
It is our sincere belief that this flagpole will be appreciated by the residents of
Tuscawilla and many other folks.
