REQUEST:
The Community Development Department requests the City Commission consider a
request from the Tuscawilla Home Owners Association (THOA) to donate an amount
not to exceed $6,000 for the installation of three (3) benches within the Tuscawilla
Subdivision.
PURPOSE:
The purpose of this agenda item is for the City Commission to consider a request of the
Tuscawilla Home Owners Association to furnish funding to the City for the installation of
three (3) benches to be located on public property within Tuscawilla.
CONSIDERATION:
On November 20, 2009, the THOA submitted a request to the City to donate an
amount not exceeding $6,000 for the installation of three (3) public benches and concrete
pads to be installed at specified locations within the Tuscawilla Subdivision as follows:
Bear Creek Nature Trail Adjacent to the Parking Area
Sam Smith Park Storm Water Pond Located West of the
Park Entrance near the Sidewalk
Greenbriar Lane at the Storm Water Retention Pond adjacent
to Bentley Green, near the Sidewalk
Specifications for the benches are shown in detail on Attachment `C' of this
agenda item, which includes an upgrade to recycled plastic slats instead of wood, and an 8'
bench supporting up to 325 pounds each.
The Community Development Department has reviewed all three proposed
installation locations with representatives of the THOA for potential public safety and
maintenance issues, and has identified minimal impacts in these areas of concern due to this
project. Staff has also contacted the City's Public Works and Police Departments regarding
this proposal and these departments have not identified any significant public safety issues.
As part of the THOA request, the City would be required to use the donated funds
to purchase, install and maintain all three (3) public benches donated for the Tuscawilla
Subdivision. The City would have ownership and the responsibility for these benches in
perpetuity.
STAFF RECOMMENDATION:
Staff recommends the City Commission decide whether to allow the Tuscawilla
Home Owners Association to donate an amount not to exceed $6,000 for the installation of
three (3) public benches as proposed, for the Tuscawilla Subdivision, and provide direction
as to the ongoing maintenance of the benches. If approved, staff recommends the City
Commission authorize the City Manager and City Attorney to prepare and execute any and all
applicable agreements required for this project.

Dear Mayor Bush and City Commissioners:
The Tuscawilla Homeowners' Association's Board of Directors voted to make a
donation to the City of Winter Springs to be used for the installation of (3) three
benches within Tuscawilla as indicated on the attached map.
Ted Johnson and Don Gilmore of the THOA Board have spent several months
investigating bench designs and potential locations. They have supplied detailed
information including the bench design and manufacturer to Steven Richart,
Urban Beautification Manager. It should be noted that the manufacturer is one
that the City has used previously.
The THOA is prepared to donate an amount not to exceed $6,000 (six thousand
dollars) for the purchase and installation of the three benches and concrete pads.
It is our sincere belief that these benches will enhance the enjoyment of living in
Tuscawilla.
