Present were: Charles Holzman, Ron Emery, John Govoruhk, Ray Bradshaw, Jack Cooper, Jacqueline Koch, and Richard Rozansky. BELGIAN WAFFLE BAKERY AT 10 SHERRY AVENUE - DETERMINATION OF BOARD REQUIREMENTS. Mr. Larry Johnston, property owner, and Mr. Claude De Leu, bakery operator, were present to speak on the Board's determination of the requirements regarding the Belgian Waffle Bakery at 10 Sherry Avenue. The City Planner stated the bakery was approved at this location by the Board of Adjustment on February 4, 1982. She stated there has been no formal site plan submitted. Mr. Johnston stated they have no plans at this time to make any changes to the site or the building. The Planner stated one condition in C-l parking is that it cannot be within the front setback. The setback on that property is 25 feet so the appli- cant cannot use the front yard for parking. Ms. Koch asked how many cars could park in the driveway. Mr. Johnston stated two. Mr. De Leu stated the majority of the business will be comprised of him delivering the waffles to the stores himself. He will be using his own car for deliveries, and will park it beyond the driveway alongside the house, so the two spaces in the driveway would always be available to customers. The Planner asked if there was any activity at the rear of the site which would require buffering. Mr. De Leu stated there was not. He stated there is a chain-link fence at the rear of the property. The Building Official stated he felt a plan should be presented for the Board's approval and that the parking area should be stabilized to more than just sand. The City Engineer informed the property owner the minute he starts tampering with the exterior of the building (stabilizing the ground) he is going to be required to put in a storm drainage retention pond. The City Planner asked if the Board felt this site would satisfy the code which requires 1 parking space for each 300 square feet of floor space. The Board unanimously agreed that the three parking spaces as described and reviewed under the provisions of Section 44.72 paragraph 27 would suffice. It was unanimously agreed that the third parking space would not be required to be stabilized until it proved otherwise. The City Engineer suggested that a maximum of one year for a re- review subject to the Police Chief's determining whether or not a parking problem has occurred prior to that and if so an immediate review upon his determination. The Board unanimously agreed with the suggestion. The City Planner stated this Board will review the operation on the site at the end of one year. The applicant agreed to submit a copy of the sketch of survey showing the parking spaces. The City Planner referred the applicant to Mr. Bradshaw for licensing information and the Fire Chief for assistance with the fire codes. Site Plan Reyiew Board Meeting February 9, 1982 Page Two. HUNT PROFESSIONAL OFFICE ON SOUTH MOSS ROAD - DETERMINATION OF COMPLIANCE WITH CONDITIONS SET BY BOARD ON MARCH 6, 1980. The City Planner stated regarding the Hunt Professional Office on South Moss Road the owner was to place siding on the building, stained a neutral color. She stated the point of the condition was that the building be upgraded in that it was not a new structure. There was also provision for landscaping, which he made several attempts at. Ms. Koch stated this was a year and a half ago. Mr. Hunt was then sent to the Code Enforcement Board for noncompliance. He had six months to put the refurbishing (siding) on the front of the building, which he did not do. He was given an extension which he did not meet and was given another extension by the Code Enforcement Board of six months to accomplish the refurbishing and that six months expired January 27. She stated Mr. Hunt did alter the front of the building in an effort to meet these conditions, and that the Board needs to determine whether they find he has accomplished the purpose of the conditions, which was to make that building fit into the residential neighborhood. The Building Official stated when they had the review for the Code Enforcement Board it was brought out that he would have to present a plan to the Site Plan Review Board for approval and he has not presented a plan. The City Planner stated she recalled this also, but that it was not listed as a condition in the minutes. Ms. Koch asked the Board members for their opinions as to the satisfaction of the require- ments. Mr. Emery stated he felt it looked as good as any of the other houses in the area. He stated there are a variety of colors on the houses. Mr. Bradshaw stated he did not agree. The wood on the office is a natural wood (no finish, exterior yellow pine siding). He stated he did not feel it was going to hold up very well tilted at an angle with no overhang. The Fire Chief stated he had no problem with the building itself, but stated the surroundings could be improved. Mr. Bradshaw stated the building was originally built as a temporary structure. The City Planner stated the condition was to refurbish the front of the building with siding stained a neutral color to be completed within six months. After further discussion the Board agreed to have the City Planner write Mr. Hunt and inquire as to his position on the refurbishing (whether it is complete at this point and his future plans). The Planner will ask Mr. Hunt if and when he plans to submit a plan so the Site Plan Review Board can determine whether or not he has completed his refurbishing. The City Engineer suggested at such time as Mr. Hunt is going to advise this Board whether he feels he has completed his work that he be present so that they can question him further.
