Minutes of Site Plan Review Board
August 31, 1981
Meeting of the Site Plan Review Board was called to order at 11:00 A.M.
for further consideration of the Site Plan of Citgo Gas Station on S.R.
434 between South Fairfax and Devon. Present were: John Govoruhk,
Charles Holzman, Jacqueline Koch, Ray Bradshaw, Jack Cooper, Ron Emery,
Burt Larsen from Citgo and Jim Wynne, Builder for Citgo.
The City Planner stated their main topic was to discuss further the drive-
way cuts on S.R. 434.
Mr. Larsen stated his company had consulted with D.O.T. and they stated
the two driveways already there are permitted entrances, that they are
legal, that they have the jurisdiction over them and they can remain.
Mr. Larsen said he had previously stated they could go with one entrance,
but his company said they want two. The City Planner questioned whether
Mr. Larsen had anything in writing from D.O.T. Mr. Larsen said he did not.
The City Planner cited a report which stated the greater the number of
access points, the greater the probability of accidents. It also stated
there is no benefit to the driver from adding a driveway cut.
The City Engineer stated he would suggest one of the cuts be restricted
to in-only and one further down be restricted to out-only traffic. The
City Planner stated sne would agree if people would do as suggested, but
did not believe the motorists would pay attention to the sign stating
such. The City Planner questioned how drivers would be prevented from
making a left turn into the exit. The Building Official stated there is
a center lane that is marked off and that if someone turns there, techni-
cally they are breaking the law. The Planner stated there is nothing
there that says you cannot turn left. The Building Official stated he
felt the Site Plan Review Board was going beyond their purpose and did not
see where approaches would do any damage. The Planner cited Section
44.23.6 of the Code. The Building Official stated if a hazard exists
from this, the Police Department should recommend to D.O.T. that this is
causing a problem and they should mark it. The Building Official stated
you are not supposed to drive over the slashmarks on the road. The City
Planner stated she was informed by D.O.T. that it is not illegal to
drive on diagonal crosslines in the State of Florida. She stated the
markings in front of the Village Marketplace are incorrect and D.O.T.
refuses to remark them.
The City Engineer stated D.O.T. put the driveway cuts in as they were
widening Hwy. 434 wherever they thought they would be needed in the future.
D.O.T. in widening 434 used whatever right-of-ways they could get and
wound up with two driving lanes, no room for accel-decel lanes. He

stated despite the fact it would be difficult to control the traffic in and
out, it would be safer to have the traffic coming in one driveway cut and
going out the other if it can so be restricted. The Engineer stated he
would like to see the flow of traffic in one direction.
The Planner questioned how this would be enforced. The Police Chief stated
the law says you will not cross a double yellow line, therefore they issue
a ticket. He stated they have not lost a case yet. D.O.T. says there is
no problem. The Building Official recommended a suggestive sign such as:
"Right Turn Only" be installed on Citgo's property. The City Planner stated
she felt the signs would not prevent the motorists from driving as they
chose.
The Public Works Superintendent questioned whether there had been traffic
problems at Cumberland Farms or any other similar site. The Police Chief
reported there had not been - most of the accidents had occurred inside,
backing up. The Fire Chief stated the City will be faced with further
traffic problems as the adjacent property is developed. Mr. Larsen stated
they could install low-level lights or a right turn only sign - whatever
is necessary. The Building Official stated he felt internal markings were
necessary.
The City Planner stated if they allowed both driveway cuts at this Site Plan,
they would have to allow them in the future and she felt a policy should be
followed, citing Dr. Martin's proposed office site, Dr. Monthree's office
building as well as the Atrium II building, all of which have no cuts on
S.R. 434. It was suggested to require a Enter Only, Exit Only and a Right
Turn Only Sign. The City Planner stated the Board could require a grass
strip so the driveway cannot be used. The City Engineer stated if any
driveways are allowed he felt they should allow two, not one, because it
would be more hazardous.
A vote was taken to allow two driveways on S.R. 434: Govoruhk, Cooper,
Emery and Bradshaw voted aye.
A vote was taken to allow one driveway on S.R. 434: Holzman and Koch voted
aye.
The majority approved two driveways on S.R. 434 at this site.
The City Engineer noted the small turning radius and stated D.O.T. would
permit a wider sweep in the direction of the traffic to the right.
It was suggested that a No Left Turn Sign be r~quired as well as the three
others above.
The Planner suggested a permanent barrier be required to control the traffic
pattern internally. The applicant is to submit revised plans. Suggestion
was made to require directional arrows on the pavement as well as painted
signs.
The City Planner informed Mr. Larsen one more utility waiver was required
from Florida Power to vacate the existing 14 foot north-south easement.
An indenture needs to be written granting the City a new 14 foot east-west
easement along the south boundary. Mr. Michael Alexatos' attorney is to
prepare the instrument. a 12 ~c.!<...
