REQUEST:
Community Development Department, Building Division requests the City Commission hold a
second reading of Ordinance 752 amending Sec. 6-101 of the Code of Ordinances, City of
Winter Springs, Florida to comply with the amended State of Florida Minimum Building Codes.
PURPOSE:
The purpose of this agenda item is to request the City Commission hold a second reading of
adopt Ordinance No. 752, amending Chapter 6 Sect. 6-101 of the Code of Ordinances, City of
Winter Springs, Florida to comply with the amended State of Florida Minimum Electrical Code.
APPLICABLE LAW:
Florida Statute 553.73, State of Florida Rule 9B-3049 and Sec. 6-101 City of
Winter Springs Code of Ordinances.
FINDINGS:
Effective September 20,1999, the State Of Florida adopted the 1999 Edition of the National
Electrical Code as the state minimum electrical code.
RECOMMENDATIONS:
Staff recommends the City Commission approve the second reading of proposed Ordinance No.
752 amending Sec. 6-101City of Winter Springs Code of Ordinances to comply with the State of
Florida Minimum Electrical Code.

Building Commission has adopted the 1999 National Electric Code (NEC) effective September
20, 1999. Based on this rule, as of September 20, 1999, the 1999 NEe is the state minimum
electrical code which you are advised to adopt and enforce as soon as possible.
Enclosed for your information are a copy of Rule 9B-3049 which adopts the 1999 NEC
( and a letter concerning Fair Housing Act accessibility standards.

Adopt the most recent version of the National Electric Code for use statewide. The 1990 version,
adopted by statute, is no longer in use nationwide and copies of, and training on, that version are
not widely available.

( (1) In order to authorize the use of the most recent advances in technology and materials

pertaining to the electrical requirements for building construction. the Commission hereby adopts
the ''National Electric Code. 1999 Edition" NFP A 70-l999. as the State Minimum Electrical
Code.
(2) On or after the effective date of this rule. each local e:ovemment and state agency with
building construction rewlation responsibilities shall enforce the standards and procedures
contained in the National Electric Code. 1999 Edition. as the minimum electrical standards in
the state.

AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA
AMENDING THE FOLLOWING SECTION OF CHAPTER 6 OF THE CODE OF
ORDINANCES, CITY OF WINTER SPRINGS FLORIDA: AMENDING
ARTICLE IV ELECTRICITY SECTION 6-101 ELECTRICAL CODE ADOPTED;
PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida has determined
that it is in the best interest of the City of Winter Springs, Florida to update and adopt the various
standard codes relating to building, housing, electrical, plumbing, mechanical, gas and
WHEREAS, the adoption of these codes is done to comply with the State of Florida
adopted Minimum Building Codes and to facilitate proper inspection activities by the City of
Winter Springs relating to construction and maintenance of buildings and the public health and
the general welfare within the corporation limits of said City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS AS FOLLOWS:
Section I - That Sec. 6-10 I Electrical code adopted, is hereby deleted in its entirety and
the following replaced therefor:
Sec. 6-101 Electrical code adopted.
The City hereby adopts in its entirety that certain electrical code known as the National
Electrical Code, 1999 Edition as published by the National Fire Protection Association and the
Central Florida Advisory Committee Notice "M", except as otherwise provided in this article.
Section II - Conflicts. All ordinances or parts of ordinances in conflict herewith being
the same are hereby repealed.
Section III - Severability. If any section or portion of a section or subsection of this
Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or
impair the validity, force or effect of any other section or portion of section or subsection or part
of this Ordinance.
Section IV - Effective date. This Ordinance shall become effective immediately upon its
passage and adoption.

analysis has been made of the building and
such building can safely support the spe-
cific antenna with a minimum wind load-
ing of one hundred (100) miles per hour.
(3) Television dish antennas or satellite anten-
nas shall not be installed in front of the
front line of any residential, commercial, or
industrial building.
(4) Television dish antennas or satellite anten-
nas may only be installed in side yards or
back yards of any building.
(5) No portion of any antenna or support struc-
ture shall be closer than five (5) feet from
any property line.
(6) Television dish antennas or satellite anten-
nas shall not be located on any public way,
easement, or parkway.
(7) Television dish antennas or satellite anten-
nas shall not be installed in any designated
parking area of any building.
(8) Mobile mounted television dish antenna or
satellite antenna structure shall comply
with all requirements (1) through (7) above.
(b) Apartment and condominium buildings.
Apartment or condominium buildings above three
(3) stories in height shall be treated as commer-
cial structures for the purpose of these regula-
tions for television dish antenna or satellite an-
tennas.
(c) Height restriction. The installation of any
television dish antenna or satellite antenna shall
not exceed the height restriction set forth in the
zoning ordinance for that location.

Sec. 6-84. Accessory buildings.
(<1) General. Accessory building means a de-
tached, subordinate structure, the use of which is
clearly incidental to, customarily associated with,
and related to the principal structure or use of the
land, and which is located on the same lot as the
principal structure or use. Accessory buildings
shall include storage buildings, toolhouses, party
houses, bathhouses (used in conjunction with
swimming pool) and similar uses. No more than

two (2) accessory buildings shall be allowed on
any single lot. Accessory buildings shall not be
used as living quarters.
(b) Height and size restridions. The maximum
height shall be twelve (12) feet measured from
ground level. The maximum size of any structure
shall be two hundred forty (240) square feet.
(c) Location. All accessory buildings shall be
located to the rear of the existing buildings line.
(d) Permits. A building permit shall be re-
quired before construction or placement can take
place. No accessory building shall be permitted
prior to construction of the principal building.
(e) Setback requirements. When an accessory
building is attached to a principal structure by a
breezeway, passage or otherwise, it shall become
a part of the principal structure and shall be
subject to the required setbacks of the principal
structure.
(1) Corner setback-On all corner lots the min-
imum open sideyard setback shall be that
of the principal building.
(2) Rear yard setback-Shall be a minimum of
six (6) feet.
(3) Side yard setback-Shall be that of the lot
on which the building is to be located.
(4) Easements-If an easement on the lot where
the building is to be located is greater than
that addressed above, then the easement
size shall prevail. No building shall be
constructed or placed on an easement.

Sec. 6-129. Fees.
All applications for plumbing permits shall be
actompanied by an appropriate plumbing permit
fee as set forth by the city commission pursuant to
resolutions adopted under the authority of this
article which are on file in the city clerk's office.

ARTICLE VI. MECHANICAL
Sec. 6-146. Mechanical code adopted.
The city hereby adopts in its entirety that
certain mechanical code known as the Standard
Mechanical Code, 1994 Edition, excluding Appen-
dix B, as promulgated by the Southern Building
Code Congress International, Inc., except as other-
wise provided in this article.

Sec. 6-147. Definitions.
(a) The word "city" as used in the code adopted
in section 6-146 refers to the City of Winter
Springs, Florida.
(b) The words "mechanical code" as used herein
refer to the Standard Mechanical Code adopted in
section 6-146.
