REGULAR MEETING

CALL TO ORDER
The Code Enforcement Board Regular Meeting of Tuesday, May 20, 2008 was called to
Order at 7:00 p.m. by Chairman Mathew Matisak, in the Commission Chambers of the
Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708).

Chairman Matisak stated for the Record, "Alternate Board Member [Dale] Kirby and
Alternate Board Member [Maria] Fair, their absences are Excused due to a work related
issue."
Next, Chairman Matisak led the Invocation and Pledge of Allegiance.
Continuing, Chairman Matisak inquired if there were any "Agenda Changes". Assistant
to the City Clerk Danielle Harker replied, "Yes, Sir. Tonight we will be hearing Agenda
Items `502.5', Agenda Item `502.7' and Agenda Item `502.8'."
Captain Glenn Tolleson, Code Enforcement Bureau, Police Department asked, "If you
could move [Agenda] Item `600' to the forefront. Corporal [Jim] Flannigan will be
testifying tonight; if we can go ahead and get that on the Record prior to the Cases."
Discussion.
Chairman Matisak said, "So, we have a request from Captain Tolleson to move [Agenda]
Item `600' up before [Agenda] Item `500'. Can I have a Motion?"

Discussion ensued on changing `Vice Chairperson' to `Vice Chairman'.

Manual to -refer to the `Vice Chair' position as `Vice Chairman' instead of `Vice
Chairperson'. Is there a Motion for that?"

Vice Chairman James B. Pitts commented, "I would like to commend the [Assistant to
the] City Clerk for the excellent job she did in the revisions and the time, obviously, that
she spent going through that in detail. Outstanding. Thank you." Board Member Wood
added, "And she caught the error." Chairman Matisak remarked, "Yes, thank you very
much for doing that."

Approval Of Qualifications For Officer Jim Flannigan Assigned To Code Bureau.
Corporal Jim Flannigan, Code Enforcement Officer, Code Enforcement Bureau, Police
Department commented, "Corporal Jim Flannigan with the Winter Springs Police
Department. I've been an Officer with Winter Springs for nineteen (19) years now; held
a variety of positions in the Department; undercover work; investigations; Iwas a
Supervisor for a while. You name it; I pretty much did it, except Code Enforcement."
Chairman Matisak asked, "Can I get a Motion to Approve the Qualifications as
presented?"

Assistant to the City Clerk Harker called the Case forward to the Board.
Chairman Matisak asked, "Is the Respondent present for this Hearing this evening?"
Inspector Cathy Davidson, Code Enforcement Officer, Code Enforcement Bureau
replied, "He is. Both parties are." Chairman Matisak continued, "Who is going to be
presenting for the City?" Inspector Davidson replied, "Myself. Inspector Davidson."
Inspector Davison stated, "This Property was sited on February 26, 2008 and given a
Notice of Violation. This Property failed Re-Inspection March 10, 2008. Re-inspected
again on April 9`h [2008] and April 28~I', 2008. This Property is still in Non-Compliance
and we are asking for Finding of Fact and Relief [Order]."

Chairman Matisak asked Inspector Davison, "Did you want to enter in this PowerPoint in
as Evidence this evening?" Inspector Davison replied, "Yes." Chairman Matisak
remarked, "It will be so noted and it will be marked as `WS 1'. Do you have a
service..." Inspector Davidson commented, "...I do..." Chairman Matisak continued,
"...Method of service to submit?" Inspector Davidson replied, "Yes, Sir, Certified Mail."
Chairman Matisak stated, "We will go ahead and mark those as `WS 2' and `WS 3'."
Discussion.
Vice Chairman Pitts asked, "Did you have an opportunity to talk to the Respondent prior
to -this evening..." Inspector Davison commented, "...I did..." Vice Chairman Pitts
continued, "...During the several months that this has been going on?" Inspector
Davidson replied, "No." Vice Chairman Pitts asked, "When was the first time that you
had an opportunity to speak with him?" Inspector Davidson replied, "February 26`I'
[2008]. I wrote him for `Obstruction of Sidewalk'." Inspector Davidson continued,
"And that was it. And also told them about the `Junk and Debris' then, in February
[2008], the first Notice."
Mr. Gregory Malenchek, 618 Locust Court, Winter Springs, FloYida: said, "Well,
basically my Case, I don't have aCase - my main thing is that the things did need to be
moved so -there's no argument as far as the things being there. All I can do is offer
those circumstances to what happened that kind of created that situation."
Continuing, Mr. Malenchek explained, "The reason why it took me so long to move this
or get those things taken care of is just because my schedule has been that, that it has
been very, very, very difficult. It's just working nights and days. I have since corrected
almost all of the situation. The only thing that is left there is that one (1) large machine
and the small wood pile that's by the sidewalk, which will -can be removed by
tomorrow."
Chairman Matisak asked, "When you say `large machine', what are you referring to?"
Brief discussion.
Continuing, Chairman Matisak inquired, "What is the machine? You keep referring it to
as a `large machine'. Specifically, what is it?" Mr. Malenchek answered, "It is a
machine that -makes printing plates." Mr. Malenchek continued, "Anderson & Vreeland
All-in-One Plate Making Unit." Discussion.
Photographs that were provided by the Respondent were shown to the Code Enforcement
Board Members.
Chairman Matisak asked regarding the photographs being shown by the Respondent,
"These are taken as of when?" Mr. Malenchek remarked, "Before I came here, about two
(2) hours ago." Chairman Matisak asked, "Taken today?" Mr. Malenchek responded,
"Yes."

Chairman Matisak asked, "Does the City wish to review those before their submitted into
Evidence; any objection?" No objections were voiced.
Discussion continued.
Chairman Matisak stated, "The first one that we will see will be labeled as `R 1'; we are
going to label these individually - so, that is what we are reviewing now. Can you tell us
what this is a picture of, Sir?" Mr. Malenchek commented, "It's a picture of the side of
my house where the paint cans were." Nluch discussion.
Chairman Matisak stated, "The second photo, we will mark as Evidence as `R 2'. And
can you tell us what this is a photo of, Sir?" Mr. Malenchek responded, "That's a photo
of my driveway -basically the area right in front of the garage where most of the -things
that were in question were stored."
Chairman Matisak asked, "And you mentioned earlier, you testified that you had the plate
making machine and some wood -what is the item that is black; looks like a cloth or a
blanket or something that is laying there. What is that?" Mr. Malenchek replied, "That
item to the left there that looks black -the bottom part is some of the shingles from when
I had done my house. Those are going to be removed also."
Mr. Malenchek continued, "And the two (2) pieces of metal that you see on top are
actually car ramps." Chairman Matisak asked, "And those are going to be removed as
well?" Mr. Malenchek replied, "Yes, they will."
Board Member Dick Crenshaw said, "Can I ask what that thing on the right is?" Mr.
Malenchek replied, "That's some soil and fertilizer." Discussion.
Chairman Matisak asked, "Let's go ahead and look at `R 3'. This is the third photo that
we are viewing will be entered into Evidence as `R 3'. And Sir, can you tell us what this
is a photo of?" Mr. Malenchek replied, "That's the picture of the foyer or entrance way
to - my house." Chairman Matisak asked, "What was there?" Mr. Malenchek replied,
"There was just a few boxes." Mr. Malenchek continued, "And they've all been
removed." Much discussion.
Regarding the large plate making machine, Mr. Malenchek stated, "What I'm just going
to ask for is some - just a short time, even if it's a week - or ten (10) days or so to figure
out a solution for that particular part of the problem." Discussion.
Referencing the May 19, 2008 photo, Inspector Davidson stated, "All of this was still
there yesterday."

Vice Chairman Pitts asked Mr. Malenchek, "You took these pictures late this afternoon?"
Mr. Malenchek replied, "Yes, I did." Vice Chairman Pitts asked Inspector Davidson,
"Did you go there this morning?" Inspector Davidson replied, "Yes." Vice Chairman
Pitts continued, "And the materials still all there?" Inspector Davidson pointed out on the
projector screen which items were still in front of the Respondent's house.
Vice Chairman Pitts said, "But the Respondent is also already said that those were still
there, but everything else has disappeared, right, as of this morning when you were
there?" Inspector Davidson responded, "Right."
Mr. Malenchek stated, "I think that -the City was fair in how long they gave me to take
care it, even."
Chairman Matisak asked Mr. Malenchek, "Are you currently in Violation as of right
now?" Mr. Malenchek replied, "If that machine is there, than I am."
Mr. Malenchek asked, "If there is a timeframe that I can ask for -even if it's a brief one,
to figure out a way to remove that machine; to get it put it in a place." Chairman Matisak
said, "Now, earlier you had mentioned seven (7) to ten (10) days in your Testimony, is
that what you're looking for?" Mr. Malenchek replied, "Yes, it is."

REVIEWING THE EVIDENCE PRESENTED AT THIS HEARING, I FIND
THAT THE CODE ENFORCEMENT OFFICER HAS PROVEN HER CASE
BASED ON THE FOLLOWING:
FINDING OF FACT:
1. THAT THE RESPONDENTS WERE PROVIDED NOTICE BY THE
CODE ENFORCEMENT OFFICER IN ACCORDANCE WITH SECTION
2-59. OF THE CITY CODE THAT A VIOLATION OF SECTION 13-2.
(TRASH AND DEBRIS, JUNK -OUTDOOR STORAGE) OF THE CITY
CODE EXISTED.

PRESCRIBED BY CHAPTER 162.12 OF THE FLORIDA STATUTES AND
THE RESPONDENT WAS PRESENT AT THIS HEARING.
3. THE RESPONDENT WAS PROVIDED A REASONABLE TIME TO
CORRECT THE VIOLATION.
4. THE RESPONDENT FAILED OR REFUSED TO CORRECT THE
VIOLATION WITHIN THE TIME PROVIDED.
5. THE VIOLATION CONTINUES TO EXIST UPON THE RESPONDENT'S
PROPERTY.
THEREFORE, I MOVE THAT THIS BOARD FIND THAT MR. GREGORY A.
AND MS. DEBRA MALENCHEK HAVE VIOLATED SECTION 13-2. (TRASH
AND DEBRIS, JUNK -OUTDOOR STORAGE) OF THE CITY CODE AND A
JUDGMENT OF `GUILTY' BE ORDERED FOR THE RECORD. I FURTHER
MOVE THAT AN APPROPRIATE RELIEF ORDER BE ISSUED
IMMEDIATELY BY THE CODE ENFORCEMENT BOARD." FULL READING

Chairman Matisak said, "At this point we have a tentative Motion for ten (10) days - to
remove the plate making machine; four (4) days for all the other items that would cause
this Property to be in Violation. The minimum of one hundred dollars ($100.00) and a
Repeat of two hundred and fifty dollars ($250.00); and this would fall under Relief Order
`A'. Do I have a Motion?"

RELIEF ORDER:
"THE CITY OF WINTER SPRINGS VERSUS MR. GREGORY A. AND MS.
DEBRA MALENCHEK, CASE NUMBER - 08-0017190 HAVING BEEN FOUND
`GUILTY' FOR VIOLATING SECTION 13-2. (TRASH AND DEBRIS, JUNK -
OUTDOOR STORAGE) OF THE CITY CODE, I MOVE THAT THE
RESPONDENT BE GIVEN FOUR (4) DAYS AFTER NOTIFICATION TO -
REMOVE THE OTHER MISCELLANEOUS ITEMS AND TEN (10) DAYS TO
REMOVE THE LARGE PIECE OF EQUIPMENT.
IF THE RESPONDENT FAILS TO -CORRECT THE VIOLATION WITHIN
THE TIME PROVIDED, A FINE OF A HUNDRED DOLLARS ($100.00) -WILL
BE IMPOSED PER DAY UNTIL COMPLIANCE HAS BEEN VERIFIED BY A
CODE ENFORCEMENT OFFICER FOR THE CITY OF WINTER SPRINGS.
FURTHERMORE, ANY OR ALL FUTURE REOCCURRENCES OF THIS
VIOLATION WILL BE CONSIDERED A REPEAT OFFENSE. A REPEAT
VIOLATION WILL NECESSITATE FURTHER PROCEEDINGS WITHOUT
THE OPPORTUNITY TO CORRECT THE REPEAT VIOLATION. THE FINE
FOR A REPEAT VIOLATION WILL BE TWO HUNDRED AND FIFTY
DOLLARS ($250.00) PER DAY BEGINNING ON THE FIRST DAY THE
REPEAT VIOLATION IS FOUND TO EXIST BY A CODE ENFORCEMENT
OFFICER.

Corporal Flannigan said, "The Property was sited on December 4th, 2007 and again on
April 3`d, 2008. It failed inspection on April 8th [2008] and again on April 22"d [2008].
Certified Mail was received and signed for on April 16th [2008]. The Property was
Posted by myself on May 10th [2008] with the Violation Notice and the Meeting for
tonight. The Property is still -non-compliant. We are asking for Finding of Fact and
Relief [Order] on this."
Chairman Matisak asked, "The PowerPoint and its photographs, you -wish to enter those
into Evidence?" Corporal Flannigan replied, "Yes, Sir." Chairman Matisak continued,
"The PowerPoint in its totality will be entered in as `WS 1'. Do you have method of
service this evening for this Case?" Corporal Flannigan replied, "Yes, Sir, I do."
Chairman Matisak said, "The method of service, we will go ahead and submit that as
`WS 2'." Chairman Matisak continued, "We have actually a couple of them. So, we will

Tolleson replied, "Mr. Chairman, I can testify that it is."
Board Member Crenshaw stated, "I worked for Alternative Leasing [Inc.] for a long time
and I -just wanted that to be known." Chairman Matisak asked, "Do you currently work
for Alternative Leasing [Inc.]?" Board Member Crenshaw replied, "No." Chairman
Matisak continued to ask, "Do you own stock in the company?" Board Member
Crenshaw responded by saying, "No." Chairman Matisak asked, "Are you a partner or a
partial owner in the company?" Board Member Crenshaw answered, "No." Chairman
Matisak continued, "Is there anyway that you would receive any financial implications
directly or indirectly?" Board Member Crenshaw added, "None whatsoever."

Chairman Matisak asked Captain Tolleson, "Have you spoken - to anybody from
Alternative Leasing, Inc. in the matter - of this Case?" Captain Tolleson answered, "No,
Sir, I have not." Captain Tolleson continued, "It should be noted that Corporal Flannigan
took this over from Lieutenant Marette Sims and I cannot testify whether she had -any
contact early on or not." Discussion.
Next, Chairman Matisak asked, "Who is the title holder at this point and time?" Captain
Tolleson replied, "Alternative Leasing, Incorporated."
Board Member Sherri P. Moore asked, "Did anyone ever sign for the service of the
Certified Mail?" Captain Tolleson replied, "Yes." Captain Tolleson continued, "And for
the Record, it was Alternative Leasing, Inc. that signed." Brief discussion.
Chairman Matisak said, "Can I have the Clerk go ahead and read the -signatures and the
agency they represent if that should be there?" Assistant to the City Clerk Harker stated,
"It says that a `Barbara A. Harpin' signed on April the 4tl' [2008]. And the second one is
a `Debbie Paschcel' -but that was on May 8th, 2008." Chairman Matisak asked, "And
both of them are from Alternative Leasing [Inc.] -does it state on the service?" Assistant
to the City Clerk Harker replied, "They didn't put their title or anything like that, but the
article is addressed to Alternative Leasing, Inc."

Chairman Matisak continued, "And then any costs will be added to the Fine. That is

And I just want to note too that they live locally on Wind Willow Circle, in Winter

Sir, it is." Chairman Matisak continued, "Other than methods of service, have you
verbally been able to speak to any of the Respondents?" Corporal Flannigan replied, "I
have not made contact with them, but I know they've received the Violations that I
posted on the door because they had been taking care of the one Violation that I did Post
along with the pool; the other Violation was taken care of. This pool, the issue was not
taken care of and - my Posted Violations were removed from the front door where I left
them so I know they got them."
Board Member Laura-Leigh Wood asked, "Isn't this the house that is in pre-foreclosure
on Winter Springs Boulevard?" Captain Tolleson replied, "Yes, it is." Discussion.
Chairman Matisak asked, "How did you become aware of this issue`?" Corporal
Flannigan said, "There was access of signs in front of the house that was also in a
Violation; that had been taken care o£ Like I said, one (1) of the signs said it was afixer-
upper house and like I said, to my knowledge, if it's a fixer-upper house, there's going to
be other issues. So, I took it upon myself to walk up between the houses on the City
easement -access and this is what I observed in the backyard." Further discussion.

Board Member Moore left the Meeting at 8:43 p. m.
Discussion continued.
Vice Chairman Pitts suggested, "I think somebody, and I think it ought to be you Mr.
Chairman, ought to say something to the -Commissioners."
Regarding items for the Chair to speak to the City Commission about, Chairman Matisak
said, "So, what are the expectations?" Discussion continued.
Next, Chairman Matisak commented, "So far, what I have is -looking at -our current
economic climate -the Board is open to meeting twice a month, but specifically what are
your expectations? The Board is open to -hear them -and to implement them."
Discussion.
Chairman Matisak asked, "Does somebody want that Motion for the Chair to go ahead
and present that materials as just discussed to the Commission?"
"SO MOVED." MOTION BY BOARD MEMBER WEISMAN. SECONDED BY
BOARD MEMBER ROERO. DISCUSSION.
