HomeMy WebLinkAbout2005 11 15 Code Enforcement Board Regular Minutes CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING NOVEMBER 15, 2005 CALL TO ORDER The Code Enforcement Board Regular Meeting of Tuesday, November 15, 2005, was called to Order at 7:00 p.m. by Chairman Mathew Matisak, in the Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida 32708). Roll Call: Chairman Mathew Matisak, present Vice Chairman Greg Roero, present Board Member Alisa Kaufman, present Board Member Paul Krebs, present Board Member Laurent Pellerin, present Board Member Leah Weisman, present Board Member Jim Wentz, present Alternate Board Member Dick Crenshaw, present Alternate Board Member James B. Pitts, present Chairman Matisak led the Pledge of Allegiance. PUBLIC INPUT No one spoke. Chairman Matisak inquired if there were any "Agenda Changes". Captain Glenn Tolleson, Police Department stated, "Yes, Sir there is. We were fortunate this month. We have brought all the Cases into Compliance except for one." Captain Tolleson added, "It will be Case Number 402.8 CONSENT AGENDA CONSENT 200. Office Of The City Clerk Approval Of The October 18, 2005 Regular Meeting Minutes. CHAIRMAN MATISAK STATED, "AT THIS TIME, COULD I GET A MOTION TO APPROVE THE OCTOBER 18 [2005] MINUTES?" (No Pool Enclosure And Stagnant Pool) Date Of Service: Certified - November 1, 2005 Inspector - Jose Romero Captain Tolleson stated, "Has been corrected." Furthermore, Captain Tolleson stated, "Was originally cited on September 1, 2005 and issued a Notice of Violation. The property failed reinspection on September 12, 2005 and again on October 27, 2005. Certified notice was sent and property posted on November 5, 2005. Upon receipt, the Respondent was given an additional three (3) days to correct." Captain Tolleson stated, "This has been an ongoing problem since Hurricane Charley. Various siding people have tried to come out and give bids; they have fallen through, unable to take insurance, whatever the case may be. They have a safety net up. We did allow that for a period of eight (8) months. And, that is the way it sits today." Captain Tolleson stated, "He [Robert T. Ali-Carr] indeed did have someone come out and submit an estimate, which I have." Captain Tolleson added, "They went in front of Permitting; paid for permitting and therein lies the problem. On October 15\ our Building Code added a lot more stringent rulings. This Company, unfortunately is in the process of trying to get all their paperwork which would allow them to work in the State of Florida. As I said, we do have a signed contract. Problem is they are trying to get there. So, basically tonight I am asking the Board to either - postpone it to allow that Company the opportunity, or you can rule 'Finding of Fact' only pending - so it does not have to come back to the Board." CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - NOVEMBER 15,2005 PAGE60F9 Board Member Jim Wentz stated, "Now with this new Building Code requirement, how extensive and hard is it going to be for this Company to come into Compliance in a matter of a short time?" Captain Tolleson stated, "It is a matter of bringing up the Workman's Comp (Compensation) insurance. Their State license. They are not the only company going through that process. Almost every Bidder in the State of Florida is going through that process." Discussion. Mrs. Beulah B. Ali-Carr, 1775 Seneca Boulevard, Winter Springs, Florida: commented on the difficulty of acquiring a company to work on the pool. Discussion. "I MAKE A MOTION TO POSTPONE - CASE NUMBER 05-0010233, THE RESPONDENT ROBERT T. AND BEAULAH B. ALl-CARR, UNTIL NEXT REGULARLY SCHEDULED MEETING OF THE CODE ENFORCEMENT BOARD." MOTION BY BOARD MEMBER KAUFMAN. SECONDED BY VICE CHAIRMAN ROERO. DISCUSSION. VOTE: VICE CHAIRMAN ROERO: AYE BOARD MEMBER WEISMAN: AYE CHAIRMAN MA TISAK: AYE BOARD MEMBER KREBS: AYE BOARDMEMBERKAUFMAN: AYE BOARD MEMBER PELLERIN: AYE BOARD MEMBER WENTZ: AYE MOTION CARRIED. Board Member Wentz stated, "If for whatever reason they do not have - can you follow up with the Contractor to make sure they send a letter stating that?" Captain Tolleson stated, "Yes." Chairman Matisak stated, "Do I have Consent of the Board?" Board Member Wentz stated, "Yes." Board Member Alisa Kaufman stated, "Yes." There were not objections from the other Board Members. REPORTS Chairman Matisak stated, "Please disregard the Scripts and then the next Regularly scheduled Meeting we will- take a look at the updated ones." Regarding Permitting Codes on the "Water bill", Board Member Dick Crenshaw stated, "They said they could not do anything until Captain Tolleson got the word up." Chairman Matisak stated, "Captain Tolleson, is that something you are already - doing is trying to get those back on there?" Captain Tolleson stated, "Yes." Alternate Board Member James B. Pitts stated, "We shouldn't do it just for the Arborist situation. I think one of the most common offenses we have in here are either commercial vehicles or unlicensed vehicles. There could be a message on there every other month for one of the Codes that we have. We have so many new residents in the community who are not aware of what our Code situation is." Chairman Matisak stated, "I think that is a good idea. Maybe a 'Code of the Month'. Something that we could put on there on a rotating basis to educate the citizens." Board Member Kaufman stated, "I would be more than happy if you tell me who I need to talk to or if we want to coordinate it?" Captain Tolleson stated, "That is fine. Send me an email- and I will send it to you." Regarding an Instructional Speaker for the Code Enforcement Board, Board Member Kaufman stated, "Weare going to be working on possibly getting a Speaker to come in here?" Captain Tolleson stated, "That is going to be after the first of the year." With discussion on Code Enforcement Classes to be conducted by Captain Tolleson, Captain Tolleson stated, "It is about three (3) to four (4) hours. We are setting it up. I am going to be doing two (2) night classes, two (2) day classes. I was going to poll the Board to see how many of you would be interested in attending." Captain Tolleson stated, "You can make either one of the four (4)." Captain Tolleson stated, "How many would be interested in attending?" All Board Members raised their hands. Captain Tolleson stated, "I will get with Debbie [Franklin, Deputy City Clerk] and have her send it out." Vice Chairman Roero stated, "Or, you can have it by the next Meeting?" Captain Tolleson stated, "Yes." Regarding forwarding email, Alternate Board Member Crenshaw noted, "We can pass a lot of stuff onto Debbie [Franklin]." Chairman Matisak stated, "So, definitely electronic communication works as well. Is anybody opposed to that?" There were no objections from the Board Members. CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING - NOVEMBER 15,2005 PAGE 9 OF 9 Regarding the book that holds the Code of Ordinances, Board Member Kaufman stated, "I would like to have one and have it at home." Chairman Matisak asked, "Is there anybody else - who would like to have their own?" Chairman Matisak noted that Board Member Crenshaw would also like to have a book. CHAIRMAN MATISAK STATED, "LET ME TAKE A - VOTE TO SEE IF WHETHER OR NOT THE RECOMMENDATION IS TO SUPPLY EACH BOARD MEMBER WITH THEIR OWN COPY OF THE CODE OF ORDINANCES." VOTE: BOARD MEMBER WEISMAN: NAY CHAIRMANMATISAK: NAY BOARD MEMBER PELLERIN: NAY BOARD MEMBER KREBS: NAY BOARD MEMBER KAUFMAN: AYE VICE CHAIRMAN ROERO: NAY BOARD MEMBER WENTZ: NAY MOTION DID NOT CARRY. Chairman Matisak stated, "Is there a Consensus for those who would like to receive a copy? Anybody disagree?" There were no objections by the Board Members. Chairman Matisak added, "Those who would like, can talk to the City Clerk [Andrea Lorenzo- Luaces] and request a copy of the Code of Ordinances." FUTURE AGENDA ITEMS N one were noted.
