Roll Call: Chairman Mathew Matisak, present Vice Chairman Greg Roero, present Board Member Alisa Kaufman, present Board Member Paul Krebs, present Board Member Laurent Pellerin, present Board Member Leah Weisman, present Board Member Jim Wentz, present Alternate Board Member Dick Crenshaw, present Alternate Board Member James B. Firoz Section 13-2. (Untended Grass And Weeds) Date Of Service: Certified - July 22, 2005 Inspector - Cathy Davidson Captain Tolleson stated, "This case was originally heard before this Board on September 21, 2004. The Board found - Mr. [Perry S.] Firoz - not in Compliance that night. The Board's Order stated that any further Violation would impose a Fine of 'One Hundred Dollars ($100.00) a day per Violation'. Certified Notice - was sent and property was posted on August 6th. The property's back yard is currently - not in Compliance. We are asking for Finding of Fact and Relief [Order] in the amount of three thousand four hundred dollars ($3,400.00) for thirty-four (34) days of Non-Compliance at one hundred dollars ($100.00) a day, per the Boards Order starting July 17, 2005 that it was in Violation." With discussion, Ms. Cathy Davidson, Code Enforcement Inspector, Police Department, answered questions from the Members of the Code Enforcement Board. "THERE HAS BEEN NO PROOF OF EXTENUATING CIRCUMSTANCES - AND THEREFORE THE FINE ST ANDS AT THIRTY-FOUR HUNDRED DOLLARS ($3,400.00)." MOTION BY CHAIRMAN MATISAK. SECONDED BY BOARD MEMBER KAUFMAN. DISCUSSION. VOTE: CHAIRMAN MA TISAK: AYE VICE CHAIRMAN ROERO: AYE BOARD MEMBER WEISMAN: AYE BOARD MEMBER WENTZ: AYE BOARD MEMBER PELLERIN : AYE BOARD MEMBER KREBS: AYE BOARD MEMBER KAUFMAN : AYE MOTION CARRIED. REPORTS Board Member Alisa Kaufman stated, "Did we want to try to - come up with some wording - 'No Proof Of Any Extenuating Circumstances'; parameters on how we can make a Motion?" Chairman Matisak stated, "Sure, I can get something put together so we can put it in our books - to look at - next month. That would be fine. For the next Meeting, I will go ahead and do another insert for the pages for the 'Continuance Cases'. And, then we can look at them as a Board, approve them and we can put them in our packages so that we have some scripting. Is everybody okay with that?"
