I. CALL TO ORDER
Chairman James B. Pitts called the Regular Meeting of the Code Enforcement Board to order
on Tuesday, June 29, 2004 at 7:00 p.m., (Rescheduled from June 15, 2004) in the
Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434,
Winter Springs, Florida 32708).

Chairman Pitts inquired if there were any "Agenda Changes". Captain Glenn Tolleson,
Police Department, stated, "Yes sir. Tonight we will be hearing Case[s] 'C', 'H', and '1'."
Deputy City Clerk Debbie Franklin, swore in those persons who may be providing testimony
during the presentation of tonight's cases,

Captain Tolleson stated, "Was originally cited February 23, 2004 and issued a notice of
Violation warning and again on April the 11th [2004]. This was originally scheduled for the
May Meeting and brought back for this Meeting. The property failed reinspection on April
18, 2004. Also failed inspection yesterday. Certified notice was sent and signed for on May
2th [2004] for this meeting. It is not in compliance and we are asking for a Finding of Fact
and Relief, however, the dumpster was emptied this afternoon, but you can see they - have
furniture behind the dumpster. It has been an ongoing problem."

FINDING OF FACT:
"IN THE CASE OF THE CITY OF WINTER SPRINGS VERSUS SUSAN N. RUMPF,
CODE ENFORCEMENT BOARD NUMBER 04-[000]5187, THE CODE
ENFORCEMENT BOARD HAS READ THE COMPLAINT FILED AND THE
WRITTEN INFORMATION PREPARED BY THE CODE INSPECTOR AND
HEARD AT THIS HEARING THE SWORN TESTIMONY OF THE CODE
INSPECTOR.
BASED UPON THE EVIDENCE OF THE TESTIMONY PRESENTED AT THIS
HEARING, I MOVE THE CODE ENFORCEMENT BOARD FIND THAT THE
VIOLATOR SUSAN N. RUMPF WAS PROVIDED NOTICE IN ACCORDANCE
WITH SECTION 2-59. OF THE CITY CODE. THAT A VIOLATION OF SECTION
13-2. OF THE CITY CODE EXISTS.
(1) THE VIOLATOR WAS PROVIDED A REASONABLE TIME TO
CORRECT SAID VIOLATION.
(2) THAT THE VIOLATOR FAILED OR REFUSED TO CORRECT
SUCH VIOLATION WITHIN THE TIME PROVIDED.
(3) THAT THE VIOLATOR [WAS] PROVIDED NOTICE IN
ACCORDANCE WITH THE SECTION 2-59. OF THE CITY CODE OF
THE HEARING BEFORE THE CODE ENFORCEMENT BOARD AND
THE VIOLATOR WAS NOT PRESENT AT THIS HEARING.
(4) THAT SAID VIOLATION EXISTS OR EXISTED UPON THE
VIOLATORS PROPERTY.
I FURTHER MOVE THAT THE APPROPRIATE RELIEF ORDER BE ISSUED
IMMEDIATELY BY THE CODE ENFORCEMENT BOARD." MOTION BY

CODE ENFORCEMENT BOARD NUMBER 04-[000]5187 THE VIOLA TOR SUSAN
N. RUMPF HAS BEEN FOUND IN.VIOLATION OF SECTION 13-2. OF THE CITY
CODE.
I MOVE THAT THE VIOLA TOR BE GIVEN FIVE (5) DAYS AFTER
NOTIFICATION TO CORRECT THIS VIOLATION OF THE CITY CODE. IF THE
VIOLATION IS NOT CORRECTED WITHIN THE TIME PROVIDED, A FINE OF
ONE HUNDRED DOLLARS ($100.00) PER DAY WILL BE IMPOSED UNTIL
COMPLIANCE IS ACHIEVED AND IS VERIFIED BY THE CODE
ENFORCEMENT INSPECTOR FOR THE CITY OF WINTER SPRINGS.
FURTHERMORE, ANY AND ALL FUTURE REOCCURRENCES OF THIS
VIOLATION AFTER COMPLIANCE HAS BEEN ACHIEVED WILL
NECESSITATE FURTHER PROCEEDINGS BEFORE THE CODE

Captain Tolleson stated, "Was originally cited on April 15th of 2004 and issued a Notice of
Violation warning. Failed reinspection on April the 29th of 2004. Certified Mail and Notice
was sent and signed for on June 3rd [2004] by both [Mr.] Juan Cruz and [Ms.] Erica Bolton.
Currently, it is not in compliance as of yesterday, June 29, 2004. We are asking for a Finding
of Fact and Relief."

that vehicle back together?" Mr. Sola stated, "About thirty (30) days."
Board Member Mathew Matisak read City Code Section 20-433. Storage Repair into the
record. Discussion.
Mr. Sola indicated that Section 20-433. is unclear regarding "disabled and unregistered
vehicles". Captain Tolleson indicated that another charge from Section 12.53. could have
been added. Board Member Matisak stated, "Okay, noted."
Furthermore, Captain Tolleson requested clarification on the longevity and Board Member
Matisak stated, "How long has the car been - in that condition?" Board Member Matisak
repeated the information for the record, "Twenty (20) days." Then Board Member Matisak
replied, "Captain Tolleson wanted point of clarification, we got it."

FIFTY DOLLARS ($50.00) WILL BE IMPOSED PER DAY UNTIL COMPLIANCE

Chairman Pitts stated for clarification, "Let me explain what has happened. You have ten
(10) days from today to correct the Violation, which means either get the vehicle licensed and
running or get it off the property. If in fact that does not happen, a fine of Fifty Dollars
($50.00) per day starts to run. Furthermore, Chairman Pitts stated, "If in fact you correct the
Violation - and [it] is satisfactory to the Captain [Tolleson], then there will be no fine.

However, if in fact, there is another Violation of the same Code, if for some reason that car
comes back and is not licensed and is there for more than thirty (30) days being repaired, then
without even coming to us [Code Enforcement Board] automatically a fine up to Five
Hundred Dollars ($500.00) a day can be imposed on you."
Board Member Thompson stated, "You [Chairman Pitts] had mentioned - 'that' car coming
back. This has to do with any car that comes back disabled on that property." Discussion.
Board Member Dick Crenshaw stated, "You can park in your back yard - as long as the car is
running. "

Captain Tolleson stated, "Was originally cited [on] May 27, 2004 and issued a Notice of
Violation warning. Property was brought to us by the Permitting Division. Certified Notice
was sent and property posted on June 18 [2004]. Is currently not in compliance as of today
[June 29, 2004]. A permit has not been issued for it. However, they have applied for it."

With discussion, Captain Tolleson stated, "If you would just give me a 'Finding of Fact' on
this one and allow it to go through the permitting process."
Ms. Patricia Foth, US Identity Group, 2120 North Ronald Reagan Boulevard, Longwood,
Florida: addressed the Code Enforcement Board regarding the permit process. Ms. Fote
stated, "Right now it is currently on a raceway with a background panel. We have revised the
print, re-engineered them, and they are going to be standing off the wall no more than five (5)
inches. So, it is going to meet Code."

LEFT - THE AREA. HE IS OFF THE BOARD [CODE ENFORCEMENT]. HE WAS
THE VICE CHAIR. WE ARE IN NEED OF A VICE CHAIR AT THIS POINT AND I
WOULD LIKE TO NOMINATE MATHEW [BOARD MEMBER MATISAK] FOR
THAT POSITION." MOTION BY CHAIRMAN PITTS. SECONDED BY BOARD
MEMBER KREBS. DISCUSSION.

With further discussion on absences, Chairman Pitts noted, "I would suggest that the Clerk's
[Andrea Lorenzo-Luaces] office be notified. They [Office of the City Clerk] can notify me.
They [Office of the City Clerk] would know in fact if there was not going to be a quorum and
notify all of us [Code Enforcement Board] that we would not have to come." Chairman Pitts
clarified, "If you are not going to be here, forty-eight (48) hours in advance, unless it is an
emergency, call the Clerk's [Lorenzo-Luaces] office and tell them [Office of the City Clerk]
you are not going to be here and why."
Board Member Thompson stated, "What I would recommend is - let us update our phone
list, mailing list. We have new Members and I think we should get that passed out."

Vice Chairman Matisak stated, "I would like to - thank Captain Tolleson and Code for
helping get that Training Session put together. I thought it was very informative."
Chairman Pitts stated, "Notify the City Clerk [Lorenzo-Luaces] that I [Chairman Pitts] will
call the City Clerk's office [Lorenzo-Luaces] the day before the meeting. No, the City Clerk
[Lorenzo-Luaces] can call me the day before the meeting." Furthermore, Chairman Pitts
stated, "And in my absence - notify the Vice Chair."
Vice Chairman Matisak presented working drafts of the "Finding of Facts" and "Relief
Orders" for discussion and approval. Discussion.
With discussion, Vice Chairman Matisak stated, "One of the first items that I want to bring
up as a Motion for this Board [Code Enforcement] - is we refer to the individual in front of
us as a Violator as soon as they come up and the Judgment has not been rendered against
them." Vice Chairman Matisak also stated, "I personally think that that is offensive to a
citizen who mayor may not be in Violation. That is why they are here, for us to determine
that. "
Vice Chairman Matisak suggested to replace the word 'Violator' with 'Respondent', which is
the verbiage that is used by Seminole County Code Enforcement. Vice Chairman Matisak
also stated, "It still gives the legal definition of the individual here and I think it is a more
respectful term to the citizen."
"I WOULD LIKE TO MAKE A MOTION THAT IT IS EFFECTIVE AT OUR NEXT
MEETING THAT WE REFER TO INDIVIDUALS IN FRONT OF THE BOARD
[CODE ENFORCEMENT] AS RESPONDENTS AND NOT VIOLATORS." MOTION
BY VICE CHAIRMAN MATISAK. SECONDED BY BOARD MEMBER KREBS.

"I MOVE THAT THE WORD 'RESPONDENT' REPLACES THE VIOLATOR IN
ALL FUTURE DEALINGS WITH CODE [ENFORCEMENT BOARD]. MOTION BY

Vice Chairman Matisak stated for the record clarification of the proposed "Orders".
With discussion and review of a proposal to change the "Agenda" format, Vice Chairman
Matisak stated, "There is an ordinance in place that dictates the format of the' Agenda' and
'Minutes' for the City Code so we cannot override that. However, what I would like to do is
add a couple of pieces of information to the 'Agenda' and the 'Minutes' so that the average
citizen when reviewing it, via print, can see some things. The first - is that when we have a
swearing of witnesses, each person is listed, their name, it does not have to be their address,
just their name and that they were sworn in and have that presented on the 'Minutes'. Also,
Vice Chairman Matisak stated, "I think there is a remedy for that where they can fill out the
sheets like they do for the City Commission. I think that would be in our interest as well."
Furthermore, Vice Chairman Matisak stated, "The other - is under the cases, that the
'Method of Service' be listed. So, if by Certified Mail, in the paper, whatever it is, and the
date that the service was issued, be included for each case for the Agenda.

Discussion ensued regarding adding the history of "counts" for each case. Captain Tolleson
stated, "Basically, we won't run all those [cases] together." Captain Tolleson stated further,
"Now, if it is a 'Repeat Violation' I am going to give you that information and it is going to
be on your' Agenda'."
Vice Chairman Matisak offered, "And that was one of the items on here - that 'continued
cases', 'repeat cases', and 'new cases' be classified separately so that they can be identified
on the 'Agenda' and 'Minutes'." Captain Tolleson stated, "Currently, the way it is set right
now is 'Repeat Cases' are always first." Discussion.
VICE CHAIRMAN MATISAK STATED FURTHER, "ESSENTIALLY, WHAT I AM
ASKING FOR IS - THE METHOD OF SERVICE, WHICH IS REQUIRED. THA T
WE ARE REQUIRED TO SEE THAT, BE NOTIFIED OF IT, AND HAVE
EVERYBODY ELSE NOTIFIED OF IT AND THE DATE OF SERVICE; TO SPLIT
OUT OUR CASES UNDER - SECTION III, 'PUBLIC HEARINGS', SECTION A:
FOR CONTINUED CASES, [SECTION] B: FOR 'REPEAT OFFENDERS', AND
[SECTION] C: FOR 'NEW CASES' TO MAKE IT EASIER TO IDENTIFY WHO
ARE CONTINUING, WHO IS REPEATING, AND WHO IS BRAND NEW. JUST A
LITTLE BIT OF A CLEANUP, I THINK, IN THE REVIEW OF THE AGENDA.
THA T IS JUST MY MOTION."
FURTHERMORE, VICE CHAIRMAN MA TISAK STATED, "MY MOTION IS
THAT WE ADD 'METHOD OF SERVICE' AND 'DATE OF SERVICE' TO EACH
CASE AND WE HAVE - UNDER 'SECTION III, PUBLIC HEARINGS', WE HAVE
A SEPARATE COLUMN FOR 'CONTINUED CASES'; 'REPEAT OFFENDERS';
AND 'NEW CASES'. THA T IS MY MOTION." MOTION BY VICE CHAIRMAN
MA TISAK. SECONDED BY BOARD MEMBER KREBS. DISCUSSION.

"Relief Orders" to City Clerk Lorenzo-Luaces and to Captain Tolleson.
Board Member Crenshaw requested that the "Member List" be available at the Code
Enforcement Meetings.
