Authorization REQUEST: Public Works Department Responding to the Commissions Questions Regarding the Power Easement Fencing in Winding Hollow PURPOSE: The purpose of this Board item is to respond to the question from the City Commission that was raised at the July 12th meeting regarding the power easement fencing in Winding Hollow. CONSIDERATIONS: The staff has researched the situation regarding the chain link fences at the power easement crossings at Winding Hollow Boulevard, Twelve Oaks Drive and Winding Chase Boulevard. The majority of the power easement property is common property of the Winding Hollow HOA Staff is not aware of any code violations by the installation of the chain link fence at these locations. Mr. Dean Kowal of Winding Hollow is handling the fences for Winding Hollow and he has indicated that they have assumed ownership and maintenance responsibility. The Covenant for Easement Use with FP&L requires a gate and fence at these locations although not necessarily chain link. Mr. Kowal is having ongoing discussions with FP&L to possibly eliminate this requirement as part ofFP&L's proposed pole replacement and line upgrades along this easement which are scheduled to occur this fall, We have no objection to the removal of these fences, COMMISSION ACTION: None Required.
